HomeMy WebLinkAboutR-84-1271J-84- 957 September 28, 1984 RESOLUTION NO.84-1271 A RESOLUTION'AUTHORIZING THE DIRECTOR OF FINANCE TO PAY TO LAUDERHILL LEASING AND JOSEPH I. DAVIS, ESQUIRE, THE SUM OF SIX THOUSAND DOLLARS ($6,000.00) IN FULL AND COMPLETE SETTLEMENT OF ALL PROPERTY DAMAGE CLAIMS, CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, AND UPON EXECUTION OF A RELEASE RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS. WHEREAS, Lauderhill Leasing, Inc. a Florida corporation, filed a claim against the City of Miami for alleged property damage, resulting from an accident when the driver Carl Newman Game into contact witha City of Miami Police car on June 13, 1963, at Southwest 32nd Avenue and Day Avenue, Miami, Florida. The plaintiff had leased the car, a 1983 Cadillac, ID No. 1G6AD6985D19236362; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's Office and in accordance with all the facts and circumstances involving the matter, said office recommends that this property claim be settled for the sum of Six Thousand Dollars ($6,000.00); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Director of Finance is hereby authorized to pay to Lauderhill Leasing, Inc., a Florida corporation, the sum of Six Thousand Dollars ($6,000.00) in full and complete settle- ment of all property damage claims, claims and demands against the City of Miami upon execution of a release releasing the City of Miami from all property damage claims, claims and demands. C�— .;: Plaintiff, Lauderhill Leasing, Inc., a Florida corporation, filed a claim against the City of Miami through its attorney, Joseph I. Davis, for property damage arising out of an accident which occurred on June 13, 1983, at Southwest 32 Avenue and Day Avenue, Miami, Florida. The plaintiff, Lauderhill Leasing had leased a 1983 Cadillac to a Mr. Carl Newman. The Cadillac lease3by Mr. Newman was hit on the aforesaid date by a City of Miami Police car that ran into the Cadillac. The City of Miami accepted responsibility for causing the accident and agreed to pay Six Thousand Dollars ($6,000.00) for damages. However, at the time of the accident, there was some question as to the ownership of the Cadillac, and the City of Miami decided to pay for the damages at a later date once the question of ownership had been resolved. At the present time, Lauderhill Leasing has established and presented evidence as to it being the owner of the Cadillac, and the City would like to fulfill its obligation to pay $6,000.00 to the 4 a� plaintiff herein. b� Therefore, considering the facts involved herein, the City Attorney's ¢ ; Office recommends payment of its obligation in the amount of $6,000.00.
