RESOLUTION NO. 84-1497
A RESOLUTION PERMITTING THE APPLICANT FOR THE
LEJEUNE CENTRE PROJECT, LOCATED AT APPROXI-
MATELY 780 NORTHWEST 42ND AVENUE, TO PROCEED
TO FILE A FINAL APPLICATION FOR MAJOR USE
SPECIAL PERMIT WITH THE DIRECTOR OF PLANNING;
PROVIDING CAVEATS; AND ESTABLISHING 3:30
P.M., THURSDAY, JANUARY 24, 1985, AS THE
PUBLIC HEARING DATE FOR THE CONSIDERATION OF
THE FINAL APPLICATION FOR MAJOR USE SPECIAL
PERMIT.
WHEREAS, Article 28 of Ordinance No. 9500, the Zoning
Ordinance of the City of Miami, Florida, requires developers of
Major Uses, as defined, to apply for, and receive, a Major Use
Special Permit before applying for a building permit, and
WHEREAS, the LeJeune Centre Project, located at approxi-
mately 780 Northwest 42nd Avenue, meets the criteria for Major
Use designation, as set forth in said Ordinance in Article 28;
and
WHEREAS, the Miami Planning Advisory Board, at its meeting
of October 3, 1984, after reviewing the preliminary application
for Major Use Special Permit, recommended by a 6 to 0 vote by
Resolution No. PAB 108-84, that the developer be permitted to
proceed to file a final application for Major Use Special Permit;
and
WHEREAS, the City Commission has reviewed the preliminary
application for Major Use Special Permit and considered any
additional conferences, referrals, or materials that may be
required prior to consideration of the Final Application for
Major Use Special Permit;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The applicant for the LeJeune Centre Project,
located at approximately 780 Northwest 42nd Avenue, may proceed
to file a Final Application for Major Use Permit with the

Section 2. No right or privilege is conferred on the
applicant by the permission to proceed to Final Application. This
resolution is not to be deemed approval of the development
proposal.
Section 3. The Commission hereby establishes 3:30 p.m.,
Thursday, January 24, 1985, as the date for a public hearing for
consideration of the Final Application for Major Use Special
Permit for the LeJeune Centre Project, located at approximately
780 Northwest 42nd Avenue.

The Planning Advisory Board, at its meeting of October 3, 1984, Item 3,
following an advertised hearing, adopted Resolution PAB 109-84 by a 6 to 0
vote, recommending approval of the preliminary application for Major Use
Special Permit for the LeJeune Centre located at 780 NW 42 Avenue, also
described as Tract "A", LE JEUNE CENTRE SUB (120-81), and recommending that
the applicant be permitted to file a final application for Major Use Special
Permit; further recommending that the City Commission establish a public
hearing date on October 25, 1984, for consideration of the final application
for Major Use Special Permit all in accordance Zoning Ordinance 9500, as
amended, Article 28 MAJOR USE SPECIAL'PERMITS; DETAILED REQUIREMENTS.
Backup information is included for your review.
A RESOLUTION to provide for the above has been prepared by the City

REQUEST
To review the Preliminary Application for•Major
Use Special Permit and recommend that the
applicant be permitted to file a Final
Application for Major Use Special Permit.
BACKGROUND
This development was conceived in 1982, and
construction was begun under the previous Zoning
district C-2. In June of 1983, Ordinance 9500
was adopted applying Zoning district CG-1/7 to
the site. Phase 1, a bank building of
approximately 125,400 has been constructed.
Under the new Zoning Ordinance the development
is now subject to Planning Department review
under the Major Use Special Permit Process for
the balance of the proposed project.
Zoning Ordinance 9500 establishes a Major Use
Special Permit process (Article 28) whereby
defined major uses require recommendation by the
Planning Advisory Board and consideration and -
authorization by the City Commission (both -
preliminary and final) before construction can
be undertaken.
The Major Use Special Permit includes, in one
action, any changes in the comprehensive plan,
zoning district classifications, other zoning
actions, and other City ordinances that would
be necessary for a building permit application
to be considered.

PETER'M. LOPEZ, assumed the Chair of the meeting, and immediately
thereafter 'appointed Joaquin Membiela to serve as Secretary Pro-
-Temporary of the Corporation.
The Chairman then, called the roll and determined that all of •the
Directors and stockholders of the company were present. Some of
them by proxies and some of them personally. Upon the calling of
the roll, the Chairman then announced that the business to come
before the meeting was;
1. "To authorize the Secretary of the Corporation,
Joaquin Membiela to execute any deeds, documents,
and bind this Company upon nis signiture of any
documents of any kind, and proceed relating to
any variance, zoning changes and the like. The
Secretary is invested of such powers to.carry
out the business of Le Jeune Center, Inc."
Therefore, the Chairman moved that the meeting be adjourned. Upon
motion, duly seconded and unanimously passed, the meeting was ad-
journed and all of the resolutions adopted have now become an
authorized act of the corporaration.� x
