ORDINANCE N 9500, THE ZONING ORDINANCE OF
THE CITY OF AMI, FLORIDA, BY CHANGING THE
ZONING CLASS FICATION OF THE AREA GENERALLY
BOUNDED BY SO HWEST 32ND AVENUE, OAK AVENUE,
THE WEST BOUN ARY OF KIRK MUNROE PARK, AND
THE REAR LOT L E OF PROPERTIES FRONTING ON
THE SOUTH SIDE F OAK AVENUE, (MORE PARTICU-
LARLY DESCRIBE HEREIN); FROM RS-2/2 (ONE
FAMILY DETACHE RESIDENTIAL) TO RG-1/3
(GENERAL RESIDE TIAL ONE AND TWO FAMILY);
MAKING FINDINGS AND BY MAKING ALL THE
NECESSARY CHANGE ON PAGE NO. 46 OF SAID

3, SECTION 300 THER OF; CONTAINING A REPEALER
PROVISION AND A SEV BILITY CLAUSE.
WHEREAS,

Planning dvisory Board,
at its meeting
of September
5,
1984,
Item No. 8, following
an advertised
hearing, voted 4 to 2 to deny the hange of zoning classifica-
tion, as hereinafter set forth, t ereby constituting a RECOM-
MENDATION OF DENIAL; and
WHEREAS, the City Commission aft'pr careful consideration of
this matter, notwithstanding the Planni g Advisory Board recom-
mendation, deems it advisable and in the best interest of the
general welfare of the City of Miami and 'ts inhabitants to grant
this change of zoning classification as he einafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE kOMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ord nance No. 9500, the
zoning ordinance of the City of Miami, Florida is hereby amended
by changing the zoning classification of t e area generally
bounded by approximately Southwest 32nd Avenue, Oak Avenue, the
west boundary of Kirk Munroe Park, and the r r lot line of
properties fronting on the south side of Oak Avenue, more
particularly described as Lots 7 through 12, Block 1, CHARLES H.
FROW SUBDIVISION (13-53), of the Public Records of ade County,
Florida, from RS-2/2 One Family Detached Residenti 1 to RG-1/3

GENERAL RESIDENTIAL one and two family.
Section 2. It is hereby found that this zoning classi-
fication change:
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) Is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) Would not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) Will not adversely influence living conditions in the
neighborhood;
(g) Will not create or excessively increase traffic
congestion or otherwise affect public safety;

(h) Will not create a drainage problem;
(i) Will not seriously reduce light and air to adjacent
I area;
h (j) Will not adversely affect property values in the
adjacent area;
(k) Will not be a deterrent to the improvement or develop-
ment of adjacent property in accordance with existing
�Nregulations;
(1) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 46 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 3,

Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, or parts
thereof in conflict herewith are hereby repealed insofar as they

Section 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
a
invalid, the same shall not affect the validity of the ordinance
as a whole.

The Planning Advisory Board, at its meeting of September 5, 1984, Item 8,
following an advertised hearing, made a motion recommending denial of an
amendment to the Official Zoning Atlas of Zoning Ordinance 9500, as amended,
by changing the zoning classification from RS-2/2 One Family Detached
Residential to RG-1/3 General Residential One and Two Family for the area
bounded by approximately SW 32 Avenue, Oak Avenue, the West boundary of Kirk
Monroe Park, and the rear lot line of properties fronting on the South side
of Oak Avenue, also described as Lots 7 through 12 inclusive, Block 1,
CHARLES H. FROW SUBDIVISION (13-53), which failed by a 4 to 2 vote,
therefore, constituting a recommendation of denial.
Three objections received in the mail; two replies in favor received in the
mail .
Backup information is included for your review.
An ORDINANCE to provide for the above has been prepared by the City
Attorney's Office and submitted for consideration of the City Commission.

Consideration of a change of zoning
classification of the above site in the Official
Zoning Atlas of Zoning Ordinance 9500, as
amended, from RS-2/2 (One Family Detached
Residential) to RG-1/3 (GENERAL RESIDENTIAL ONE
AND T110 FAMILY).
To rezone lots 7 through 12, Block 1, CHARLES H.
FROM SUBDIVISION 13-53 to RG-1/3 to permit
development of duplex and townhouse residential*.
The north side of Oak Avenue directly opposite
the area of the proposed zoning change is
currently zoned RG-1/3 for duplex and townhouse
development. Since Oak Avenue has become a busy
traffic route connecting 32nd Avenue and 27th
Avenue, the maintenance of single family zoning
on the 'south side of Oak Avenue is no longer
reasonable or proper. The south of Oak Avenue
(subject area) should be rezoned to conform with
the zoning on the north side of Oak Avenue. The
owner requesting the change does not have enough
property to qualify. for application. An
attached list of signatures of all property
owners within and adjacent to the area of
requested change represents endorsement of
support for this zoning change.
Approval
At its meeting of September 5, 1984, the Planning
Advisory Board made a motion reconxnending denial
which failed by a 4 to 2 vote, therefore, consti-
tuting a recommendation of denial.
