RESOLUTION NO. 84-11:89
A RESOLUTION'APPOINTING MARSHALL HARRIS,
HANNIBAL COX, AND REVEREND ANTHONY RAMOS
TO COMPRISE A PANEL OF ARBITRATORS FOR
THE PURPOSE OF MAKING FINDINGS ON
RECOMMENDATIONS FROM THE CITY MANAGER
FOR THE ASSESSMENT OF PENALTIES AGAINST
THE CABLE LICENSEE, AND PREPARING AND
SUBMITTING A WRITTEN REPORT OF THEIR
FINDINGS TO THE CITY COMMISSION;
PROVIDING FOR THE STAFF TO MAINTAIN
RECORDS OF THE PANEL OF ARBITRATORS; AND
AUTHORIZING AN AMOUNT NOT TO EXCEED
$30,000 FROM CABLE TELEVISION SPECIAL
REVENUE FUNDS FOR THE PURPOSE OF
PROVIDING STAFF SUPPORT AND EXPENSE
COMPENSATION TO SAID PANEL.
WHEREAS, the City Commission, on December 17, 1980, adopted
Ordinance No. 9223, Chapter 10.5, of the City Code, known and
cited as the "City of Miami Cable Television Regulation
Ordinance" (the "Enabling Ordinance"), providing for the terms,
provisions and conditions under which the City would grant a
cable television license to an approved Licensee; and
WHEREAS, the Commission enacted Ordinance No. 9332, adopted
October 19, 1981 (the "License Ordinance"), under which the
Commission granted a cable television license to Miami Tele-
communications, Inc. and Americable of Greater Miami, Ltd.
(together the "Licensee") for the operation and maintenance of a
cable television system within the City ; and
WHEREAS, the City Commission adopted Ordinance No. 9915 on
October 10, 1984, which provides for the establishment of a panel
of three arbitrators appointed by the City Commission; and
WHEREAS, on September 20, 1984 the City Commission by Motion
M84-977 appointed Marshall Harris, Hannibal Cox and Reverend
Anthony Ramos as arbitrators relating to existing cable
television licensee penalties; and
WHEREAS, said panel will receive recommendations for
penalties relating to the cable television licensee as to future
penalties to be charged to the cable licensee;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
OF MIAMI, FLORIDA:

Section 1. That Marshall Harris, Hannibal Cox and Reverend
Anthony Ramos are hereby appointed to serve as a panel of three
arbitrators who will serve at the pleasure of the Commission and
hear and consider all recommendations of the City Manager with
regard to the assessment of penalties against the licensee, and
shall submit a written report on their findings to the City
Commission, which findings shall be binding unless appealed by
either party to the City Commission, as provided by ordinance.
Section 2. An amount not to exceed $30,000 is hereby
allocated from Cable Television Special Revenue Funds for the
purpose of providing staff support and expense compensation to
the panel of arbitrators in order to perform their responsi-
bilities under the State law and Section 1004 of Ordinance No.
9332 as amended.
Section 3. The arbitration panel shall maintain records
pertaining to the deliberations of the panel of arbitrators
established as set forth herein, utilizing staff funded under
Section 2 of this Resolution.

support their activities be pre-
sented to the City Commission for
their approval."
On October 10, 1984, the City Commission passed Ordinance
No. 9915 establishing a new process for assessing penalties
against the cable licensee for alleged violations against the
Cable License Ordinance. By Motion M84-977 the City Commission,
i on September 20, 1984 appointed Marshall Harris, Hannibal Cox,
and Rev. Anthony Ramos to serve as a panel of arbitrators who
would hear and consider all recommendations of the City Manager
for the assessment of penalties against the cable television
licensee.
Under this process, it is preferable that the Administration
maintain an arms length approach in providing the staff support
_a to the panel of cable arbitrators. In order to accomplish this,
I am recommending that the staff be selected by and report to
the panel of arbitrators. Office space and administrative
support for that person can be provided by the City, or the panel
can make appropriate arrangements, using the funds allocated.
