WHEREAS, the Miami Planning Advisory Board at its meeting of September 19, 1984, Item No. 4, following an advertised hearing, adopted Resolution No. PAB 106-84 by a 5 to 1 vote, RECOMMENDING APPROVAL of amending Ordinance No. 9500, as amended, as herein- after set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant these amendments, as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 9500, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said ordinance as follows:l "ARTICLE 15. SPI: SPECIAL PUBLIC INTEREST DISTRICTS General Provisions 1 SECTION 1530. SPI-3: COCONUT GROVE MAJOR STREETS OVERLAY DISTRICT. SECTION 1533. CLASS C SPECIAL PERMIT. 1533.3. Special Height Limits. Words and/or figures strig%en through shall be deleted. Underscored words and/or figures shah be added, Remaining provisions remain unchanged, Asteri.sXs 'i.ndicate omitted and unchanged material. All ordinances, code sections or parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole. The Planning Advisory Board, at its meeting of September 19, 1984, Item 4, following an advertised hearing, adopted Resolution PAB 106-84 by a 5 to 1 F vote, recommending approval of an amendment to the text of Zoning Ordinance 9500, as amended, by amending ARTICLE 15 SPI: SPECIAL PUBLIC INTEREST DISTRICTS, Section 1530 SPI-3 Coconut Grove Major Streets Overlay District, Section 1533.3 to provide an exception that where the underlying zoning is i RO-3/6 the height limit shall be 80 feet and by amending the Official Schedule of District Regulations, page 4 for CR Commercial Residential Districts, Transitional Uses, Structures and Requirements and for page 5 for CG-1 General Commercial Districts, Transitional Uses, Structures and Requirements, to amend paragraph 3 in both instances to provide that the' paragraph is Permissible Only by Special Permit and that by Special Permit the specified uses may occupy up to 40 feet of the 50 feet transitional area adjacent to RS-1, RS-20 RG, RO and 0-1 Districts providing in all such instances for a minimum 10 foot landscaped buffer abutting the zoning district boundary line; on page 5 for CBD-1 Central Business District, Principal Uses and Structures, Permissible Only by Special Permit by deleting paragraph 4 pertaining to interim parking lots and substituting in lieu thereof a new paragraph 4 "Class 8 special permits for interim parking lots shall not be issued after January 1, 1985; Class B Special Permits for interim parking lots shall be revoked effective January 1, 1987. Interim parking lots shall conform to City of Miami Guides and Standards for offstreet parking facilities on and after January 1, 1987 or cease parking use." The subject ordinance was part of a much larger "Amendment L" that was before the City Commission on first reading December 20, 1984. This item was identified on said Agenda as Item No. 21. As the Clerk's minutes indicate, the specific section pertaining to SPI-3 was lifted from the total "Amendment L" package and separately passed on First Reading. The balance of Amendment L was continued to a later meeting. I am of the opinion that this passage by the Commission on December 20, 1984, constituted a valid "First Reading" for the SPI-3 Section. On January loth, 1985, this excerpt returned to the City Commission for its Second Reading. During said meeting it was erroneously referred to by the Mayor as being there on First Reading. As a result of this reference by the Mayor, the January IMI, 1985, Clerk's Report was erroneously marked to show the Item on "First Reading forthat specific meeting, instead of the correct "Second Reading." Applicable City Charter, Code and Statutory provisions mandate that Zoning Ordinances be read by title on two separate occasions. This was done. Legal requ rements have been complied with. Absent some other legal impediment, the subject ordinance should be published and codified by the City Clerk's Office.
