A RESOLUTION, BY A FOUR -FIFTH (4/5ths)
AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION AFTER A DULY ADVERTISED PUBLIC
HEARING, RATIFYING THE CITY MANAGER'S FINDING
OF SOLE SOURCE; WAIVING THE REQUIREMENT FOR
COMPETITIVE SEALED BIDS AND APPROVING THE
PURCHASE OF ONE (1) SPSS SOFTWARE LICENSE
RENEWAL, ON A CONTRACT BASIS FOR ONE (1)
YEAR, RENEWABLE ANNUALLY, FROM S.P.S.S.,
INC., THE ONLY LICENSED MARKETING AGENT AND
SOLE SUPPLIER, FOR THE DEPARTMENT OF
COMPUTERS AT A TOTAL PROPOSED ANNUAL COST OF
$5,000.00; ALLOCATING FUNDS THEREFOR FROM THE
1984-85 OPERATING BUDGET OF THAT DEPARTMENT;
AUTHORIZING THE CITY MANAGER TO INSTRUCT THE
PURCHASING AGENT TO ISSUE A PURCHASE ORDER
FOR THESE MATERIALS, SUBJECT TU THE
AVAILABILITY OF FUNDS.
WHEREAS, the Department of Computers is responsible for
providing effective Mainframe Computer operations, support and
equipment to all City departments, including the Department of
Planning; and
WHEREAS, the Planning Department has established a need
for a software package that analyzes statistical data from City
property and occupational license files for reports distributed
to various City Departments; and
WHEREAS, the Department of Computers has located and
utilized the only software package developed for Burroughs large
systems users and written in FORTRAN, SPSS (Statistical Package
for the Social Sciences), which effectively analyzes statistical
data and provides comprehensive procedures for data
transformation and file manipulation; and
WHEREAS, the supplier, S.P.S.S., Inc., has been
determined to be the owner and only licensed marketing agent for
said software; and
WHEREAS, the supplier has offered the software and
license maintenance at discounted fees; and
WHEREAS, the SPSS Software License Renewal will be used
by the Department of Computers to process existing statistical
models built with said Software for Planning Department reports,
and includes upgraded features and efficiency; and CITY ConiglSSI0N

WHEREAS, funds for this purchase are available in the

WHEREAS, the Chief Procurement Officer has made a
written finding that S.P.S.S., Inc., is the sole supplier of the

specified materials and that pricing offered to the City is both
reasonable and favorable; and
WHEREAS, the finding of the Chief Procurement Officer
has been approved and adopted as the findings of the City

source award has been properly advertised and publicly heard; and

WHEREAS, the City Manager and the Director of the
Department of Computers recommend that the requirement for formal
competitive sealed bids be waived and that the purchase from
S.P.S.S., Inc. as the sole source be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. By an affirmative four -fifths (4/5ths) vote
of the Members of the City Commission, after a duly advertised
public hearing, the City Manager's written finding that S.P.S.S.,

Inc., is the Sole Source of Supply for the furnishing of one (1)
SPSS Software License, on a contract basis for one (1) year
renewable annually, to the Department of Computers, is hereby
ratified.
Section 2. That the requirement
for formal competitive
sealed bids for furnishing One (1) SPSS
Software License is

Section 3. The City Manager is hereby authorized to

these materials, subject to the availability of funds.

for Renewal of SPSS Software
license from Sole Source

The Department of Computers recommends
the adoption of the attached
resolution waiving the requirement for
formal sealed bids for annual renewal
of the SPSS Software Package License
Fee from SPSS, Inc.,the only known
source, at an annual proposed cost of
$5000.
The, Department of Computers has been requested by the Planning
Department to continue to provide SPSS (Statistical Package for
the Social Sciences) for their use to provide statistical data for
many departments throughout the City.
The SPSS Software Package is owned by SPSS, In., therefore not
available from any other source. It is necessary to renew the
license annually in order to process the models built using this
software. The advantages of an annual license is that you get
continued improvements to the product in both features and
efficiency.
SPSS is an integrated system of computer programs written in
FORTRAN, designed to analyze statistical data, provide the user
with a comprehensive set of procedures for data transformation and
file manipulation and offers a large number of statistical
routines.
The Planning Department uses SPSS to provide information to, and
conduct analysis For, many departments in the City including
Intergovernmental Affairs, Parks and Recreation, Human Resources,
Police and Fire and on occasion, the Computer Department.
The value of SPSS to the City has been established. The Planning
Department would not be able to provide the many information and
analysis services to the City and public without it.

The Department of Computers concurs with the Planning Department
that this software package is of great value to the City.
Funds are available in the departmental FY184-85 operating budget.
The above findings are hereby approved and adopte.d as the fin ings
of the undersigned.
