HomeMy WebLinkAboutO-09944Amendment No. 4 to Ordinance No. ORDINANCE NO-, 9 9 4_,4 AN ORDINANCE AMENDING SECTIONS 2 AND 6 OF ORDINANCE NO, 9901 ADOPTED SEPTEMBER 21, 1984s THE ANNUAL APPROPRIATIONS ORDINANCE FOR FISCAL YEAR ENDING SEPTEMBER 30, 1985, AS AMENDED BY ESTABLISHING A SPECIAL, REVENUE FUND ENTITLED, POLICE SECOND DOLLAR TRAINING FOR FISCAL YEAR 1984-85 FOR THE PURPOSE OF PROVIDING FUNDING IN THE AMOUNT OF $267,567 FOR LAW ENFORCEMENT TRAINING AND EDUCATION AS OUTLINED IN FLORIDA STATUTE 943.25(8)(a), REVENUE IN A LIKE AMOUNT IS AVAILABLE FROM METROPOLITAN DADE COUNTY PURSUANT TO COUNTY RESOLUTION NO. 97-82 ADOPTED JANUARY 15, 1982; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9901 on September 21, 1984, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1984; and WHEREAS, Florida Statute 943.25(8)(a), states that municipalities and counties may assess an additional $2.00 dollars as a court cost against every person convicted for violation of a state penal or criminal statute or convicted for a violation of municipal or county ordinance for criminal justice education and training including basic training expenditures for their respective law enforcement and correctional officers, part-time law enforcement officers, auxiliary officers, and support personnel, provided that such education and training activities conform to the requirements of S.943.14; and WHEREAS, the revenues generated from said $2.00 dollars is distributed by Dade County pursuant to County Resolution No. 97-82 adopted on January 19, 1982, semi-annually and is based on the number of sworn police officers on record at June 30 and December 31 of each year for each municipality; and WHEREAS, the Finance Department, pursuant with generally accepted accounting principals, recommends that the revenues and expenditures for same be accounted for in the FY'85 Annual Appropriations Ordinance ; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section.1. The herein Special Revenue Fund is established for the purpose of providing funds in the amount of $267,567 for law enforcement training and education as outlined in Florida Statute 943.25(8)(a). Revenue in a like amount is available from Metropolitan Dade County pursuant to County Resolution No. 97-82 adopted January 19, 1982. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Surana, Director REFERENCES: jj Department Of Management and Budget �M` � ENCLOSURES: It is recommended that the City Commission approve the attached ordinance establishing a Special Revenue Fund entitled, "Police Second Dollar Training for Fiscal Year 1984"85" for the purpose of providing funding in the amount of $267,567 for law enforcement training and education as outlined in Florida Statute.943.25(8)(a). Revenue in a like amount is available from Metropolitan Dade County pursuant to County Resolution No. 97-82 adopted January 19, 1982. Florida Statute 943.25(8)(a) states that municipalities and counties may assess an additional $2.00 dollars as a court cost against every person convicted for violation of a state penal or criminal statute or convicted for a violation of municipal or county ordinance for criminal justice education and training including basic training expenditures for their respective law enforcement and correctional officers, part-time law enforcement officers, auxiliary officers, and support personnel, provided that such education and training activities conform to the requirements of 5943.14.
