HomeMy WebLinkAboutR-84-1141J-84-913 9/28/84 RESOLUTION NO. 84`114i A RESOLUTION CONCERNING THE BRICKELL BAY OFFICE TOWER PROJECT LOCATED AT APPROXIMATELY 1005 SOUTH BAYSHORE DRIVE, (MORE PARTICULARLY DESCRIBED HEREIN), A DEVELOPMENT OF REGIONAL IMPACT PROPOSED BY C. ROBERT CUSIC, TRUSTEE; MAKING FINDINGS; AUTHORIZING A DEVELOPMENT ORDER; APPROVING SAID PROJECT WITH MODIFICA- TIONS SUBJECT TO THE CONDITIONS OF THE DEVELOPMENT ORDER, THE APPLICATION FOR DEVELOPMENT APPROVAL, AND THE REPORT AND RECOMMENDATIONS OF THE SOUTH FLORIDA REGIONAL PLANNING COUNCIL; PROVIDING THAT THE PERMIT SHALL BE BINDING ON THE APPLICANT AND SUCCESSORS IN INTEREST; FURTHER, DIRECTING THE CITY CLERK TO SEND COPIES OF THE HEREIN RESOLUTION AND DEVELOPMENT ORDER TO AFFECTED AGENCIES AND THE DEVELOPER. WHEREAS, C. Robert Cusic, Trustee, has submitted a complete Application for Development Approval for a Development of Regional Impact to the South Florida Regional Planning Council pursuant to Section 380.06 Florida Statutes, and did receive a favorable recommendation for a proposed development order as set forth in the Report and Recommendations of the South Florida Regional Planning Council; and WHEREAS, the Miami Planning Advisory Board, at its meeting held on September 19, 1984, Item No. 2, following an advertised hearing, adopted Resolution No. PAB 104-84 by a 6 to 0 vote, recommending approval of the Development Order for the subject Brickell Bay Office Tower project, a Development of Regional Impact; and WHEREAS, a recommendation from the Miami Planning Advisory y Board has been forwarded as required by Ordinance No. 8290; and WHEREAS, the Miami City Commission has conducted a public hearing on October 10, 1984, having considered the Application for Development Approval and the Report and Recommendations of 1 the South Florida Regional Planning Council; and WHEREAS, the City Commission has determined that all legal requirements have been complied with; and WHERRikS, the City Commission deems it advisable and in the best interest of the general welfare of the City of Miami to CITY CQMMISSIC1�t ; MEETING OF OCT 3 l issue a Development Order as hereinafter set forth; i NOWt THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY A OF MIAMI, FLORIDA* { FINDINGS OF FACT Section 1. The following findings of fact are made with respect to the project: a. The Commission has determined that the project is in conformity with the adopted Miami Comprehensive Neighborhood Plan. b. The Commission has determined that the project is in accord with the district zoning classification of Zoning Ordinance No. 9500. c. The City Commission finds that the project would not adversely impact air quality, ground water, soils, animal life, vegetation, wastewater management or solid waste disposal, and further finds that it would have a number of positive impacts including: (1) Over 1,602 permanent new jobs would be generated by the project. Nearly 831 temporary full-time construction will also be generated, with nearly $38 million in total wages and 1,117 jobs added to the regional economy. (2) Ad Valorem revenues generated by this project will produce $310,213 for Dade County, $470,536 for the City of Miami, and $354,895 for the School Board. (3) Access and circulation to and from the site should be substantially improved by street and signaliza- tion changes at Brickell and Southeast 12th Terrace/Southeast 13th Street, Southeast 14th Street, Southwest 3rd Avenue/Southwest 13th Street/Southwest 15th Road, and numerous planned and programmed public improvements, including a proposed Metromover for the Brickell area. d. The City Commission also finds that: (1) The project will have a favorable impact on the s economy of the City; and (2) The project will efficiently use public transporta- tion facilities; and (3) The project will favorably affect the need for people to find adequate housing reasonably accessible to their places of employment; and (4) The project will efficiently use necessary public facilities; and (5) The project will have a favorable impact on the environment and natural resources of the City; and (6) The project will not adversely affect living conditions in the neighborhood; and (7) The project would no adversely affect public safety; and (8) That there is a public need for the project. Section 2. A Development Order, attached hereto as Exhibit "A" and made a part thereof by reference, approving with modification, the Brickell Bay Office Tower Project, a Develop- ment of Regional Impact, proposed by C. Robert Cusic, Trustee, for RENAISSANCE TRACT "A" (118-14) of the Public Records of Dade County, Florida, at 1005 South Bayshore Drive, be and the same is hereby granted and issued. Section 3. The Application for Development Approval is incorporated herein by reference and relied upon by the parties in discharging their statutory duties under Section 380.06, Florida Statutes. Substantial compliance with the representa- tions contained in the Application for Development Approval is a condition for approval unless waived or modified by agreement among the parties. Section 4. The Report and Recommendations of the South Florida Regional Planning Council, attached hereto as Exhibit "B" are incorporated herein by reference. Section 5. The Development Order, as approved, shall be -3- t binding upon the applicants and any successors in interest. Section 6. The City Clerk is hereby authorized and directed to send certified copies of this Resolution immediately to: the Florida Department of Veteran and Community Affairs, Division of Local Resource Management, 2571 Executive Center Circle East, Tallahassee, Florida 32301; the South Florida Regional Planning Council, 3440 Hollywood Boulevard, Suite 140, Hollywood, Florida 33021; and Clifford A. Schulman, Esq., Greenberg, Traurig, Askew, Hoffman, Lipoff, Rosen and Quentel, P.A., 1401 Brickell Avenue, Miami, Florida 33131. Section 8. Implement best management practices to minimize air pollution, including: -- Traffic flow improvements pursuant to Condition 13 below; -- Provision of bus and metrorail schedules and routes in project common areas; -- Provision of bus and metrorail schedules and routes in project common areas; -- Provision of at least five percent of all employee } parking spaces for preferentially located car or van pool parking; and -- Establishment and operation of a van or car pool program to encourage ride sharing. -=` 3. Obtain administrative approval from Dade County DERM for occupancy of the restaurant, bank, and retail spaces below the 100-year base flood elevation, or modify the building structure to comply with Federal and County flood -design criteria. 4. = 5. 1 6. Obtain all necessary approvals from Dade County Water and Sewer Authority (WASA) for provision of water and wastewater service to the project, and from Dade County Public Works Department for solid waste disposal service, prior to issuance of any certificates of occupancy. 8. Require in all lease or sales agreements that: -- All areas within a facility with an SIC code identified by Table 5 of the Council DRI Assessment, as it may be amended by the Florida Department of Environmental Regulation, and where hazardous materials, as identified in Table 6 of that Assessment, as it may be amended, will be used, handled, stored, or displayed { will be constructed with impervious flooring without drains to allow cleanup of spills. Use the funds obtained pursuant to Condition 13 herein to construct the improvements identified in Condition 13 or the improvements approved as part of the current long-range transportation study for the Brickell area. In the event that the developer of 1221 Brickell chooses to construct these same improvements, pursuant to City Resolution #84- 5899 the City shall use the funds contributed by the Brickell Bay Office Tower DRI to reimburse the developer of 1221 Brickell. 22. Provide that the effectiveness of the Development Order shall be stayed and no development permits thereunder shall be granted, until such time as an Amended ADA, providing updated information, is submitted to the Council, County, and State and an Amended Development Order issued, if Applicant Conditions 01 through 16 are not substantially fulfilled within two (2) years from the effective date of the Development Order. Should the Development Order be stayed pursuant to this condition, nothing herein shall be construed to limit Condition 24 below that this Development Order runs with the land and its terms and conditions are binding on the Applicant, its successors, and/or assigns. General 23. The Applicant shall submit a report, twelve (12) months from the date of issuance of this Development Order and each twelve (12) months thereafter until a final Certificate of Occupancy is issued; to the South Florida Planning Council; the State of Florida Department of Community Affairs, Division of Local Resource Management; all affected permitting agencies and the Planning Director. The effectiveness of the Development' Order shall be stayed and no development permits thereunder shall be granted, until such time as an Amended ADA, providing updated information, is submitted to the Council, County, and State and an Amended Development Order issued, if the following activities are not substantially completed within two (2) years from the effective date of the Development Order: • Construct, or provide the funds, bonds, or letters of credit for recommended surface street improvements s required by Items 13 herein; • Obtain all required permits. Should the Development Order be stayed pursuant to this condition, nothing herein shall be construed to limit Item 28 below that this Development Order runs with the land and its terms and conditions are binding on the Applicant-, its successors, and/or assigns. 25. The applicant shall record the Brickell Bay. Office Tower Development Order with the Clerk, Dade County Circuit Court, pursuant to Section 380.06(14)(d), F.S., specifying that the Development Order runs with the land .and is binding on the Applicant, its successors, and/or assigns. The Applicant shall give notice to Richard P. Brinker - Clerk, Dade County Circuit Court, 73 West Flagler Street, ' Miami, Florida, 33130, for recording in the Official Records of Dade County, Florida,, as follows: a) That the City Commission of the City of Miami, Floridap has issued a Development Order for the Brieke.11 $ay Office Tower, a Development of Regional Impact located — j at approximately 1005 S. PART II - SUMMARY OF PROJECT IMPACTS A. ENVIRONMENT AND NATURAL RESOURCES 1. Air ' Tne Applicant's air pollutant dispersion modeling predicts maximum on -site one -hour and eight -hour carbon monoxide concentrations of 9.6 milligrams per aublc meter (mg /m3) and 5.8 mg/m3, respectively, for 1986, which do not exceed State criteria. However, there is no air quality monitoring station currently operating in the immediate vicinity of the site. Rather, the Applicant's modeling results are based upon an assumed maximum background carbon monoxide concentration of 4.1 mg/m3, which Is an average value for a large metropolitan area. Actual air sampling in nearby downtown Miami during recent years has revealed numerous exceedances of maximum allowable eight -hour average State criteria for carbon monoxide concentrations. ' i i Due to extensive development activity planned and underway in the Brickell area, and the associated increase in traffic, monitoring is necessary to establish baseline data for accurate Impact analysis of future development, Including the cumulative effects of non-DRI projects. The cumulative air quality effects of all development In this area should be monitored In order#to determine whether the City wlII be able, to maintain "attelnwant" status with ­&_-A_—A— '41 , a t r � f constraints on further development under a "non•attalnment" designation. To assist in developing required information, the Applicant should continuously monitor carbon monoxide concentrations for a period of two weeks at a sampling station location to be agreed upon, along with study parameters and reporting requirements, by the Applicant, the City, and Dade County Department of Environmental Resources Management (DERM). Also, the City should establish an air quality monitoring program in the Brlckell area and require monitoring by other developments in order to obtain accurate and reliable air quality data for the entire area. This program should coordinate the installation of monitoring stations throughout the area. The Applicant should also encourage the use of mass transit, bicycles, and ride sharing to reduce the auto traffic, hence the air pollution, generated by the project. Specifically: e transit schedules and routes should be provided in project comAwn areas; at least five percent of all employee parking spaces, to be located on the ground, basement, and first floor levels should be reserved for carpool and vanpool parking= e a car and/or van pool program should be implemented to encourage ride sharingz and e secure, on -site bicycle storage should be the provided. in addition to these measures, recommended transportation improvements, discussed in Part 11 0 below, should improve traffic flow In the area, further reducing air pollution created by the project. 2. Land and Flood Prone Areas The 1.7 acre project site has been cleared, and project construction has begun. Soil tests for other developments In the Brickeil Area have not revealed any significant constraints to construction. The project is located in tone A-14 of the Federal Flood insurance Administration (FIA) Rate Map with a minimum occupied -floor elevation of +11 feet NGVO, the 100-year flood level. The Applicant has built the space for the bank, a retail area, and a portion of the restaurant on the ground floor at an elgtatton.of +10.2 feet NGVO, and the remainder of the restaurant at the even � ' lower basement level. I 10 w. t � `M �I As built, the bank, retail area, and the entire restaurant are below the 100-year flood elevation, contrary to FIA regulations. The Applicant should obtain administrative approval from Dade County DERM, which administers FIA regulations locally, for occupancy of the restaurant, bank, and retail spaces below the 100-year base flood elevation, or modify the building to comply with the FIA criteria. Such administrative approvals are reviewed annually by FIA to determine if Dade County Is properly administering the Federal Flood Insurance Program and whether eligibility for Federal Flood Insurance and certain other forms of Federal assistance, including federally insured mortgages and loans and Federal disaster assistance, should be suspended. 3. Hydrology and Drainage Biscayne Bay is immediately to the east of the development site. The groundwater beneath the site is saline to brackish and unsuitable for direct human consumption. Groundwater flow beneath the site is generally eastward toward Biscayne Bay. The Applicant proposes to route all stormwater runoff from the site through sediment settlement tanks and, via two pumps, Into the ground at 119 to 120 feet below the site. Considerable quantities of heavy metals, oil, and grease will accumulate on the pavement of the eight -story roofed parking arse. t1 ;r .? y �a n • -r�i: r9-1 s , i i In order to mitigate potentially adverse effects upon groundwater and water quality in Biscayne Bay, the Applicant should not flush pollutants from the parking areas into the stormwater drainage system. Instead, the parking areas should be vacuum swept regularly to keep them clean. 4. Vegetation Under City requirements, the Applicant must plant at least 30 trees on -site. More than SO tress are included in the landscaping plan. Only non-poisonous and non-Invaslve native and exotic vegetation should be used, and the Applicant should remove all exotic, Invaslve species. S. Historical and Archaeological Sites The site does not contain any recorded archaeological or hiztoric sites according to the Metropolitan Dade County Historic Preservation Division. B. ECONOMY 1. Prolect Costs, The Applicant estimates a total project cost of $54.4 million (1984 dollars) . As shown In Table 2. an estimated $47.8 million-; (80 percent) Is to be spent in the Region. Fiscal Impact Using historic average expenditure data and 1983 millage rates, the project's net fiscal impact would be $367,000 for Mimi, $431,000 for Dade County, $2660000 for the Dade County School District, and $14,000 for the special districts combined, for a cumulative annual regional total of $1.1 million (Table 4). C. PUBLIC FACILITIES 1. Water Supply The Applicant has projected total average potable water demand to be 430200 gallons per day (GM) for the completed development. " The Miami Dade Water and Sewer Authority (WASH) has adequate capacity to serve the project, and the Applicant has an agreement with WASH to provide water for the revised project. i 2. I____ wastes generated at the Srickell Say Office Tower development will consist primarily of paper products, packaging, wood crating, landscaping debris, and discarded restaurant foodstuffs and perishables. The Applicant has not yet secured a commitment for disposal service for the revised project from the Dade Oounty Public Works Department. 4. Energy The Applicant proposes to use gas for restaurant cooking and electricity for the remainder of the development. Total energy consumption at project bulldout is estimated to be 23.9 billion BTUs, or 7 million kilowatt hours. This is equivalent to the energy content of 3,804 barrels of crude oil. Since this energy must be converted to electricity, three times this mount of energy, or 11,412 barrels of oil, must actually be burned at the power plant to provide electricity to the site. The Applicant proposes a number of energy conservation measures, including an east -west building orlentatlon, landscape shading of the plaza, flexible air conditioning systems (with an EER gre't`er than 12.0) able to cool a single floor, an energy monogement system, use of fluorescent rather then incandescent Ilghtiog, and 0 .4; 24 -1 ti. • hot crater temperatures set at 105OF or less. Police and Fire The Applicant proposes to provide an on -site security system to include key card access control and closed circuit television surveillance. The City Police Department will provide routine service to the site. The Applicant should consult with the Police Department to plan project features that will facilitate effective police operations. Adequate air space access for emergency helicopter evacuation should be included in the building design. The site is within the fire and emergency response area of Fire Station 14, of the Miami Fire Department, at 1105 SW 2nd Avenue. Emergency response time to the site is less than 4 minutes. Fire Station 04 contains one aerial and two engine companies. Review of construction plans by the City resulted in Applicant incorporation of a snake relief system for improved fire protection. D. TRANSPORTATION 1. Existing Traffic The traffic impact area (Figure 4) Is bounded by the Miami River 5 on the north, SW 26th load on the south, Biscayne Bay on the east, and 1-95 on the west. Environment The proposed project will not create an adverse impact upon the environment or natural resources. The applicant will conduct an air quality study for a period of two weeks, and will comply with Federal and County flood design criteria for those portions of the structure subject to 100-year base flood elevation regulations. Conditions are included in the Development Order in reference to traffic management, building design and energy consumption. S. Recommended Improvements and Fundina The past several years have seen unprecedented development in they is vicinity of Brickell Avenue as well -as in other areas of downtown 3 Miami. Of the thirteen major projects (Table 8) proposed or under construction in the 8rickeil area, ten are located on Brickell Avenue or South Bayshore•Drive. Only three projects are proposed s' for the immediate vicinity of the Brickell Metrorail Station. Altogether, over 30700,000 square feet of office and retail use, 'c and almost 1,700 residential or hotel units are under construction or proposed. Absorption of office space on Brickell Avenue from 1965 through 1979 averaged only 86,000 square feet per year, which increased to 119,000 square feet per year from December, 1981 to December, 1983. The opening of several large office buildings In downtown -= Miami caused the average annual occupancy rate north of the Miami River to fall from 97 percent in 1980-81 to 84 percent in June, 1984. Similarly, before construction and opening of almost 4 million square feet of office space on 8rickeil, average annual occupancy rates have already begun to fall soutn of the Miami River from their 1980-81 high of 99 percent to less then 97 percent. The cumulative and collective impacts of developments in the Brickell Area are of regional as well as local concern. The .Nyq • 9 �Y`v� f aq 'i d z long-term security of major private investments and realization of the beneficial returns that these projects represent to the Raglan in employment, construction expenditures, economic diversification and stabilization, and property taxes for essential services, all depend on the availability of adequate public services and facilities, including transportation facilities to provide the competitive accessibility needed to support existing development, as well as to attract and accommodate future development. The importance of competitive accessibility to regional activity centers is underscored by Council policy: ® Competitive accessibility within and between regional activity centers, as measured by acceptable levels of service - on local and regional access routes, and provision of adequate parking, should be maintained and, where possible, enhanced. (Section 29J-2 04S(S) F.A.C., Policy 2). _ The need for the City to undertake an infrastructure capacity study, focussing on balancing the amount of development permitted with the existing and feasible expanded capacities of the public Infrastructure serving the development, has previously been recognized by the Council and the City. Council policy holds that financing required transportation Improvements should be shared between the public sector and private development interests: Development sponsors should pay the marginal costs of upgrading existing transportation facilities, or the full cost of constructing new facilities, required by a specific development proposal. In addition, signal rephasing of that Intersection (S40,000) will be necessary. • Signalization of the intersection of Brickell Avenue/S.E. 14th Street (S50,000), restriping the westbound approach for• - a combined through and right -turn lane and an exclusive left -turn lane, and modification of the curb on the north side of the west leg to allow for a more direct through movement since the east and west legs of S.E. 14th Street are slightly offset (S20,000). m. Using square footage as a surrogate measure for traffic generation, the fair -share improvements cost for the Lincoln/Nasher, Tishman-Speyer/Equitable, and 1221 Brickell DRIB ranged between $0.24 and SO.29 per square foot. Using this range, the Brickell Bay Office Tower developer should fund between $771,000 and $93,000 of improvements. These funds should be provided to the City and earmarked by the City to reimburse the 1221 Brickell developer for constructed improvements in excess of nis fair share or to construct these same intersection improvements. r PART Ili - SUMMARY AND RECOMMENDATIONS The Development of Regional Impact assessment for Brickell Say Office Tower Indicates that the project Mould have a number of positive regional Impacts: e Up to 400 permanent new jobs Mould be generated by the project, with an additional 700 relocated from existing office space in the Region. Nearly 670 additional full-time jobs could be generated in the three South Florida counties, with a $14.2 million increase in total wages and $20.3 million in value added to the regional economy. e A net positive fiscal impact of $1.1 million dollars would be created by the project. Council evaluation indicates that the proposed project should not create adverse impact on ground water, soils, animal life, or vegetation. in terms . of adverse regional impact, the project would: e Increase potable water demand by an average of 43,200 gallons per'day. e increase annual energy demand within the Region by the equivalent of 3,804 barrels of residual oil. 4 2� _1 44 4.
