A RESOLUTION ACCEPTING THE PLAT ENTITLED
"COCONUT GROVE STATION", A SUBDIVISION IN
THE CITY OF MIAMI; AND ACCEPTING THE
DEDICATIONS SHOWN ON SAID PLAT; AND
AUTHORIZING AND DIRECTING THE CITY MANAGER
AND CITY CLERK TO EXECUTE THE PLAT AND
PROVIDING FOR THE RECORDATION OF SAID PLAT
IN THE PUBLIC RECORDS OF DADE COUNTY,
FLORIDA.
WHEREAS, the Department of Public Works recommends the
acceptance of the plat:
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The plat entitled "Coconut Grove Station", is a
resubdivision of all of Lots 1 through 11 inclusive, Block 29
SYLVANMERE, according to the Plat thereof as recorded in Plat Book 419
Page 29 of the Public Records of Dade County, Florida, and S.W. 28th
Lane adjacent to said Block 2, and Lots 1 through 5 inclusive, less
the East 15 feet thereof, and all of Lots 6 through 33 inclusive,
Block 1, COMMERCIAL SILVER BLUFF, according to the Plat thereof as
recorded in Plat Book 14, Page 59 of the Public Records of Dade
County, Florida, and S.W. 28th Lane and S.W. 29th Avenue adjacent to
said Block 1, and S.W. 29th Avenue and a portion of S.W. 28th Lane
adjacent to Block 7, COMMERCIAL SILVER BLUFF SECTION 2, according to
the Plat thereof as recorded in Plat Book 28, Page 20 of the Public
Records of Dade County, Florida, all lying in Section 16, Township 54
South, Range 41 East, City of Miami, Dade County, Florida which
subject plat by reference is made a part hereof as if fully
incorporated herein and which plat, together with the dedications
shown thereon, and the dedications to the perpetual use of the public
of all existing and future planting, trees and shrubbery on said
property, is hereby accepted and confirmed by the City of Miami,
Florida.

Florida. The Plat consists of two tracts containing 5.32 + acres
and is zoned RG-1/3, I-1/7 and CR-3/7.
This plat is being forwarded to your office for City Commission
action.

The accompanying Plat entitled "Coconut Grove Station" was
prepared by The Kaiser Transit Group.
It is in correct form for submission to the City Commission and
is forwarded with a recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a resubdivision of Lots 1 through
11 inclusive, Block 2, SYLVANMERE, according to the Plat
thereof as recorded in Plat Book 41, Page 29 of the
Public Records of Dade County, Florida, and S.W. 28th
Lane adjacent to said Block 2, and Lots 1 through 5
inclusive, less the East 15 feet thereof, and all of Lots
6 through 33 inclusive, Block 1, COMMERCIAL SILVER BLUFF,
according to the Plat thereof as recorded in Plat Book
14, Page 59 of the Public Records of Dade County,
Florida, and S.W. 28th Lane and S.W. 29th Avenue adjacent
to said Block 1, and S.W. 29th Avenue and a portion of
S.W. 28th Lane adjacent to Block 7, COMMERCIAL SILVER
BLUFF SECTION 2, according to the Plat thereof as
recorded in Plat Book 28 , Page 20 of the Public Records
of Dade County, Florida. The Plat consists of two tracts
containing 5.32 + acres and is zoned RG-1/3, I-1/7 and
CR-3/7.

(2) The location of the streets and the widths conform with the
standards of the Department of Public Works of the City of
Miami, Florida.
(3) As certified to by Henry Kingsbury, Registered Land
Surveyor, this Plat complies with the plat filing laws of
the State of Florida.
(4) The City Zoning Board of Miami, Florida, after Public
Hearing, hab recommended the closing of S.W. 28th Lane and
S.W. 29.th Avenue. This action was confirmed by City
Commission Resolution No. 83-864.
(5) The attached Certificate of Title Examination dated January
39 1985, signed by R.A. Cuevas, Jr., Attorney, indicates
that the fee simple title to the property platted is
correctly vested in Metropolitan Dade County and the Plat
has been correctly executed.
(6) The area platted is not encumbered by mortgages.
(7) Since all the required subdivision improvements on this
property have been previously placed and accepted, this Plat
will be forwarded to the City Commission of Miami, Florida.
(8) The location of the property is shown colored in red on the
accompanying copy of a portion of City of Miami, Florida,
Zoning Shaet No. 42.
(9) The attached Resolution has been prepared for the acceptance
of the Plat by the City Commission of Miami, Florida.

said Block 1, COMMERCIAL SILVER BLUFF, as recorded in Plat Book
14 at Page 59, Public Records of Dade County, Florida, title has
previously been vested in the public by the provisions of said
plats.
d. That with regard to those portions of S. W. 28th Lane
and S. W. 29th Avenue adjacent to Block 7, COMMERCIAL SILVER

Records of Dade County, Florida, title has previously been vested
in the public by the provisions of said plat.
Dade County acquired the above -described property as
follows.

through 33 inclusive, Block 1, COMMERCIAL SILVER
BLUFF, according to the plat thereof recorded in Plat Book 14
at Page 59, Public Records of Dade County, Florida, by virtue of
an Order of Taking dated January 7, 1982, and recorded in
Official Records Book 11334 at Page 201, and Certificate of
Payment pursuant to said Order of Taking dated January 25, 1982,
and recorded in O.R.B. 11334 at Page 200, Public Records of Dade
County, Florida, both also filed for record in the eminent domain
case Dade County v. Tiger Enterprises, Inc., et al., Circuit
Court Case No. 81-19559.
2. The West 10 feet of Lot 11 and all Lots 12 and 13,

Warranty Deed from Harry Barkin and Freda K. Barkin, his wife, to

Based and conditioned upon all the assumptions and
statements hereinabove set forth, together with the exceptions
listed on said commitments, and upon the premises that no liens
or judgments have been filed against the property subsequent to
Dade County's obtaining title, I am of the opinion that, subject
to any conditions, restrictions, covenants, easements,
reservations, limitations and liens of record or zoning

regulations, Dade County has good and marketable fee simple title
to the "property" less Parcel Nos. 7S240.24 and 7S240.23 as
described in Exhibits A and B attached hereto.
Parcel Nos. 7S240.23 and 7S240.24 comprise respectively the
westerly half of S. W. 29th Avenue to be closed, and a portion of
S. W. 28th Lane to relocated by replat of the Coconut Grove
Metrorail Station site. The County has entered into an agreement
with the owners of the property abutting the westerly edge of the
portion of S. W. 29th Avenue to be closed to quitclaim said
interest in S. W. 29th Avenue in exchange for the County
quitclaiming to them a portion of the right of way of S. W. 28th
Lane that will be rerouted. The form of agreement was approved
by Resolution No. R-324-84, adopted March 20, 1984, by the Board
of County Commissioners of Dade County. Said agreement
specifically provides for 'the owner and tenant of the land
abutting S. W. 29th Avenue to file written consents to the replat
of the station site.
