RESOLUTION NO. 8 -1424
A RESOLUTION AUTHORIZING AND DIRECTING
THE DIRECTOR OF THE DEPARTMENT OF FINANCE
TO PAY $2009 000 TO MICHAEL JOHNSON IN
SETTLEMENT OF A LAWSUIT FILED AGAINST
THE CITY OF MIAMI AND CERTAIN CITY
EMPLOYEES IN THE U.S. DISTRICT COURT,
SOUTHERN DISTRICT OF FLORIDA, CASE NO.
83-2087, CIV-SMA, SAID PAYMENT TO BE MADE
UPON THE EXECUTION AND FILING OF
APPROPRIATE SETTLEMENT DOCUMENTS IN SAID
LAWSUIT.
WHEREAS, MICHAEL JOHNSON filed a lawsuit in August, 1983
against the CITY OF MIAMI and City employees JOHN DEES,
GEORGE ROSCHELL9 KENNETH KEMP, G. LANE BRADFORD, NORRIS LOWE
and KELLEY ENGLAND for damages resulting from his being shot
by a City of Miami police officer on May 18, 1980; and
WHEREAS, it is advantageous for the City of Miami to
effect a settlement of said lawsuit;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The Director of the Department of Finance of
the City of Miami is hereby authorized and directed to pay to
MICHAEL JOHNSON the sum of $200,000 in settlement of his
lawsuit against the City of Miami and City employees JOHN
DEES, GEORGE ROSCHELL, KENNETH KEMP, G. LANE BRADFORD, NORRIS
LOWE and KELLEY ENGLAND filed in the U.S. District Court,
Southern District of Florida, Case No. 83-2087-CIV-SMA, said
payment to be made upon the execution and filing of
appropriate settlement documents in said lawsuit.

case of Michael Johnson
v. City of Miami in the
REFERENCES: amount of $200,000
ENCLOSURES:
Authorization is requested for our office to file an offer
of judgment in the amount of $200,000 in the above styled cause
of action. The plaintiffs have refused a higher amount which we
had indicated earlier would be recommended to you. Accordingly,
it is unlikely that this settlement offer ($200,000) will be
accepted. The purpose For making the offer at this time is to
preclude further attorney's fees and costs from the time the
settlement offer is filed in the event the jury returns a verdict
in an amount under $200,000.
