A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT
AMOUNT OF $14,553.14 IN THE CONTRACT BETWEEN THE
CITY OF MIAMI, FLORIDA AND BETTER CONSTRUCTION, INC.,
DATED MAY 11, 1982 FOR THE CONSTRUCTION OF JOSE MARTI
RIVERFRONT PARK, SAID FUNDS TO BE PROVIDED FROM FUNDS
APPROPRIATED TO THE PROJECT BY ORDINANCE 9534 ADOPTED
DECEMBER 9, 1982 AND AMENDED NOVEMBER 16, 1983;
FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING
THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY
CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF TWO-THIRDS
OF THE MEMBERS OF THE CITY COMMISSION AND ADOPTING
CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESO-
LUTION; ALSO ACCEPTING THE COMPLETED WORK OF BETTER
CONSTRUCTION, INC., AT A TOTAL COST OF $1,972,337.14
AND AUTHORIZING FINAL PAYMENT IN THE AMOUNT OF
424,342.06 PLUS INTEREST BEGINNING FEBRUARY 14, 1985
UNTIL THE DATE OF PAYMENT.
WHEREAS, there exists a contract dated May 11, 1982

between the City of Miami, Florida and Better Construction, Inc.,

in the amount of $1,910,934.00 for the construction of Jose Marti
Riverfront Park; and
WHEREAS, the amount of the contract has been increased

by $35,000 by Resolution No. 83-704, adopted July 28, 1983, and by
$11,850 authorized by Resolution No. 84-77, dated January 19,

1984, which increased the contract amount of $1,957,874.00; and
WHEREAS, an additional increase in contract of $14,553.14
is required to cover the final construction cost of the project,
said additional cost having been caused by changes in the work or

additional work ordered by the City during the final stages of
the project; and
WHEREAS, the City Manager has made a written finding that
a valid emergency existed to have Better Construction, Inc., do
the said changes in work and additional work while they were on
the site; and
WHEREAS, Better Construction, Inc., has satisfactorily
completed all of the work covered by the contract and the afore-
mentioned changes in the work and additional work, and has furnished

materials in connection with the project have been paid in full; and
WHEREAS, the City Manager and the Director of the
Department of Public Works recommend the increase in contract to
cover the additional construction cost and the acceptance of the
completed work and final payment of $24,342.06 to Better Construction,
Inc.; and
WHEREAS, funds for the increase are available from funds
appropriated to the project by Ordinance No. 9534, dated December
9, 1982 and as amended November 16, 1983;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. After a properly advertised public hearing,
the finding of the City Manager set forth in the preamble of the
resolution is hereby ratified by an affirmative vote of two-thirds
of the City Commission, and adopted as fully set forth in this
section.
Section 2. The contract between the City of Miami,
Florida and Better Construction, Inc., dated May 11, 1982 for the
construction of Jose Marti Riverfront Park is hereby increased by
$14,553.14, with funds therefor hereby allocated from funds
already appropriated to the project by Ordinance 9534 dated
December 9, 1982 and amended November 16, 1983.
Section 3. The completed work performed by Better
Construction, Inc., for Jose Marti Riverfront Park is hereby
accepted at a total cost of $1,972,337.14.
Section 4. The proper officials of the City of Miami,
Florida are hereby authorized to pay Better Construction, Inc.,
a balance of $24,342.06 as just and complete payment for all
work performed and all materials furnished in connection with
the aforesaid contract.

Section 5. Payment of interest is hereby authorized
of the amount of $24,342.06 at the rate of 9% per annum for the
period beginning on February 14, 1985, until the date of final
payment.

The Department of Public Works recommends the adoption
of a resolution authorizing an increase in the contract
amount of $14,553.14 in the contract between the City
of Miami and Better Construction, Inc., for the con-
struction of Jose Marti Riverfront Park, said funds to
be provided from funds already appropriated to the
project; further ratifying the City Manager's written
finding that the increase resulted from emergency cir-
cumstances by an affirmative vote of two-thirds of the
members of the City Commission; also accepting the
completed work of Better Construction, Inc., at a total
cost of $1,972,337.14 and authorizing the payment of
interest, at the rate of 9% per year, for the period
from February 14 to the date payment is made, on the
amount of the final payment.
There currently exists a contract dated May 11, 1982 between the City
of Miami and Better Construction, Inc., in the amount of $1,957,874.00
for the construction of Jose Marti Riverfront Park, (Phase I). The
original amount of the contract was $1,910,934.00, but previous in-
creases in the contract amount of $35,000.00 by Resolution No. 83-704
adopted July 28, 1983, and $11,850.00 authorized by Resolution No.
84-77 dated January 9, 1984 increased the contract to the amount
stated above.
The project has now been completed by Better Construction, Inc., and
the final construction cost is $1,972,337.14, which reflects an over-
run of the contract amount of $14,553.14. The overrun was caused by
changes in work and additional work ordered by the City on an emerg-
ency basis that will ultimately result in a savings when Phase III of
the park is constructed.. The City Manager has made a finding that
the work causing the overrun was done under emergency circumstances.

The completed work by Better Construction, Inc., is found to be
satisfactory, and they have furnished us with documents certify-
ing that all labor and materials connected with the project have
been paid in full. This department recommends the adoption of
a resolution that will authorize an increase in contract in the
amount of $14,553.14 from funds already appropriated to the project
and the acceptance of the completed work and authorization of final
payment to the contractor.
This item was not taken up on February 14, 1985 and is being
