A RESOLUTION AUTHORIZING THE REDUCTION OF
TIME WHICH SHALL INTERVENE BETWEEN THE
DATE OF PUBLICATION OF THE NOTICE INVITING
BIDS FOR THE FOR THE BAYFRONT PARK
REDEVELOPMENT PROJECT-BAYWALK FILL PHASE I
AND THE FINAL DATE FOR SUBMITTING BIDS FROM
15 TO 8 CALENDAR DAYS.
WHEREAS, in order to construct the Bayside Specialty Center
and the Bayfront Park Redevelopment Project a certain portion of
Biscayne Bay must be filled; and
WHEREAS, the U.S. Army Corps of Engineers is to construct
the Bayfront Walkway and Facilities Project including this fill
as part of the Bayfront Park Redevelopment Project; and
WHEREAS, a portion of this fill area, herein designated as
Phase I, within the proposed Bayside Center Limited Partnership
leasehold for the Bayside Specialty Center, must be filled prior
to commencement of the U.S. Army Corps of Engineers Project; and
WHEREAS, in order to meet the City's contractual obligations
to the Bayside Center Limited Partnership, work on the Phase I
Fill Area must be completed on an expedited schedule; and
WHEREAS, this necessitates a reduction in the time which
shall intervene between the publication of the Notice Inviting
Bids and the final date for submitting bids, in accordance with
the City Code, Section 18.52.1, from 15 to 8 calendar days; and
WHEREAS, all other requirements of the City Code Section
18.52.1 Competitive Sealed Bidding, will be met in this project;
WHEREAS, the City Manager has made a written finding that a
valid emergency now exists for a reduction in the time which
shall intervene between the date of publication of the Notice
Inviting Bids and the final date for submitting bids;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The findings set forth in the preamble to this
Resolution are hereby adopted as if fully set forth in this
Section.
Section 2. The reduction of the time which shall intervene
between the date of publication of the Notice Inviting Bids for
the Bayfront Park Redevelopment Project-Baywalk Fill Phase I, and
the final date for submitting bids, from 15 to 8 calendar days is
hereby authorized by a two-thirds vote of the members of the City
Commission.
Section 3. The City Manager is hereby authorized to
instruct the Department of Public Works to assist in the
completion of Bid Documents including Plans and Specifications,
carry out Bidding as set forth in the City Code Section 18-52.1
and as provided for herein, and submit to the City Manager for
consideration by the City Commission at their earliest possible
meeting, a recommendation to award the construction contract for
the Bayfront Park Redevelopment Project-Baywalk Fill Phase to the
lowest responsible and responsive bidder.

In order to develop the Bayside Specialty Center and the north half of
the Bayfront Park Redevelopment Project an area of the bay, south of the
Miamarina, is to be filled as part of the U.S. Corps of Army Engineers
(C.O.E.) Bayfront Walkway and Facilities Project. A portion of this fill
area, referred to as Phase I, which lies within the Bayside Center
Limited Partnership leasehold must be filled prior to commencement of
work by the C.O.E. In order to carry out this work and meet the
schedule to which the City is obligated through our agreement with
Bayside Center Limited Partnership, the project must be undertaken on an
accelerated schedule.
This resolution reduces the number of days during which the project is
out to bid, from the required 15 to 8 calendar days. The advertisements
Inviting Bids will be published in two newspapers of general
circulation and all the other procedures outlined in the City Code
Section 18.52.1 Competitive Sealed Bidding will be followed.
To authorize this change in procedures,
