WHEREAS, the Miami Zoning Board, at its meeting of
January 21, 1985, Item No. 1, following an advertised hearing,
adopted Resolution No. ZB 9 -85, by • 7 to 0 vote, RECOMMENDING
DENIAL of a change of zoning classif ation, as hereinafter set
forth; and
WHEREAS, the City Commissi• after careful consideration of
this matter deems it advisable -nd in the best interest of the
general welfare of the City , f Miami and its inhabitants to deny
this change of zoning class fication as hereinafter set forth- -
NOW, THEREFORE, BE I ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA.
Section 1. T•e Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of he City of Miami, Florida, is hereby amended
by changing the oning classification of approximately 601 -651
Northwest 57 Court, Miami, Florida, more particularly
described as Lets 1, 2, 3, and 4 less the E 50', Lots 5 and 6 and
the N 1/2 of Lot 7, Block 17, WEST FLAGLER PARK (8 -96) of the
Public Re••rds of Dade County, Florida, from RS -2/2 One Family
Detached .• esidential to RO 1/2 Residential- Office.

Neighborhood Plan;

Section 3. Page No. 3• of the Zoning Atlas, made a part
of Ordinance No. 9500 by ref rence and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary b these amendments.
Section 4. Al ordinances, code sections, all parts
thereof in conflict rewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this
Ordinance be de• ared by a court of competent jurisdiction to be
invalid, the -ame shall not affect the validity of the ordinance
as a whole.

HISTORY OF RECOMMENDATIONS AND ACTIONS
ZONING BOARD MEETING 10/1/84
PLANNING DEPARTMENT DENIAL. The proposed change is not in accord
with the Miami Comprehensive Plan and the land
use characteristics of the area. The granting
of this change would result in a precedent
setting, unjustified encroachment into the
residential area, and cause residential uses to
be faced with liberal commercial zoning
classification. The effect would be detrimental
to the general character of the area along NW
57th Court which is residential in nature.
PUBLIC WORKS No dedication is requested.
No comment.
At its meeting of October 1, 1984, the Zoning
Board adopted Resolution ZB 91 -84 by a 8-0 vote,
continuing the above to November 5, 1984 for
applicant to complete application information
At its meeting of November 5, 1984, the Zoning
Board adopted Resolution ZB 103-84 by a 6.2
vote, deferring the above to January 21, 1985.

before the Miami Zoning Board, the applicant, Eugene R. Picchi
Incorporated, has changed its request for zoning to a less intense
district, that is the Application should now read a Request for Zone

Present Zoning Designation - RS 2/2
Dear Mayor and City Commission:
The Present Zoning Designation on this property is inappropriate
because this property has been unusable in its present zoning
classification for forty (40) years.
The property directly to the East, the Shell Gasoline Station,
includes the East 50 feet of Lots 1, 2, 3 and 4 and is immediately
adjacent on the North with the rear 50 feet of Lot 5. The Shell
Gasoline Station, and the other commercial property directly to
the East of Lot 5 and the adjacent Lots 6 and the North Half of
Lot 7, all owned by the applicant, are also zoned commercial.
Lots 6 and the North Half of Lot 7 will be used as parking for
the building which the applicant desires to place on the Lots in
question.
Many attempts have been made by the applicant over the years to
find another use for the property. There is an existing wooden
structure on the property which has been closed and boarded up,
and which is untenable for use as anything. There is also a
small CBS structure on the very South end of the property which
has been abandoned and is not usable at this time and which is
intended to be razed if the Application is approved.
Further, the property does nothing but grow up in high weeds
which the applicant as owner is required to cut-down regularly,
at a heavy cost to the applicant.

The property lies on Northwest 7th Street just West of Northwest
57th Avenue, a major traffic thoroughfare immediately adjacent
to a very high traffic intersection. The property across the
street on the North, the property on each corner of the inter-
section and the property immediately adjacent to this property
on the East and North are all zoned commercial and heavy commercial
uses are presently established thereon.
Despite repeated attempts over the years no buyers have been
obtained willing to build residences on the property, and the
property remains fallow, a burden both to the propery owner
and to the City.
By this Application, it is intended to put a good use on the
property which will be a tax paying entity and which will be
compatibly wi tr - with the area.

Dear Mayor and City Commission:
The Present Zoning on this property has remained for forty
(40) years. It is unusable.
The Application would permit the construction of a commercial
office building with retail stores facing only inward (none
facing toward the street) so that the property could be utilized.
The Lots in question are immediately adjacent to a Shell Gasoline
Station and other commercial property.
The Site Plans and Proposed Building Plans which are a part
of this Application indicate the construction of a two story
office building with elevator, off the street parking, ingress
and egress to Northwest 7th Street and limited emergency egress
to Northwest 57th Court. The front portion of the property
comprising Lots 1 thru 5 will be utilized for the structure and
the rear portion of the property comprising Lots 6 and the North
1/2 of Lot 7 will be used solely for parking in connection with
the commercial use.
The applicants have made many attempts over the past years to
utilize this proeprty but ever since the Shell Gasoline Station was
build's on the East 50' of Lots 1 thru 4 the remaining area on

the Lots has been too small to permit any kind of development and
the Lots have remained fallow these many years.
The proposed use will enable an attractive building to be
constructed on the North Lots facing Northwest 7th Street,
a heavily used commercial artery and parking with a buffer
area adjacent to the remaining RS 2/2 property on the South.
Briefly, it is intended by this Application to utilize a parcel
of property which has remained an eyesore in the area for many
many years and which now can be developed in such a way as to
benefit the community in which it is located, allow beautification
of the area, and become a taxpayer for the city.

THE CITY OF MIAMI, FLORIDA, BY CHANGING THE
ZONING CLASSIFICATION OF APPROXIMATELY
601 -651 NORTHWEST 57TH COURT, MIAMI,
FLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN)
FROM RS -2/2 ONE FAMILY DETACHED RESIDENTIAL
TO R/0 - 1/2 RESIDENTIAL OFFICE BY MAKING
FINDINGS; AND BY MAKING ALL THE NECESSARY
CHANGES ON PAGE NO. 30 OF SAID ZONING ATLAS
MADE A PART OF ORDINANCE NO. 9500 BY
REFERENCE AND DESCRIPTION IN ARTICLE 3,
SECTION 300, THEREOF, CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of
January 21, 1985, Item No. 1, following an advertised hearing,
adopted Resolution No. ZB 9 -85, by a 7 to 0 vote, RECOMMENDING
DENIAL of a change of zoning classification, as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to deny
this change of zoning classification as hereinafter set forth.p'
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF TBE CITY
OF MIAMI, FLORIDA.
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately 601 -651
Northwest 57th Court, Miami, Florida, more particularly
described as Lots 1, 2, 3, and 4 less the E 50', Lots 5 and 6 and
the N 1/2 of Lot 7, Block 17, WEST FLAGLER PARK (8 -96) of the
Public'Records of Dade County, Florida, from RS -2/2 One Family
Detached Residential to RO 1/2 Residential - Office.
Section 2. It is hereby found that this zoning
classification change:
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) Is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts.
(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) Is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) .Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; ■■•.•
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare;
Section 3. Page No. 30 of the Zoning Atlas, made a part
of Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances, code sections, all parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 5. Should any part or provision of this
Ordinance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.
