RESOLUTION NO. 84-1496
A RESOLUTION AMENDING THE STIPULATION OF
AGREEMENT TO CONDITION DEVELOPMENT ORDER AND
TO DISMISS APPEAL (RESOLUTION NO. 75-423;
APRIL 229 1975), BY MODIFYING CONDITION "B"
TO GRANT A FORTY-FOUR (44) DAY EXTENSION OF
TIME TO MARCH 28, 1985 IN WHICH TO COMPLY
WITH THE REQUEST TO CONSTRUCT LOW INCOME
HOUSING ON CLAUGHTON ISLAND; FINDING THAT
THIS AMENDMENT IS NOT A SUBSTANTIAL DEVIATION
PURSUANT TO SECTION 380.06, FLORIDA STATUTES,
DIRECTING THE CITY CLERK TO SEND COPIES OF
THE RESOLUTION TO AFFECTED PARTIES.
WHEREAS, per Resolution 75-135; February 12, 1975, the
Commission issued a Development Order for Claughton Island, a
Development of Regional Impact per Chapter 380.06, Florida
Statutes; and
WHEREAS, per Resolution 75-423, April 22, 1975, the
Commission authorized execution of a "Stipulation of Agreement to
Condition Development Order and Dismiss Appeal" which inter alia
provided that the developer would provide 200 units of low income
housing on Claughton Island in 10 years (or by February 12,
1985); and
WHEREAS, the developer has proffered certain studies to the
City Commission and requires more time to refine the studies and
allow for City Commission determination; and
WHEREAS, local government has properly advertised and
provided for a public hearing to review the proposed amendments
to the development order, and has provided a reasonable
opportunity for affected parties to present evidence to support
or rebut the proposed amendments; and

WHEREAS, the Miami Planning Advisory Board did hold a public
r hearing on December 19, 1984, following an advertised hearing,

and adopted Resolution No. PAB 140 -84, by a vote of 5 to 0 ,
recommending a modification of condition 11B119 Resolution No. 75-
123 (April 22, 1975) to extend the date of performance to August
15, 1985; and
WHEREAS, the City Commission believes that time extension
for this condition would be in the best t r sts of the City of

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Commission finds that this time extension is
not a substantial deviation per Chapter 380.06, Florida Statutes.
Section 2. Resolution 75-123; April 22, 1975, being the
Stipulation of Agreement to Condition Development Order and
Dismiss Appeal is hereby modified in the following respects:1

11B. The Developer has submitted a Memorandum of
Understanding to be entered into by and between the City of Miami
and the Developer which Memorandum is attached hereto and made a
part hereof as "Attachment I." The Developer agrees to be bound
by the provisions thereof in order to assure that a minimum of
200 units of low-income housing as defined therein shall be
provided within 10 years and forty-four days, or by March 28,
1985, as an integral part of the overall development scheme of
Claughton Island."
Section 3. The City Clerk is hereby directed to immediately
send certified copies of this Resolution to the Florida
Department of Community Affairs, Division of Local Resource
Management, 2571 Executive Center Circle East, Tallahassee,
Florida, 32301; to the South Florida Regional Planning Council,
3440 Hollywood' Boulevard, Suite 140, Hollywood, Florida 33021;
and to Greenberg, Traurig, Askew, Hoffman, Lipoff, Rosen and
Quentel, 1401 Brickell Avenue Miami, Florida, 33131.

Claughton Island, being an Island of 44 acres more or less located in

WHEREAS, Section 6*of Exhibit "E" of said Resolution requires
the investors to provide not less than 200 units/ of low-income housing

and rented in the manner set forth by the investors, and '
%EREAS, the City and the Investors are desirous of clarifying
the intent of the aforesaid provision and assuring that the Investors

will appropriately carry out the intent of said section.
M-7, THEREFORE, the parties understand that the Development

may be provided by the Developer at such times and in such numbers and •

option of the Investors, at a rental, lease or sale price meeting the
minimum standards for la,►-inoome housing as established by the then current
requirermts published by the Department of housing and Urban Develo�vmt
of the Federal Government in the Federal Register.

3. The low-income units described herein shall only be

offered for rental., lease or sale to persons who meet and do not e=oed
the criteria for low-invome individuals prescribed by the regulations
in effect at the time of such rental, lease or sale prescribed by the
Department of Housing and Urban Development and published in the most
current issue of the Federal Register.

4. The Investors' obligation pursuant to this understanding

is to provide theminimum number of low-inoccre housing units required !

herein. However, the Investor is not hereby prevented from participating
in or receiving any funds from any local, state or federal government
i
program which seeks to provide or encourage the construction and
maintenance of low-•inoome housing.
5. Nothing herein shall be construed as restricting the
Investor from developing or constructing more than the rdnimn number of
units required, nor shall it be construed as requiring any particular
schedule for the construction of said units so long as not less than 200
of such units are eatpleted and available for occupancy by February
12, 1985. This Memorandum is solely for the purpose of clarifying the
1 meaning and intent of the parties as set forth by all parties at the time

the aforesaid Resolution no. 75-135 was passed by the City of Miami.

It is recommended that the Commission amend the
stipulation of agreement to condition development
order and to dismiss appeal (Resolution No. 75-423;
April 22, 1975), by modifying Condition "B" to grant
a six (6) month extension of time to August 12, 19859

amendment is not a substantial deviation pursuant to
Sectiocl 380.069 Florida Statutes, and direct the City
Clerk 1:0 send copies to affected parties, per the
attached resolution.
In 1975 tt.e City Commission issued a Development Order for
Claughton T..sland. Later in 1975 in order to dismiss an appeal of
the City's Development Order, the Commission authorized execution
of a "Stipulation of Agreement to Condition Development Order and
to Dismiss Appeal" which was signed by the City Manager, the
South Florida Regional Planning Council and the developer.
Condition "B" of this stipulation obligated the developer to
provide 200 units of low income housing on Claughton Island
within 10 years (or by February 15, 1985).
The developer has proffered a report "Urban League of Greater
Miami Report on Developer Obligations for Low Income Housing in
Miami and Feasible Alternative Applications of the Obligation of
the Claughton Island Development Investors" as prepared by the
Urban League. This report and related pro -forma development
scenarios are under• review and discussion between the
Administration and the developers. Additional time is necessary
for further review, definition of alternative obligations and
location, and Commission deliberations.
The Planning Advisory Board is expected to make their
recommendations on December 19, 1984.
It is requested that this item be entered -on the City Commission
agenda of December 20, 1984.

NOTICE OF PUBLIC HEARINGS
NOTICE is hereby given that on December 19, 1984, the
City of Miami Planning Advisory Board and on Decembtr 20,
1984, the City of Miami Commission will consider the request
of SWIRE BISCAYNE INC to modify Condition "B" of the
Stipulation of Agreement to Condition Development Order
and to Dismiss Appeal previously approved by the -City
Commission on April 22, 1975, by Resolution No. 75-423.
The purpose of the request is to grant a six (6) month
extension of time in which to comply with the request to
construct low income housing on Claughton Island. The
Commission and Board will also be requested to determine
that such an extension of time is not a substantial deviation
from the terms of said Development Order pursuant to Section
380.06, Florida Statutes.
