HomeMy WebLinkAboutR-85-006340 r J-85-60 RESOLUTION NO. 85-6 3 A RESOLUTION ACCEPTING THE PLAT ENTITLED "DOWNTOWN CENTER TRACT", A SUBDIVISION IN THE CITY OF MIAMI; AND ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT; AND ACCEPTING THE COVENANT TO RUN WITH THE LAND POSTPONING THE IMMEDIATE CONSTRUCTION OF CERTAIN IMPROVEMENTS UNTIL REQUIRED BY THE DEPARTMENT OF PUBLIC WORKS; AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT AND PROVIDING FOR THE RECORDATION OF SAID PLAT IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA. WHEREAS, the Department of Public Works recommends the acceptance of the plat: NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The plat entitled "Downtown Center Tract", a subdivision of land lying and being in Section 37, Township 54 South, Range 41 East, City of Miami, Dade County, Florida, more particularly described as follows: Begin at a point 5.00 feet westerly of the Northeast corner of Lot 1, Block 134 North, A.L. Knowlton Map of Miami, as recorded in Plat Book "B", Page 41 of the Public Records of Dade County, Florida, thence S. 87 0-44'-50" W. along the South line of the abandoned 25.0 feet right-of-way of Florida East Coast Railway lying westerly of South Miami Avenue in the City of Miami, Dade County, Florida for 75.83 feet to a point on a curve, said point bears N. 100 03158" E. from the radius point; thence northwesterly along a circular curve to the left having a radius of 2316.37 feet and a central angle of 2`02110" for an arc distance of 82.32 feet to a point tangent; thence N. 81'-58'-12" W. for 218.64 feet to a point on a curve, said point bears S. 22 * 48'07" W. from the radius point; thence Northwesterly along a circular curve to the right having a radius of 586.19 feet and a central angle of 8 !-13' 43" for an arc distance of 84.19 feet, said last mentioned course being coincident with said abandoned right-of- way; thence N. 2'-19'-30" W. for 30.22 feet to a point on a curve, said point bears S. 32043'37" W. from the radius point; thence Northwesterly CITY COMMISSION Yr7r. The proposed record plat entitled "Downtown Center Tract" is a subdivision of a portion of Section 37 Township 54 South, Range 41 East, bounded on the East by Miami Avenue, on North by S.W. 2nd Street, and on South and West by line parallel to and 12.5 feet distant from center line of F.E.C. Hotel Spur Tract, as shown in Deed Book 3, Page 143 of the Public Records of Dade County, Florida. The plat consists of one tract containing 1.2 + acres more or less. It is zoned CBD - 1/9• This plat is being forwarded to your office for City Commission action. The foregoing recitals are true and correct. 2. The CITY hereby allows the existing portion of the IMPROVEMENTS to remain within the ENCROACHMENT AREA. 3. In the event a portion of the IMPROVEMENTS located in the ENCROACHMENT AREA or a portion of the IMPROVEMENTS directly related to the ENCROACHMENT AREA is irreparably damaged, demolished or destroyed, the OWNER shall not rebuild or reconstruct the IMPROVEMENTS within the ENCROACHMENT AREA, and shall dedicate that portion of Zoned Right of Way including the ENCROACHMENT AREA to the City. 4. The OWNER agrees to refrain from further construction in the ENCROACHMENT AREA and acknowledges that no building permit will be issued by the CITY for construction in the ENCROACHMENT AREA. 5. The OWNER does hereby covenant to indemnify, save and hold harmless the CITY from any claims, demands or liabilities of any nature whatsoever arising out of or because of the granting of this Covenant, and will defend or cause to be defended, any action brought against the CITY in connection herewith; and the OWNER shall carry a general comprehensive liability insurance policy, in the amount of $1.000,000.00 Said policy of insurance shall be procured by, and the premiums paid by, the OWNER; its effective date shall precede the effective date of this Covenant. A Certificate of Insurance bearing the name of the City of Miami as the party insured, or other proof of insurance coverage affording protection to the CITY, shall be provided to the satisfaction of the CITY. Said insurance shall provide that the CITY be given at least thirty (30) days advance written notice of any material changes, cancellation or non -renewal notification of any policies, and in event of such material change, cancellation or non -renewal notification, the OWNER shall immediately replace said policy with another policy to -2- J SMITH • MANDIAR. In the further event that the CITY is not in possession of same by such latter date, then CITY shall have -the right to immediately secure similar insurance policy in its name with the total cost of the premium and all those as may become due during the life of this Covenant being charged to the OWNER, and the CITY shall have the right to declare and establish same as a lien on the described premises of such defaulting owner and enforced as any lien provided under the Statutes of the State of Florida. 6. This Declaration of Covenant shall run with the land and shall be binding upon and inure to the benefit of the parties hereto their successors and assigns wherever the context hereof so requires or admits.
