A RESOLUTION CONTINUING THE PUBLIC HEARING
PERTAINING TO THE; ISSUANCE OF A MAJOR USE
SPECIAL PERMIT, A DEVELOPMENT ORDER, AND
ZONING RECLASSIFICATION FOR THE TERREMARK
CENTRE PROJECT, A DEVELOPMENT OF REGIONAL
IMPACT LOCATED AT APPROXIMATELY AVIATION
AVENUE, TIGERTAIL AVENUE AND SOUTH BAYSHORE
DRIVE (MORE PARTICULARLY DESCRIBED HEREIN);
FROM 3:30 P.M., THURSDAY, OCTOBER 25, 1984,
TO 3:30 P.M. , THURSDAY, JANUARY 24, 1985, OR
A RESCHEDULED OR RECONVENED MEETING, AS THE
PUBLIC HEARING DATE FOR CONSIDERATION OF SAID
FINAL APPLICATION FOR MAJOR USE SPECIAL
PERMIT; FURTHER, DIRECTING THE CITY CLERK TO
SEND COPIES OF THIS RESOLUTION TO AFFECTED

AGENCIES AND THE APPLICANT.
WHEREAS, per City Commission Resolutions 84-903 and 84-904;
July 31, 1984, a public hearing was set forth 3:30 P.M.,

Thursday, October 25, 1984, for the purpose of considering the
issuance of a Major Use Special Permit and Development Order

respectively for Terremark Centre, a Development of Regional
Impact to be located at Aviation Avenue, Tigertail Avenue and

South Bayshore Drive in Coconut Grove; and

WHEREAS, the applicant, by letter of September 19, 1984, has
applied to the South Florida Regional Planning Council for a
deferral to December 3, 1984, of consideration of Council

recommendations on the Terremark Centre project; and

WHEREAS, per Chapter 380 F1a.Stat., the City Commission must
consider the recommendations of the South Florida Regional
Planning Council before issuing a Development Order for a

on file in the Planning and Zoning Boards Administration Depart-
ment, and incorporated herein by reference, is hereby continued
from 3:30 P.M., Thursday, October 25, 1984, to 3:30 P.M.,
Thursday, January 24, 1985, or a rescheduled or reconvened
meeting.
Section 2. The City Clerk is directed to immediately
forward certified copies of this Resolution to the Florida
Department of Community Affairs, Division of Local Resource
Management, 2571 Executive Center Circle East, Tallahassee,
Florida, 32301; to the South Florida Regional Planning Council,
3440 Hollywood Boulevard, Suite 140, Hollywood, Florida, 33021,
and to the applicant Grove Bay Plaza Ltd., 2600 Southwest 3rd
Avenue, Penthouse, Miami, Florida, 33129.

Per Resolution 84-903; and 84-904
July 31, 1984 a public hearing was set
for 3:30 P.M. Thursday October 25,
19841 for the purpose of considering
the issuance of a Major Use Special
Permit and Development Order
respectively for Terremark Centre, a
Development of Regional Impact to be
located at Aviation Avenue, Tigertail
Avenue and South Bayshore Drive in
Coconut Grove, to include consideration
of a change of zoning classification by
separate orainance. It is reeuested
that this item be continued to the City
ommissicn of January 2., 1985; per the
attached resolution.
Per Resolution 84-903 and 84-904 July 3, 1984, a public hearing was
set for October 25 pertaining to the Terremark Centre.
The applicant (Grove Bay Plaza Ltd.) has now applied to the South
Florida Regional Planning Council (SFRPC) for a deferral to
December 31 1984, of consideration of Council recommend at inns on
Terremark Centre. Without the SFRPC recommendations, the City
Commission cannot act (see letter of September 19, 1984, attached).
It is therefore recommended that the Terremark Centre public hearing
be continued to the City Commission meeting on January 24, 1985•

BACKGROUND Zoning Ordinance 9500 establishes a Major Use
Special Permit process (Article 28) whereby

authorization by the City Cownission (both
preliminary and final) before construction can
be undertaken. This process encompasses
Developments of Regional Impact and other
projects (as the Major Use Special Permit
threshold is lower). It is the intent of the
!Major Use Special Permit to include, in one
action, any changes in the comprehensive plan,
zoning district classifications, other zoning
actions, and other City ordinances that would be
necessary for a building permit application to
be considered.

Dear Joe:
Please find enclosed a copy of my letter to Sharon Dodrill,
dated September 19, 1984, which agrees to a postponement of the
SFRPC DRI hearing currently scheduled for ,,onday, October 1, 1984.
We proposed that the Terremark Centre DRI be rescheduled for the
December 3, 1984 SFRPC meeting. Accordingly, we shall request
the Miami Planning Advisory Board and the Miami City Commission
to defer their hearings set for October 17 and 25, 1984. Please
advise as to what days are available for the PAB and Commission
hearings assuming the SFRPC meeting occurs on Monday December 3,
1994.

Dear Sharon:
This is to confirm our earlier discussion where I advised
that my clients, the developers of the Terremark Centre project,
located in Coconut Grove, City of Miami, Florida, have agreed
to a postponement of the SFRPC DRI hearing on the Terremark
application which currently is scheduled for Monday, October 1,
1984. This agreement is in direct response to the Council's
request for postponement to permit greater opportunity for citizen
participation. lie would appreciate if you would advise both
the Council and those interested citizens who attended your September
meeting of our concurrence in the Council's request. In the near
future, we hope to meet with interested citizens in the area.
To accomplish this, we agree that the Terremark Centre DRI should
be scheduled for the December 3 SFRPC meeting. Please advise
if this is acceptable.
By separate letter, we are advising the City of Miami

Gentlemen:
This letter of intent accompanies the zoning application
of Grove Bay Plaza, Ltd., a Florida limited partnership,
whose general partner is Terremark at Bayshore, Inc. and
whose limited partner is A.T.H. (CURACAO), N. V.
Subject property consists of a parcel which is:
Bounded on the North by Tigertail Avenue;
Bounded on the East by Aviation Avenue;
Bounded on the South by South Bayshore Drive; and
Bounded on the West by property owned by the United
States of America, which is utilized as a Naval
Reserve Facility.
All of subject property is currently zoned RO 3/6 except for
the Northeasterly corner of approximately 100' x 200' whose
current zoning classification is RG 2/5. Request is hereby
made to change the classification of the entire parcel to

and on the fourth by a governmental facility. Although for
gross lot area purposes the applicant has not included any
portion of this large open -space area, it has the appearance
of an open -space buffer which compliments the contemplated
development.
2. In addition to fronting on Bayshore Drive, the par-
cel has the advantage of permanent open space owned by the
City of Miami to the South of Bayshore.
The development program of the applicant has been revised down-
ward to respond to comments made by City Staff and to be con-
sistent with developments already existing in this general area.

As noted above, the applicant is seeking a mixed -use project
which combines office, retail and residential uses, which would
be constructed on a gross lot area of 191,673.38 sq. ft. as one
of the anchors of Coconut Grove. The building heights have been
established at a maximum of 21 stories in order to create sym-
metry and balance along South Bayshore Drive, and the design of
the proposed development creates an inter -action between the
contemplated commercial and residential aspects. Although
applicant is requesting an increase in sector number, it is
readily apparent that it serves the purpose of permitting the
residential component of the project, as the commercial/office
components alone do not require any zoning change whatsoever.
It is felt that the residential component will contribute to
the vitality of the area and balance the commercial aspects
of South Bayshore.
A community grows in a wholesome manner when pedestrian traffic
is induced. The basic policy of the City of Miami in seeking
a lateral expansion of Coconut Grove is to develop nodes of
