HomeMy WebLinkAboutR-84-1397J-84-1204 RESOLUTION NO. 84" 1397 A RESOLUTION AUTHORIZING THE CITY MANAGER TO PREPARE PLANS AND SPECIFICATIONS, ADVERTISE FOR AND RECEIVE COMPETITIVE BIDS, EVALUATE THE BIDS RECEIVED, AND EXECUTE A CONTRACT WITH THE LOWEST ACCEPTABLE BIDDER FOR BAYSIDE-BAYFRONT PARK AUDITORIUM ASBESTOS REMOVAL AT A TOTAL COST NOT TO EXCEED $2009000.00 WITH FUNDS FOR THE CONTRACT TO BE PROVIDED FROM MONIES ALREADY ALLOCATED TO THE BAYSIDE PROJECT;`. FURTHER RATIFYING THE MANAGER'S WRITTEN FINDING THAT THE HEREIN PROJECT RESULTED FROM THE EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF TWO- THIRDS OF THE MEMBERS OF THE CITY COMMISSION AND ADOPTING THE FINDINGS AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESOLUTION. WHEREAS, the Bayfront Park Auditorium, which is to be demolished for the construction of Bayside immediately after the Miami Grand Prix which will be held February 23-24; and WHEREAS, it has been determined that the Auditorium contains harmful asbestos that in accordance with Federal and State regulations must be removed prior to the start of demolition of the structure; and WHEREAS the City Manager has made a written finding that a valid emergency need exists for the removal of the asbestos prior to the Miami Grand Prix to avoid delay to the starting, and ultimate completion of Bayside, and WHEREAS the City Manager and the Director of the Department of Public Works recommends that the City Commission authorize the City Manager to prepare plans and specifications, advertise and receive competitive bids, evaluate the bids and execute a contract to be known as Bayside-Bayfront Park Auditorium Asbestos Removal, with the lowest acceptable bidder for the removal, WHEREAS the total cost of the aforementioned contract is to be less than $2000000.00, and WHEREAS funds for the contract cost shall be provided from money already allocated to the Bayside project. CITY COMIS$ION MEETING OF DEC 13 IM s NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section I. After a properly advertised public hearing, the finding of the City Manager set forth in the preamble to this Resolution is hereby ratified by an affirmative vote of 2/3rds of the City Commisison and adopted as if fully set forth in this section. Section 2. The City Manager is hereby authorized to prepare plans and specifications, advertise for and receive competitive bids, evaluate the bids received, and execute a contract for BAYSIDE-BAYFRONT PARK AUDITORIUM ASBESTOS REMOVAL at a total cost not to exceed $200,000.00; with funds for the project to be provided from previously allocated Bayside_Project Funds. ENCLOSURES: December 13, 1984) The Department of Public Works recommends the adoption of the resolution authorizing the City Manager to prepare plans and specifications, advertise for and receive competitive bids, evaluate the bids received, and execute a contract with the lowest acceptable bidder for BAYSIDE- BAYFRONT PARK AUDITORIUM ASBESTOS REMOVAL at a total cost not to exceed $200,000.00 with funds for the contract to be provided from money already allocated to the BAYSIDE project; further ratifying the Manager's written finding that the herein project resulted from emergency circumstances by an affirmative vote of 2/3 rds of the members of the City Commission and adopt the findings and conclusions set forth in the preamble of the resolution. The Bayfront Park Auditorium is the be demolished to allow the construction of the Bayside project. We have found that it contains harmful asbestos material that federal and state regulations require removal of prior to the start of any demolition of the building. The auditorium is scheduled to be used for the Miami Grand Prix and then immediately turned over to the Rouse Company, the Bayside developers. They have stated that the delay in the start of the demolition of the auditorium will delay their completion of Bayside. The delay can be avoided by removal of the asbestos prior to the race. To accomplish this, the Department of Public Works recommends the adoption of the attached resolution which will authorize you to proceed with all steps necessary to execute a construction contract for the removal of a cost not to exceed $200,000 without any further Commission action. Of course, the Commission would accept the completed work and authorize final payment to the contractor. The Law Department has advised us that to comply with the City's procurement ordinance in seeking adoption of the resolution we must also have a written finding by you that the work is the result of emergency circumstances and that a public hearing be held to hear objections to the slight deviation of the procurement ordinance we propose. Accordingly, attached to this memorandum, in addition to the resolution is: 1. The written finding, mentioned above, for your signature. 2. The reason for the emergency need is as follows: In order for the Rouse Company to meet the scheduled completion of Bayside, they must begin demolition of the Bayfront Park Auditorium when it is turned over to them after it is used for the Miami Grand Prix. It has been confirmed that the building contains harmful asbestos material that, in accordance with federal and state regulations, must be removed prior to the start of demolition.
