A RESOLUTION RESCINDING THE CONTRACT
AWARDED UNDER RESOLUTION NO. 84-1239 TO
CARTWRIGHT VENTILATION, INC. FOR FURNISHING
COOLING FANS AND VENTILATION EQUIPMENT,
INCLUDING ALL LABOR AND MATERIALS FOR
INSTALLATION AT THE MAIN MOTOR POOL SHOP IN
THE AMOUNT OF $5,296.00, BECAUSE SAID FIRM
FAILED TO ACCEPT THE AWARD TO PROVIDE THE
REQUIRED EVIDENCE OF INSURANCE AND FAILED
TO BEGIN WORK WITHIN THE TIME STIPULATED IN
ITS BID PROPOSAL NO. 83-84-106; FURTHER
AUTHORIZING THE CITY ATTORNEY TO TAKE THE
NECESSARY LEGAL ACTION TO RECOVER ALL OR
PART OF THE CITY'S COSTS RESULTING FROM
SUCH FAILURE ON THE PART OF CARTWRIGHT
VENTILATION, INC.; FURTHER ACCEPTING THE
BID OF ACME INDUSTRIAL SHEET METAL, INC.,
THE NEXT LOWEST RESPONSIBLE AND RESPONSIVE
BIDDER, FOR FURNISHING SAID EQUIPMENT AT
THAT CITY FACILITY ON A SHORT-TERM CONTRACT
BASIS FOR THE DEPARTMENT OF BUILDING AND
VEHICLE MAINTENANCE AT A TOTAL PROPOSED
COST OF $7,937.00 WITH FUNDS THEREFOR
PREVIOUSLY ALLOCATED UNDER RESOLUTION NO.
84-1239 ADOPTED NOVEMBER 8, 1984 AND WITH
THE BALANCE OF FUNDS THEREFOR BEING
ALLOCATED FROM THE 1984-85 OPERATING BUDGET
FURTHER AUTHORIZING THE CITY MANAGER TO
INSTRUCT THE PURCHASING OFFICER TO ISSUE A
PURCHASE ORDER FOR THIS EQUIPMENT.
WHEREAS, new equipment is required for adequate
ventilation and cooling of the Main Motor Pool Shop of the
Department of Building and Vehicle Maintenance; and
WHEREAS, pursuant to public notice, sealed bids were
received August 31, 1984 and a contract was duly awarded on
November 8, 1984 by Resolution No. 84-1239 to Cartwright
Ventilation, Inc. for furnishing three (3) Roof Exhaust Fans and
four (4) Air Circulating Fans, including all labor and materials
for installation, on a short-term contract basis until final
acceptance, for the Department of Building and Vehicle
Maintenance; and
WHEREAS, the Purchasing Office has twice attempted to
notify Cartwright Ventilation, Inc. in writing by certified
registered receipt mail of the award of this bid; and
WHEREAS, said mail has been returned by the United
States Post Office as "moved -left no address"; and
WHEREAS, the telephone service to said firm has been

WHEREAS, the aforementioned circumstances constitute a
failure on the part of Cartwright Ventilation, Inc. to accept the
award, furnish required evidence of insurance and begin work
z-% within the time stipulated in the bid contract; and
WHEREAS, this equipment is urgently needed to protect
rt. the health and welfare of City employees in the Motor Pool; and

WHEREAS, funds for this service were in part, allocated 5
previously by Resolution No. 84-1239, with the balance of funds

WHEREAS, the City Manager and the Director of the
Department of Building and Vehicle Maintenance recommend that the t#

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE

CITY OF MIAMI, FLORIDA:
Section 1. The contract awarded to Cartwright
f Ventilation, Inc. under Resolution No. 84-1239 adopted November
8, 1984 for furnishing Cooling fans and Ventilation Equipment,
including all labor and materials for installation at the Motor
=` Pool Shop is hereby rescinded.
Section 2. The City Attorney is hereby authorized to
take the necessary legal action in order to recover all or part =_
of the City's costs resulting from the failure on the part of
Cartwright Ventilation, Inc. to honor its bid proposal (No. 83-
84-106).
Section 3. The bid of Acme Industrial Sheet Metals,
Inc. for furnishing Cooling Fans and Ventilation Equipment
including all Labor and Materials for installation at the Motor

Pool Main Shop on a short-term contract basis for the Department
of Building and Vehicle Maintenance at a total proposed cost of
$7,937 is hereby accepted with funds therefor previously
allocated Under Resolution No. 84-1239, adopted November 8, 1984,
and the balance of funds therefor hereby allocated from the 1984-
85 Operating Budget of said Department.
Section 4. That the City Manager is hereby authorized
to instruct the Purchasing Officer to issue a Purchase Order for
this equipment.
PASSED AND ADOPTED this loth day of January 1985.

IT IS RECOMIENDED THAT A RESOLUTION BE

Pursuant to public notice, six (6) sealed bids were received
on August 31, 1984 for furnishing and installing cooling
fans and ventilation equipment.
The City Commission, at its regular meeting on November
8, 1984, awarded the subject bid to Cartwright Ventilation,
Inc. for furnishing cooling fans and ventilation system
at the Motor Pool Division of this department. Since that
time, Cartwright Ventilation, Inc. cannot be reached at
the listed address, and we have been informed that they
are no longer in business. Therefore, it is recommended
that the next lowest bid from Acme Industrial Sheet Metal,
Inc. be accepted for furnishing cooling fans and ventilation
equipment.
This equipment will be installed in the Main Motor Pool
Work Shop Area, and would provide an adequate ventilation
system in the shop during the summer weather.
Funds for this purpose are available in the current operating
budget of this department.
