AN EMERGENCY ORDINANCE ESTABLISHING A NEW TRUST AND AGENCY
FUND ENTITLED "SALES TAX COLLECTIONS", FOR THE PURPOSE
RECEIVING AND DISBURSING IN A FIDUCIARY CAPACITY ALL MONIES
THE CITY COLLECTS AS SALES TAX FOR RENTAL OF CITY
FACILITIES, TO RECORD AS REVENUE THE ADMINISTRATIVE SERVICE
FEE IN THE AMOUNT OF $15,000 THAT THE CITY IS PAID FOR
TRANSFERRING SAID SALES TAX COLLECTION TO THE STATE, AND
TRANSFERRING SAME TO THE GENERAL FUND AS CURRENT REVENUE;
CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City of Miami collects sales tax for rental of City
facilities; and
WHEREAS, said sales tax under State law must be distributed to the State of
Florida; and
WHEREAS, the State of Florida allows the City of Miami to keep an
administrative service fee to act as a fiduciary for said sales taxes; and
WHEREAS, the administrative service fee is $15,000 with $12,342 from Fund
Balance and $2,658 from current revenues; and
WHEREAS, said $15,000 is revenue to the General Fund;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The following Trust and Agency Fund is hereby established and
resources are hereby appropriated as described herein:
Fund Title: Sales Tax Collections
Resources: Administrative Service
Fee (3% on all Sales
Tax Collections) $15,000
Appropriations: Sales Tax Collections $15,000
Section 2. The herein Trust and Agency Fund is established for the purpose
receiving and disbursing in a fiduciary capacity all monies the City collects as
sales tax for rental of City facilities, to record as revenue the administrative
service fee in the amount of $15,000 that the City is paid for transferring said
sales tax collection to the State and transferring same to the General Fund.
Section 3. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisidns of this ordinance are hereby
repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or
word of this ordinance shall be held to be invalid, the remaining provisions of
this ordinance shall not be affected.
Section 5. The requirement of reading this ordinance on two separate days
is hereby dispensed with by an affirmative vote of not less than four -fifths of
the members of the Commission.
Section 6. This ordinance are hereby declared to be an emergency measure
on the grounds of urgent public need for the preservation of peace, health,
safety and property of the City of Miami and upon the further ground of the
necessity to make the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases of goods and
supplies and to generally carry on the functions and duties of municipal
affairs.

It is recommended that the attached emergen-
cy ordinance establishing a new trust and
agency fund entitled "Sales Tax Collec-
tions", for the purpose receiving and dis-
bursing in a fiduciary capacity all monies
the City collects as sales tax for rental of
City facilities, to record as revenue the
administrative service fee in the amount of
$15,000 that the City is paid for transfer-
ring said sales tax collections to the
State, and transferring same to the general
fund as current revenue, be passed.

The City of Miami is required to collect sales tax for the use of
its facilities.
This tax is deposited into a trust and agency fund for monthly
remittance to the Sate of Florida. For performing this collection
activity, the City receives an administration fee.
This ordinance will allow transfer of that fee from the trust and
agency fund to the general fund.
