RESOLUTION NO. 84-1235
A RESOLUTION APPROVING A TWO (2) YEAR
EXTENSION OF EMPLOYMENT PAST THE AGE OF 70
FOR ROSE MARTIN, TYPIST CLERK II, DEPARTMENT
OF FIRE, RESCUE AND INSPECTION SERVICES,
EFFECTIVE JULY 16, 1984 THROUGH JULY 15,
1986, WITH THE PROVISION THAT IN THE EVENT OF
A ROLLBACK OR LAYOFF IN SAID DEPARTMENT, ROSE
MARTIN'S PHYSICAL CONDITION SHALL BE
RE-EVALUATED TO DETERMINE IF HER CONDITION IS
SATISFACTORY FOR CONTINUED EMPLOYMENT.
WHEREAS, the Civil Service Board, on September 25, 1984,
unanimously recommended the approval of employment past the age
of 70 for Rose Martin, Typist Clerk II, Department of Fire,
Rescue and Inspection Services; and
WHEREAS, the City Physician has determined that the physical
condition of said Rose Martin is satisfactory for continued
employment;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. A two (2) year extension of employment past the
age of 70 is hereby granted for Rose Martin, Typist Clerk II,
Department of Fire, Rescue and Inspection Services, effective
July 16, 1984 through July 15, 1985, with the provision that in
the event of a rollback or layoff of said Department, Rose
Martin's physical condition shall be re-evaluated to determine if
her condition is satisfactory for continued employment.

The Civil Service Board, at its meeting of September 25, 1984 approved a two (2)
year extension of employment past the age of seventy (70) for Rose Martin,

It is respectfully requested that a Resolution be adopted extending Ms. Martin's
employment from July 16, 1984 to July 15, 1986.

At its meeting of September 25, 1984, the Civil Service Board considered the request
of Rose Martin, Typist Clerk II in the Department of Fire, Rescue and Inspection
Services, for an extension of employment past the age of seventy (70) for a period
of two (2) years, to be effective July 16, 1984 to July 15, 1986.

The Board noted that K.E. McCullough, Director, Department of Fire, Rescue and Ins-
pection Services, had recommended approval of the request and that Dr. J.A. Milera,
City Physician, had found Ms. Lieberman physically qualified to continue employment !`^
for the additional two (2) years.
The Board voted to approve the request, with the provision that in the event of a
rollback or layoff, Ms. Martin, rather than a junior employee, would be affected,
noting that this is in accordance with past policy.

Because of recent developments in the law concerning age
discrimination, we have not incorporated the expression of past
policy in the attached approved resolution which indicated that
the subject employee, rather than a junior employee, would be
affected in the event of a rollback or layoff. Instead, we have
incorporated a procedure that should such contingency occur
(rollback or layoff), the employee's physical condition would
then be re-evaluated to determine continued fitness for
employment.
