CORPORATION AT A TOTAL COST OF $65,800.40 FOR ALLAPATTAH MINI PARK - DEVELOPMENT A COMMUNITY DEVELOPMENT PROJECT; ASSESSING $2,000.00 AS LIQUIDATED DAMAGES FOR 10 DAYS OVERRUN OF CONTRACT TIME; AND AUTHORIZING A FINAL PAYMENT OF $5,203904 WHEREAS, there exists a contract dated June 6, 1983 between the City of Miami and P.N.M Corporation; and WHEREAS, the work consisting of improvements to Allapattah Mini Park - Development a Community Development Project located at N.W. 19 Terrace and N.W. 21 Avenue, has been satisfactorily completed, and P.N.M. Corporation, has furnished the required documents certifying that all bills for labor and materials have been paid in full in connection with the aforesaid contract; and WHEREAS, liquidated damages for overrun of contract time of 10 days should be deducted from the final payment due the contractor; and WHEREAS, the City Manager and the Department of Public Works recommend that the completed work be accepted and final payment be made to the contractor; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The completed work performed by P.N.M. Corporation, for ALLAPATTAH MINI PARK - DEVELOPMENT a Community Development Project, at a total cost of $65,800.40 is hereby approved. Corporation, at a total cost of $65,800.40; assessing $2,000.00 as liquidated damages for overrun of contract time; and authorizing a final payment of $5,201.04 for ALLAPATTAH MINI PARK - DEVELOPMENT a Community Development Project. P.N.M. Corporation has completed the project consisting of constructing a new park, including a paved plaza, game tables, benches, a drinking fountain, basketball court with lighting, playground with equipment, fencing, irrigation, and landscaping in an area bounded by N.J. 19 Terrace and N.W. 21 Avenue. During construction of the project, the contractor failed to properly coordinate and organize his work forces so as to complete the project within the specified contract time. In addition, the contractor did not work every day that he could have to complete the project within the prescribed contract time. Therefore, there is an overrun to the contract time of 10 calendar days. The contract documents provide for the assessment of liquidated damages in an amount of $200 per calendar day for each day over the contract time. This was a unit price contract in the amount of $67,800.40 less $2,000.00 as liquidated damages for 10 days overrun of contract.
