AN ORDINANCE AMENDING SECTION 22-8(B)(1)
OF THE CODE OF THE CITY OF MIAMI,
F L 0 R I D A I WHICH DEALS WITH PRIVATE
COLLECTION SERVICE TO COMMERCIAL
ESTABLISHMENTS BY ADDING A NEW PARAGRAPH
(f) ESTABLISHING THE HOURS OF 6:00 A.M.
AND 11:00 P.M. AS THE ONLY HOURS FOR
WASTE COLLECTION TO COMMERCIAL
ESTABLISHMENTS LOCATED OUTSIDE THE
CENTRAL COMMERCIAL DISTRICT; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY
CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 22-8(B)(1) of the Code of the
City of Miami, Florida, as amended, is hereby further amended
in the following particulars:)
"Sec. 22-8. Frequency and amount of garbage
collection service provided by
city; collection of excessive
accumulations where city service
is inadequate
(A) City Service Generally.
(B) Collection of Excessive Accumulations.
(1) Private collection service to commercial
establishments.
(f) Private waste collection
operators duly licensed by the
city, whose services are
employed outside the central
commercial district, as herein
defined, shall service those
accounts only between the hours
of 6;00 A,M. and 11;00 P.M."

Section 2. All ordinances or parts of Ordinances in
conflict herewith, insofar as they are in Conflict, are
hereby repealed.
Section 3. If any section, part of sectioni
paragraph, clause, phrase, or word of this ordinance i.s
declared invalid, the remaining provisions of this ordinance
shall not be affected.

Pickup Hours

City Attorney December 13� 1984
On November 159 1984 we forwarded an initial draft of a
proposed ordinance regulating hours of collection for
commercial waste haulers. We have now been informed by the
Solid Waste Department of the City that 6:00 A.M. is the time
that City waste -collection crews commence their operations.
Research indicates that the City Code evening prohibition
against the operation or playing of music aimed at not
disturbing "the quiet) comfort or respose" of persons in
their homes and residences takes effect at 11:00 P.M (Sec.
36-5). Accordingly, the attached ordinance incorporates the
6:00 A.M. and 11:00 P.M. time period as the permitted hours
of operation for commercial waste haulers in areas outside of
the Central Commercial Distrtict.
The City Manager is receiving a copy hereof for placement on
the December 13, 1984 Agenda for first reading.
