AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO, 9939, ADOPTED
DECEMBER 20, 1984, THE CAPITAL IMPROVEMENTS APPROPRIATION
ORDINANCE, BY SUBSTITUTING, AS A REVENUE SOURCE FY'86 FP&L
FRANCHISE REVENUES IN THE AMOUNT OF $700,000 FOR FY185 FP&L
FRANCHISE REVENUES AS THE REVENUE SOURCE COMMITTED TO
FUNDING THE MICROWAVE RADIO SYSTEM, A COMPONENT OF THE
CITYWIDE MICROWAVE 80OMHZ COMMUNICATION SYSTEM, AND
ALLOCATING THE UNCOMMITTED $700jOOO OF FY185 FP&L FRANCHISE
REVENUE TO FUND THE CITY'S REMAINING CASH COMMITMENT IN A
LIKE AMOUNT FOR STAGE I OF THE DOWNTOWN COMPONENT OF
METRORAIL; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.

WHEREAS, the City Commission adopted Ordinance No. 9939, on December 20,
1984, establishing resources and appropriations for the implementation of
Capital Improvements in the City of Miami, Florida; and
WHEREAS, the funding plan approved by the Miami City Commission for the
Citywide Microwave 800MHz Communications System included $782,000 of FY'85 FP&L
Franchise revenues committed to funding the Microwave Radio System Component;
and
WHEREAS, payment for the completion of the Microwave Radio Component to
Motorola Communication and Electronic, Inc., the Company awarded the contract
for the installation of the entire 800 MHz system, is not scheduled until FY186;
and
WHEREAS, the City of Miami has a total Stage I commitment to Metropolitan
Dade County for the Downtown Component of Metrorail of $3,320,070; and
WHEREAS, $2,340,000 is the City's cash contribution and the remaining

$980,070, is for structural changes and improvements to the World Trade Center
Garage and Biscayne Boulevard Parking which were negotiated credits for the
construction work for the benefit of the Downtown Metrorail station; and
WHEREAS, the City has paid Metropolitan Dade County $1,640,000 of the
$2,340,000 which was allocated as the City's cash contribution to Stage I; and
WHEREAS, the City's remaining cash commitment to Metropolitan Dade County
is $700,000; and
WHEREAS, the substitution of FY186 FP&L franchise revenues in the amount of
$700,000 for FY185 FP&L franchise revenues as the revenue source committed to
funding the Microwave Radio System, a component of the Citywide Microwave 800
MHz Communications System will make available the FY'85 FPU franchise revenue
as a revenue source to fund the remaining $700,000 cash commitment to
Metropolitan Dade County for the Stage I Component of Metrorail;

Section 2. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with provisions of this ordinance are hereby
repealed.
Section 3. If any section, part of section, paragraph, clause, phrase or
word of this ordinance is declared invalid, the remaining provisions of thin
ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an emergency measure on
the grounds of urgent public need for the preservation of peace, health, safety,
and property of the City of Miami, and upon the further ground of the necessity
to appropriate sufficient funds for the expansion of the Fire Alarm Office so
that a construction contract may be awarded, as required,

Section 5, the requirement of reading this ordinance on two separate days

of the Commission.
Section 5. The recitals appearing in the preamble to this Ordinance are
hereby adopted by reference as if fully set forth verbatim in this Section and
constitute an accurate description of the nature of the herein appropriation as
appearing in the title of this Ordinance.

It is recommended that the Miami City Commission approve the
attached emergency ordinance substituting FY186 FP&L
Franchise Revenues in the amount of $700,000 for FY'85 FP&L
Franchise Revenues as the revenue source committed to
funding the Microwave Radio System, a component of the
Citywide Microwave 800 MHz Communications System and
allocating the uncommitted $700,000 of FY185 FP&L Franchise
Revenues to fund the City's remaining cash commitment in a
like amount for Stage I of the Downtown Component of
Metrorail.
The City Commission approved the funding plan for the Citywide Microwave 800 MHz
Communications System in July 1984. One of the revenue sources included '
in said plan is the allocation of $782,000 of FY'85 FP&L Franchise Revenue as a
funding source for the Microwave Radio System Component. Payment for the
completion of same to Motorola Communication and Electronic, Inc., the company
awarded the contract is not scheduled until FY186. The City also has a
commitment to Metropolitan Dade County in the amount of $3,320,070 for its share
of the Downtown Component of Metrorail. The City's cash contribution is
$2,340,000 and the remaining $980,070 is for structural changes and improvements
to the World Trade Center Garage and Biscayne Boulevard Parking which were
negotiated credits for the construction work for the benefit of the Downtown
Metrorail Station. The City has already paid Metropolitan Dade County
$1,640,000 of the $2,340,000 leaving a remaining balance of $700,000.
