RESOLUTION NO. 85~71Q'
A RESOLUTION CALLING AND PROVIDING FOR A
SPECIAL MUNICIPAL ELECTION TO BE HELD ON
THE 5TH DAY OF NOVEMBER, 1985, FOR THE
PURPOSE OF SUBMITTING TO THE QUALIFIED
ELECTORS OF THE CITY OF MIAMI FOR THEIR
APPROVAL OR DISAPPROVAL THE BALLOT
QUESTION OF WHETHER THE CITY SHALL BE
PROHIBITED FROM INCREASING THE MILLAGE
RATE FOR AD VALOREM TAXES ON REAL
PROPERTY IN THE NEXT FISCAL YEAR.
WHEREAS, ad valorem taxes on real property are levied to
pay the costs of services provided by local government; and
WHEREAS, the citizenry should be given an opportunity to
indicate their willingness to accept a level of services
commensurate with a fixed maximum level of ad valorem tax
revenues even if the result is a possible decrease in the
level of services; and
WHEREAS, the earliest scheduled time for the citizenry
to express themselves on this question is the municipal
election in November 1985;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. A special municipal election is hereby
called and directed to be held in the City of Miami, Florida,
from 7:00 A.M. until 7:00 P.M. on Tuesday, the 5th day of
November, 1985 for the purpose of submitting to the qualified
electors of the City of Miami for their approval or dis-
approval the herein ballot question.
Section 2. Said special municipal election shall be
held at the voting places in the precincts designated, all as
shown on the list attached hereto and made a part hereof and
referred to as Exhibit No. 1. A description of the

registration books and records which pertain to election
precincts wholly or partly within the City and which the City
is adopting and desires to use for holding such special
municipal election is as follows: All registration cards,
books, records and certificates pertaining to electors of the
City and established and maintained as official by the
Supervisor of Elections of Dade County, in conformity with
the provisions of the general laws of the state, are hereby
adopted and declared to be, and shall hereafter be recognized
and accepted as, official registration cards, books, records
and certificates of the City.
Section 3. For the purpose of enabling persons to
register who are qualified to vote in said election and who
have not registered under the provisions of the general laws
of Florida and Chapter 16 of the Code of the City of Miami,
or who have transferred their legal residence from one voting
precinct to another voting precinct in the City, they may
register at the following office of the Supervisor of
Elections of Metropolitan Dade County, Florida, which is
hereinafter set forth and which will be open during the
following dates and times:
ELECTIONS DEPARTMENT
1444 Biscayne Boulevard, Miami, Florida
Monday to Friday, inclusive: 8:00 A.M. - 5:00 P.M.
In addition to the above time and place, said qualified
persons may register at such branch offices and may also use
any mobile registration van for the purpose of registration
in order to vote in the herein described election during such
times and on such dates as may be designated by the Super-
visor of Elections for Metropolitan Dade County.
Section 4. RALPH G. ONGIE, the City Clerk of the
Cit in the herein described election during such
times and on such dates as may be designated by the Super-
visor of Elections for Metropolitan Dade County.
Section 4. RALPH G. ONGIE, the City Clerk of the
City of Miami is hereby designated and appointed as the

official representative of the City of Miami in all
transactions with the Supervisor of Elections of Dade County
in relation to matters pertaining to the use of the
registration books and the holding of said election.
Section 5. The Election Clerks and Inspectors to
serve at said polling places on said date shall be designated
by the Supervisor of Elections for Metropolitan Dade County
for such purpose.
Section 6. The City Clerk is hereby authorized and
directed to publish notice of the adoption of the herein
resolution and of the provisions hereof at least twice, once
in the fifth week and once in the third week prior to the
week in which the aforesaid election is to be held, in the
following newspapers which are published within the City of
Miami, Florida:
Section 7. The official ballot to be used at said
special municipal election shall be in full compliance with
the laws of the State of Florida, including all provisions of
the "Electronic Voting Systems Act." The ballot used in said
election for voting on the question submitted shall be that
portion of the cardboard or paper or other material within
the ballot frames of the voting machines which will contain a
statement of the question submitted, and said voting machines
shall provide facilities with such instructions on their use
as will enable all qualified electors to vote for or against
such question as they may choose. Said ballot as it appears
within the first row of horizontal ballot frames of the
voting machine shall be substantially in the following form:

Section 8. The City Clerk shall cause to be prepared
absentee ballots in full compliance with the law of the State
of Florida containing the questions set forth in Section 7
above for the use of absentee electors entitled to cast such
ballots in said election.

which appeared in the City Clerk's Report of the October 25,
1984 City Commission Agenda.
The language of an appropriate alternative question has not
been supplied but can be formulated by the Commission at its
meeting of January 10, 1985.

DEVELOPMENT OF OVERTOWN/PARK WEST FROM OCTOBER 31, 1984 TO
NOVEMBER 30, 1984; FURTHER REQUESTING THE CITY MANAGER TO
INFORM ALL INTERESTED PARTIES OF THIS EXTENSION.
