WHEREAS, the Miami Planning Advisory Board, at its meeting of January 2, 1985, Item No. 4, following an advertised hearing, adopted Resolution No. PAB 4-85, by a 6 to 0 vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the zoning ordinance of the City of Miami, Florida, is hereby amended by applying the SPI: 17 SOUTH BAYSHORE DRIVE OVERLAY DISTRICT to area generally bounded by. McFarlane Road, South Bayshore Drive, a line approximately 200 feet east of, and parallel to, Aviation Avenue (less an area at the Southeast corner of the intersection of Tigertail and Aviation being an area approximately 150 feet. along Tigertail and approximately 100 feet along Aviation), Tigertail Avenue, Mary Street, Grand Avenue, and a line approximately 250 feet west of, and parallel to Mary Street, to the point of beginning; more particularly described asp Lot 17 IM, less the northwesterly appt6xifftately 100 feet, all Lot 18 And Lot 19 less that portion of Lot 19 of said sub lying northwesterly of the northeasterly extension of the southeasterly line of Lot 21 less the northwesterly 94 feet thereof and Lots 26-37t Block 381 Lots 1-12 inclusive, Block 39 and closed portion of Blaine Street (Ordinance No. 1448) and Lots 1-6 inclusive, Block 40 and Lots 1-58 inclusive, Block 41 NEW BISCAYNE AMENDED (B-16); and TRACT "A" OAK VILLA (91-23) : Lots 1-55 INCLUSIVE, DAY GROVE TERRACE (9-180)*, Tract A, GROVE MOUNTAIN ( 118-16) ; Tract 10 HOUSER SUB (28-50; Lot 56 (remnant) CORNELIA M. Section 2. It is hereby found that this zoning classi- fication changeb. (a) Is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) Is not contrary to the established land use pattern; (c) Will not create an isolated district unrelated to adjacent and nearby districts; (d) Is not out of scale with the needs of the neighborhood or the City; (e) Would not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) Is necessary due to changed or changing conditions; (g) Will not adversely influence living conditions in the neighborhood; (h) Will not create or excessively increase traffic congestion or otherwise affect public safety; (i) Will not create a drainage problem; (j) Will not seriously reduce light and air to adjacent' area; W Will not adversely affect property values in the adjacent area; (1) Will not be a deterrent to the improvement or develop- ment of adjacent property in accordance with existing regulations; (m) Will not constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare; -2- Section S, Pagtg No, 45 and 46 of the 20hing AtIA91 ffiadt a part of ordinance No. 9500 by tefototCe and description in Article 3# Section 100 of said Ordinance, are hereby amended to reflect the changes ftiade necessary by those amendmentg. Section 4. All ordinances, code sections, or Parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 56 Should any part or provision of this Ordi- n. nance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole. To apply the proposed SPI 17: SOUTH BAYSHORE DRIVE OVERLAY DISTRICT to the area northwest of South Bayshore Drive, from Aviation Avenue to McFarlane Road The Bayshore Drive. Development Study proposed this zoning change. The Planning Department has recently studied the mounting development, pressures for the South Bayshore area for large scale office development. As a result "of this study, entitled Bayshore Drive Development Study, a text amendment and related atlas changes were recommended that would establish necessary height restrictions, design guidelines and other pertinent policies.
