RESOLUTION 84-1444
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI AUTHORIZING AND URGING THE
BOARD OF COUNTY COMMISSIONERS OF DADE COUNTY,
FLORIDA, TO ESTABLISH A SPECIAL ASSESSMENT
DISTRICT FOR THE PURPOSE OF PROVIDING
MARKETING AND PROMOTION, SECURITY,
MAINTENANCE AND MANAGEMENT SERVICES FROM THE
MIAMI DESIGN PLAZA MERCHANTS ASSOCIATION
(MDPMA) FOR THE MIAMI DESIGN PLAZA DISTRICT
WITHIN SAID BOUNDARIES AS HEREINAFTER
DESCRIBED; TO LEVY A SPECIAL ASSESSMENT TAX
NOT TO EXCEED $.25 PER SQUARE FOOT IN SAID
DISTRICT OF THE CITY OF MIAMI FOR A FIVE YEAR
PERIOD BEGINNING OCTOBER 1985.
WHEREAS, the Charter of Metropolitan Dade County,
Florida has empowered the Board of County Commissioners of Dade
County, Florida with the exclusive authority to create and
establish Special Assessment Districts within Metropolitan Dade
County; and
WHEREAS, the Laws of Florida and the Code of
Metropolitan Dade County, Florida require the governing body of a
municipality to approve the creation of a Special Assessment
District if said district embraces all or part of the
municipality; and
WHEREAS, the continued development of the Miami Design
District is of importance to the City of Miami and Metropolitan
Dade County; and
WHEREAS, the Miami Design Plaza Merchants Association
(MDPMA) is the economic development vehicle for the merchants in
the area; and
WHEREAS, merchants and businesspersons have also
expressed a need and desire to market and promote this area; and

WHEREAS; the marketing and promotion of this district is
important for the retention and expansion of trade and commerce
of the design industry within the City of Miami; and
WHEREAS, the streets and ways of the Miami Design
District area must remain safe for the merchants and residents of
the area;
WHEREAS, there is a need for providing security services
wherein need has been expressed by concerned merchants and
citizens;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The Board of County Commissioners of Dade
County, Florida, is hereby authorized and urged to establish a
Special Assessment District for the purposes of providing
marketing and promotion, security, maintenance and management
services for the Miami Design Plaza District within the
boundaries described in Section 3 hereof.
Section 2. The Board of County Commissioners of Dade
County, Florida is hereby authorized and urged to levy a Special
Assessment Tax not to exceed $.25 per square foot in said
district for a period of five years beginning October, 1985.

Section 3. The boundaries of said district shall be
described generally as set forth in the schedule attached hereto,
designated Exhibit "A" and made a part hereof.

period beginning October, 1985.11
The Miami Design Plaza District is one of the most successful business
districts in the City of Miami. The district continues to face
significant competition from the $120 million design center soon to be
constructed in Dania, Florida. It is anticipated that the new center
will attract many customers now patronizing the Miami Design Plaza and
may even result in the relocation of some firms to Dania. As a
result, the City of Miami funded the Miami Design Plaza District
Development Plan study which identified issues and alternatives to
ensure the success of the Design Center. One of the major
recommendations was the creation of a Special Assessment District to
fund needed services in the area.

Background
A) Deterioration of Area
As of June 15, 1984, there exists 85,260 square feet of vacant
space in the Miami Design Plaza. Although a part of this can be
attributed to a decline in business, certainly the physical
deterioration of the area and the perception of crime is
contributing to the increase in vacancies.
B) Competition
The development of the Design Center of the Americas in Dania has

the potential to dramatically split the Design Market in Florida.
Adoption of a Special Assessment District can substantially
combat this split by providing funds to improve and promote the
Miami Design Plaza area to the extent that local tenants will not
be so easily convinced to move to Dania.
C) Area Property Values
Property values which have risen at a fast pace during the last
ten years can be protected only by a commitment of property
owners, tenants and local government to provide visible
a
improvements to the area.
The commercial area in the Miami Design District comprises
approximately 1,200,000 square feet. By establishing a special tax of
$.25 per square foot/per year, the district would generate an
additional $300,000 per year during the next five years. The
additional revenue obtained from levying such a tax will enable the
MDPMA to actively promote the area, maintain a full-time
administrative office to handle the affairs of the organization, and
to increase the police coverage of the area. These are all major
problems being faced by the MDPMA which cannot be adequately resolved
because of the lack of funds.
The first step towards obtaining the Special Assessment District
designation for the Miami Design area is to receive formal approval
from the City of Miami Commission authorizing the Board of County
Commissioners to ratify and approve the establishment of a Special
Assessment District. The MDPMA will then have to present a petition
representing a cross-section of the district population supporting the
proposed assessment.

Recommendation
r It is recommended that the City of Miami Commission approve the
T attached resolution authorizing and urging the Board of County
Commissioners to establish a Special Assessment District for the Miami
Design Plaza District of the City of Miami.
r The County will then schedule a public hearing to discuss the issue.
If the results of the evaluation and the public hearing are positive,
the County Commission may then approve the establishment of the
Special Assessment District.

ENCLOSURES:
I have recommended that this office approve as to
form and correctness the resolution requesting Dade
County to establish a Special Assessment District for
the Miami Design Plaza District of the City of Miami.
As I have notified you and your staff in numerous
discussions, the Dade County Code provides that Special
Assessment Districts may be established for the following
purposes:
1. Water System Improvements
2. Sanitary Sewer Improvements
3. Storm Sewer Improvements
4. Street Improvements
5. Sidewalk Improvements
G. Beach Erosion Control Improvements
7. Street Lighting Improvements
8. Public Transit Improvements or Services
' Absent a change to the Dade County Code, a Miami
Design District would only be able to utilize the proceeds
from the Special Assessment in the above manner.
Prior to our receipt of the proposed resolution on
November 29, 1984 I had a discussion with Edward Blanco of
your office relative to the proposed establishment of a
district. I requested that he communicate with the County
Manager's Office through you and that the proposed resolution
be reviewed by the County staff and Attorney's Office.
Subsequent to that meeting we have not been advised whether
or not that requirement was met but in approving the reso-
lution are presuming that you have complied with all the
requirements of Dade County.
