MINUTES OF SPECIAL MEETING OF THE CITY COMMISSION OF MIAMI, FLORIDA On the 8th day of March, 1985, the City Commission of Miami, Florida, met at its regular meeting place in the City Hall, 3500 Pan American Drive, Miami, Florida in special session to consider business of public import, namely, the selection of a City Manager The meeting was called to order at 4:50 O'Clock P.M. by Mayor Maurice A. Ferre with the following members of the Commission found to be present: Commissioner Demetrio Perez, Jr. Commissioner Miller J. Dawkins Commissioner J. L. Plummer, Jr. Vice -Mayor Joe Carollo Mayor Maurice A. Ferre ALSO PRESENT: Randolph Rosencrantz, City Manager Lucia Allen Dougherty, City Attorney Ralph G. Ongie, City Clerk Matty Hirai, Assistant City Clerk An invocation was delivered by Mayor Ferre who then led those present in a pledge of allegiance to the flag. 1 CONDOLENCES TO THE FAMILY OF CHARLES R. HADLEY, UPON HIS DEATH Mayer Ferre: As you know, Charles Hadley passed away last week. We need to formalize a resolution of condolence for Charles Hadley. Mr. Plummer: So move. Mr. Dawkins: Second. Mayor Ferre: Call the roll, please. Mr. Plummer: So move. Mr. Dawkins: Second. Mayor Ferre: David Cerf, for the record, ran for City Commissioner one or twice, he served as a civic activist and was highly regarded and respected. PRINCE CONCERT AFT FOR ORANGE BOWL ON APRIL 6 AND 7, 1985 Mayor Ferre: I'd like to ask... Is Cesar here? Nestor, would you have Cesar come down and explain to the Commission... I think we ought to get on the record that the administration is recommending, but Commissioner Plummer, why don't you explain. This is a request by people that are going to bring Prince down to Miami. These are two leading radio stations who would like to have the Orange Bowl do in Miami similarly as it did for Michael Jackson. Mr. Plummer: Mr. Mayor, as you have said, there are two radio stations, the Black radio station and Y-100, who have joined hands. Mayor Ferre: W.E.D.R. Mr. Plummer: W.E.D.R. who have joined hands and are desirous of having the Prince concert in Miami in April. They have proffered to this Commission and asked for the same rights that were granted to the Michael Jackson concert, with one exception. That exception, in my opinion, is better for the City. That is that they will pay a flat figure of 750 per patron for the concession rights, which would be split with the City and the Dolphins, which have the concession rights. That is the only thing that I can see as a difference. Other than that, everything is the same as the Michael Jackson concert. Mayor Ferre: Does anybody have any objections? Mr. Dawkins: What was the split for the Michael Jackson in the concession? Mr. Plummer: The split, Commissioner, was the City received from the Dolphins the same percentage that it receives under normal circumstances. I think that is 32%. They made an agreement, the Dolphins made an agreement with the promoters for all of the so-called Jackson products. They made their own. Whatever the Dolphins took in, we got our normal 32% of that. sl 3 March 8, 1985 Nw- Mr. Dawkins: Now we're going to get 25%? Mr. Plummer: No, sir, we would now get a flat fee of 750 per person paid to the concession rights. In effect, we would come out with more money in the end. The rental stays the same. Their request is $25,000; the same rental as was afforded to the Jackson concert with the normal provisions of an extra day and no additional charges if it rains. The City will provide the traffic policemen outside. They can provide all the security inside. All of that is the same as it was before. ------------------------------------------------------------ !TOTE FOR THE RECORD: Commissioner Carollo entered meeting at 4:53 P.M. ------------------------------------------------------------ Mayor Ferre: Commissioner Carollo, while we were waiting for a full Commission, we took up several matters. Three of them were condolences for the family of Charles Hadley, David Cerf, and Bob East. We are now on the subject of a proposal by Y-100 and W.E.D.R. to bring Prince tn the Orange Bowl, and as Plummer has outlined, in the same deal.... Mr. Plummer: With that one exception, Joe, which on the sheet you have is item 2. — Mayor Ferre: Is Cesar Odio here? Mr. Plummer: As I understand it, Mr. Mayor, if the Commission so entertain a motion to approve subject to the administration ratification and negotiation. Mayor Ferre: Plummer so moves. Is there a second? Mr. Plummer: Here's Mr. Odic) now. Mayor Ferre: There's a question on this Y-100/W.E.D.R. Is this something that you feel that would be advisable? Mr. Odio: If it is the same thing that we had with the concert of the Jackson Brothers, I think it good for the City of Miami. Mayor Ferre: There is a motion by Plummer. Is there a second? Mr. Carollo: Mr. Mayor, when do, they need tn have an answer? Mayor Ferre: Today because the concert will be April.... Mr. Plummer: 7th, that's not the time frame. The problem with the time frame is they're winding up their scheduling tour and they have to know this week. Mr. Carolln: As far as the City being protected, insurance, liability.... Mr. Plummer: That would be part of the negotiations. This is only waiving of the normal fees as they did the Jackson. Mr. Carnllo: How much were the fees charged on Jackson after the flat fee? Mr. Plummer: $25,000. Mr. Odin: They will pay COMMENTS - AUDIO DIFFICULTY. for any damages INAUDIBLE s1 4 March 8, 1985 I Mayor Ferre: I think the important thing is that ynu know the highlight of the Jackson Tour was Miami and Prince evidently has decided to challenge Michael Jackson in Miami, so obviously this will put us in the concert map. The following motion was introduced by Commissioner Plummer, who moved its adoption: MOTION NO. 85-221 A MOTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO NEGOTIATE WITH STADIUM MANAGER CORPORATION FOR A CONCERT TO BE STAGED BY 6-100 AND W.E.B.R. FOR A "PRINCE" CONCERT IN THE ORANGE BOWL STADIUM ON APRIL 6 A14D 7, 1985 AND GRANTING THEM THE SAME RATE FOR USE OF THE STADIUM AS WAS GRANTED TO THE PROMOTERS OF THE MICHAEL JACKSON CONCERT EXCEPT THAT 750 PER PATRON FOR THE _ CONCESSION RIGHTS SHALL BE SPLIT BETWEEN THE CITY AND THE MIAMI DOLPHINS; FURTHER STATING THAT ALL OF THE ABOVE IS TO BE SUBJECT TO THE CITY MANAGER'S APPROVAL. Mayor Ferre: For legal purposes so that this is not challenged legally under the powers granted to me within the Charter, I have extended the Commission meeting for the purposes of reviewing and agreeing to the license agreement between the City of Miami and Stadium Management Corporation for the purposes renting the Orange Bowl to bring Prince in April to Miami. 5 SELECTION OF CITY MANAGER Mayor Ferre: We're now in the selection of City Manager. INAUDIBLE BACKGROUND COMMENTS NOT ENTERED INTO THE PUBLIC RECORD. Mayor Ferre: I would recommend that as a procedure that we have nominations for the position that we have those ballots announced by the Clerk as we proceed and that we go for ten ballots and then take a break either to come back and continue the voting or come back to do it another time, sl 5 March 8, 1985 if that is required, a decision we will make at that time. I would hope that we could make the decision today. I think we've had ample opportunity. Does anybody disagree with that? Then I will open the floor for nominations for candidates for City Manager. Mr. Plummer: Mr. Mayor, I nominate Cesar Odin. May-r Ferre: Are there any other nominatinns? I might remind you.... Mr. Plummer: I move that the nominations cease. LAUGHTER. Mayor Ferre: That's real cute, but under the rules that we outlined, it doesn't work that way. Mr. Carollo: If the Commissinner thinks it's wnrking, INAUDIBLE AUDIO TROUBLE. Maynr Ferre: I will remind you that the nominatinns do not need any seconds. Mr. Carolln: I would like to nominate Sergio Pereira. Mayor Ferre: Are there any other nominations? Mr. Dawkins: Mr. Maynr, I wnuld like to nominate a gentleman who after looking at all of the applicants, I saw the (INAUDIBLE - AUDIO TROUBLE) I felt then and I feel now that he did a good job and was a good manager. I place the nomination of Howard Gary. Mayor Ferre: I think out of courtesy it proper to have Randy Rosencrantz. I will nnminate Randy Rosencrantz. Are there any other nominees? Mr. Perez: I would like to make the nomination of Cesar Odin. Anyhow I want to make public I am going to (INAUDIBLE - AUDIO TROUBLE) Cesar Odin is the first Cuban American background to be the next City Manager of the City of Miami. Maynr Ferre: Are there any other nominations to be placed? Are there any other candidates that need to be nominated? (INAUDIBLE - AUDIO TROUBLE) Then we will proceed with the vote. (INAUDIBLE) ....increase the nominations, but that would require three votes, once the nominations are closed. I'm saying this up front so (INAUDIBLE). Are there any other nominees? Is there a motion to close? Mr. Carolln: There is a motion to close nominations, Mr. Maynr. Mayor Ferre: Is there a second? Mr. Perez: Second. Mayor Ferre: It's seconded. Mr. Carolln: Mr. Mayor, (INAUDIBLE - AUDIO TROUBLE) ... it certainly appears that it's between Sergio Pereira and Cesar Odio. I think they are both fine individuals. The reason I voted for Pereira is simply that he has been in the position of leadership as an administrator for fourteen years for Dade County. He has had some of the most important responsibilities that this county can give to an assistant administrator. I'm referring to the airport and port of Miami, in addition to responsibilities that he has had. Mr. Odin, on the other hand, has proven himself in many areas but his experience in government is limited to five years. In those five years he hasn't had anywhere near the experience and responsibility that Mr. Odio has had under him in Dade County. I think they are two fine individuals, but I think we have to see which of the two stands up. That is why I voted for Mr. Pereira. I think his background, fourteen years in Dade County, with the key responsibilities that he has had there; that background to me stands out the most. Mr. Plummer: Mr. Mayor, very simply, Mr. Odin I think is very well known in each and every one of us. I don't think I have to go any further than that. My vote is conscientious. They know Cesar Odin. Mr. Perez: I want to make public, I don't think that I have to go through Cesar Odin's record. I think in my three sl 7 March 8, 1985 years in this City Commission, I have had the opportunity to deal with this great City administrator. I am very proud of the record of Cesar Odin for the people of the City of Miami. He has participated in different community projects, in important events as the Miss Universe, internatinnal events, and I know for certain for these three years I have had a high concept of professinnal work, of credibility about his family background. Also, I would like to emphasize from my own conviction, (INAUDIBLE - AUDIO TROUBLE)- he's a great anti -communist member. I would like to recognize the family of Amadoro Odin, distinguished members of the Cuban political situation. APPLAUSE. Mayor Ferre: We're now on the sixth ballot. I don't recall in the past, forty-seven ballots, as I recall, that there wasn't some movement during the process. We have now gnne on fourteen ballots, excuse me fifteen, fourteen without a change. The first ballot was different. I just want to state into the record, Mr. Mayor, (INAUDIBLE - AUDIO TROUBLE) ... the manager is chosen, I have absolutely no, no change. Take that for what it's worth. Mr. Ongie: They have all been identical. Mayor Ferre: We have now... I nominated Rosencrantz. What has happened (INAUDIBLE - AUDIO TROUBLE)... We have now gone for twenty ballots. Everyone has voted absolutely the same every time. My guess, Mr. Plummer, you aren't the only one who is willing to make (INAUDIBLE - AUDIO TROUBLE). I think of the candidates that receive two votes, in my opinion they are both qualified to hold this job for the City of Miami. I have told both Sergio Pereira and Cesar Odio that I would be pleased if either one as the Manager of the City of Miami. I have voted twenty times for Sergio Pereira because, as an administrator in the public sector for fourteen years, he has some strong & favorable qualifications that on his own merits and through his own efforts have gotten him the position of assistant to the County Manager. In that area of County Assistant Manager, he is number three. In the county he oversees the seaport, the airport, the financial operations of Metropolitan Dade County. On Dade County, including the airport and seaport, there is an operation in excess of 30,000 employees. The budget alone of the airport and the seaport and the business transactions in things that we do are larger•'than the City of Miami. It is a very large responsibility, which Pereida has done commendably and without any blemish of any sort. I think that he at age forty, after fourteen years with Metropolitan Dade County, and previously with government in New Jersey, specifically in the manpower field, has become a person to be highly regarded by his peers. There is no sl 10 Mar--h 8, 1985 secret that Mr. Pereida and , who) is second in command for Dade County, our closest associate and friend, consequently, Mr. Pereida has a very close relationship with some leaders and some activists and very important ethnic community of Miami, the Black community. As I am sure you are aware, some of these people, many of them, have called your offices and they have called my office in support of Pereida. In addition, I think because the question of Metropolitan Dade County has a warmer relationship, if you will, with a so-called establishment, starting with the Miami Herald, I think that adds an additional dimension, which is beneficial to the City of Miami. Lastly, I might point out that Mr. Pereida comes with a high recommendation of the people he has worked with, some of whom are here. As a matter of fact, I saw Commissioner Valdez walk in a moment ago. I am talking about not all, but some members of the County Commission. Like today, for example, Harvey Ruvin told me that there are few people that he has had the opportunity to work in the County administration that are easier to deal with and he gets quicker answers from than from Sergio Pereida. Lastly, I talked to the County Manager himself, who just came back from Israel. The County Manager told me that he has always looked upon Sergio Pereira as one of the most qualified professionals who he has dealt with and that he looked upon him as having potential and capacity for being County Manager after he retired or after he went _ for something else in the future. Now, I said that Cesar Odin was equally qualified and I want to... I have not voted _ fir him. Let me explain. My lack of support for both is not indicative in any way of my regard for him as a human being and a person. I have known Cesar for 32 years. I was 18 and he was 17 when we first met. He and I have had a close, close relationship for 23 of those 32 years. I was 18 when we were associated together on several occasions in the private sector. For the past five years in the City nf Miami I have had worked with him as I did with Maule Industries for 18 years. He is highly qualified and I'm sure he would make a good City Manager. My vote has been strictly on my perception for what is best for the City of Miami. I cannot vote on friendship; that is a mistake many, many people in the Spanish speaking world, of which I am from. My interest is what is best for the people of the City of Miami. Based on that and only that criteria, based on the premise that Sergio Pereira is a man of fourteen years' experience in government and with a clear record, I have cast my vote in that direction. I might add a little side line, which I think is important because most of the people here are Cubans and Hispanics. There are those continuing, I think erroneously, or, a nationalistic premise of Cubans, good or bad, Cubans. I have rejected that in the past politically and rejected it ever since. I think that is a bad approach to life. I'm not saying that it's not human. I'm not saying it doesn't happen in another communities and I'm not saying people who are Christian or Jews or Irish or Black, whether it be in Chicago or whether it be Irish in Boston, or wherever, favor their own; that's human nature. I understand that. That happens to everybody, not just for Latins. When Pepe Garcia -Pedrosa resigned, there was a commission that came to see me, some of you in this room were in that commission, and you said to me, "Garcia -Pedrosa is Cuban; that is a Cuban post, and we want a Cuban nominee." I said that was George Knox, who is Black and he was City Attorney, and he was the first Black City Attorney of Miami. Howard Gary is Black and he was the first Black City Manager. Under your logic, then, the next City Manager will have to be Black, and the next City Attorney would have had to be Cuban. We cannot government in a community based on that pride of understandable, but erroneous logic. We must vote for those who are the most qualified. And let the chips fall where they may. There sl 11 March 8, 1985 are many who will be upset. There are many who feel that only a Cuban can be City Manager of this town. I reject that. I think we need to vote for what we think is best for our community.
