J-84-1051 V RESOLUTION NO. 841282 =' A RESOLUTION AMENDING RESOLUTION NO. 83-787, ADOPTED SEPTEMBER 7, 1983, WHICH CONFIRMED THE ASSSESSMENT ROLL FOR CONSTRUCTION OF AVALON SANITARY SEWER IMPROVEMENT IN AVALON SANITARY SEWER IMPROVEMENT DISTRICT SR-5453-C (CENTERLINE SEWER) BY REDUCING THE TOTAL ASSESSMENT IN THE AMOUNT OF $905.25 AND THE INDIVIDUAL ASSESSMENT AGAINST PROPERTY NUMBER 01-4116-22-0150 IN A LIKE AMOUNT. WHEREAS, on September 7, 1983, the City Commission adopted Resolution No. 83-787, which confirmed the assessment roll for construction of AVALON SANITARY SEWER IMPROVEMENT in AVALON SANITARY SEWER IMPROVEMENT DISTRICT SR-5453-C (CENTERLINE SEWER); and WHEREAS, said assessment roll contains an excess charge of .3 $905.25 for sanitary sewer service built to serve property number 01-4116-22-0150; and WHEREAS, said property number 01-4116-22-0150 was found to have been assessed in excess of the special benefits derived from this sanitary sewer district and was, therefore, assessed in error; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. Sections 1 and 3 of Resolution No. 83-787, adopted September 7, 1983, which confirmed the assessment roll for construction of AVALON SANITARY SEWER IMPROVEMENT in AVALON SANITARY SEWER IMPROVEMENT DISTRICT SR-5453-C (centerline sewer) are hereby amended in the following particulars:1 _R- :;.. Cather Director of Public Works ENCLOSURES: (For Commission Meeting of NnvPmhPr A 1QA4 DATE: October 15, 1984 FILE: B-5453 SUBJECT: AVALON SANITARY SEWER IMPROVEMENT SR-5453- Resolution amending resolution confirming REFERENCES: assessment roll The Department of Public Works recommends the adoption of the attached resolution which decreases the assessment against one parcel in AVALON SANITARY SEWER IMPROVEMENT in AVALON SANITARY SEWER IMPROVEMENT DISTRICT SR-5453-C (centerline sewer). On September 7, 1983, the Commission adopted resolution no. 83-787 which confirmed the preliminary assessment roll for AVALON SANITARY SEWER IMPROVEMENT in AVALON SANITARY SEWER IMPROVEMENT DISTRICT SR-5453-C (centerline sewer). The property consisting of lot 37 less R/W to City and less W 154 Ft'. Ewan Peacock, P.B. 1-195, has an unusually irregular shape; the assessable front footage was very difficult to arrive at; the property is Criss -crossed by easements, which restrict the use of the land considerably. These easements, along with a jagged base - building line, were not readily apparent at the time of the original assessment. After further investigation, it has been found that the assessable frontage used for this property is not representative of the benefits derived by the property from the sanitary sewer system, and should be reduced. 'T IV ,0 T 84-1282 N FACT SHEET r7 mow AVALON SANITARY SEWER IMPROVEMENT SR-5453 The subject property was originally assessed as follows: 172.0 feet of frontage along S.W. 29 Street, plus 1 service lateral. The total came out to be $2,245.11. The property owner contacted the City to explain that there is no possible use for a large portion of the land, inasmuch as it is criss-crossed by easements and has a jagged base -building line which cuts deep in to the property. In the case of an irregular lot such as this, there are many judgemental factors in computing an equitable assessment; following the Charter to the letter would result in a grossly unfair amount. Therefore, according to the benefits received by the property from the improvement, an adjusted frontage of only 87.5 feet is proposed; this will reduce the assessment charge by $905.25.
