A RESOLUTION APPROVING A TWO YEAR
EXTENSION OF EMPLOYMENT PAST THE AGE OF
74 FOR OSCAR T. DIAZ, PROPERTY SPECIALIST
it DEPARTMENT OF POLICE, EFFECTIVE
FEBRUARY 1, 1985 THROUGH JANUARY 31,
1987, WITH THE PROVISION THAT IN THE
EVENT OF A ROLLBACK OR LAYOFF, OSCAR T.
DIAZ' PHYSICAL CONDITION SHALL BE
RE-EVALUATED TO DETERMINE IF HIS
CONDITION IS SATISFACTORY FOR CONTINUED
EMPLOYMENT.
WHEREAS, the Civil Service Board, on February 12, 1985,
unanimously recommended the approval of employment past the
age of 74 for Oscar T. Diaz, Property Specialist I,
Department of Police; and
WHEREAS, the City Physician has determined that the
physical condition of said Oscar T. Diaz is satisfactory for
continued employment;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. A two year extension of employment past
the age of 74 is hereby granted for Oscar T. Diaz, Property
Specialist I, Department of Police, effective February 1,
1985, through January 31, 1987, with the provision that in
the event of a rollback or layoff, Oscar T. Diaz' physical
condition shall be re-evaluated to determine if his condition
is satisfactory for continued employment.
PASSED AND ADOPTED this 21 day of March , 1985.

Because of recent developments in the law concerning age
discrimination, we have not incorporated the expression of past
policy in the attached approved resolution which indicated that
the subject employee, rather than a junior employee, would be
affected in the event of a rollback or layoff. Instead, we have
incorporated a procedure that should such contingency occur
(rollback or layoff), the employee's physical condition would
then be re-evaluated to determine continued fitness for
employment.

The Civil Service Board, at its meeting of February 12, 1985 approved a two (2) year
extension of employment past the age of seventy-four (74) for Oscar T. Diaz, Pro-
perty Specialist I, Department of Police.
It is respectfully requested that a Resolution be adopted extending Mr. Diaz'
employment from February 1, 1985 to January 31, 1987.

Attached please find a memorandum from Dr. J.A. Milera confirming
the continued qualification for employment of Property Specialist
I Oscar T. Diaz. Mr. Diaz has requested to continue his
employment with this Department beyond the age of seventy (70),
and his request has been endorsed by this Department as well as
the City Physician.
This memorandum is submitted to request approval from the Civil
Service Board to continue the employment of Property Specialist I
Oscar T. Diaz. Mr. Diaz was seventy-four (74) years old on
February 1, 1985, and this approval would continue his employment
through February 1, 1986.
As always your assistance in bringing this matter before the
Board shall be greatly appreciated. Please contact Lt. Steve
Baldwin in our Personnel Unit, extension 6413, should you require
any additional information.

At its meeting of February 12, 1985, the Civil Service Board considered the request
of Oscar T. Diaz, Property Specialist I, in the Department of Police, for an ex-
tension of employment past the age of seventy four (74) for a period of two (2)
years,to be effective February 1, 1985 to January 31, 1987.
The Board noted that Clarence Dickson, Director, Department of Police, had recom-
mended approval of the request and that Dr. J.A. Milera, City Physician, had found
Mr. Diaz physically qualified to continue employment for the additional two (2) years.
The Board voted to approve the request, with the provision that in the event of a
rollback or layoff, Mr. Diaz rather than a junior employee, would be affected,
noting that this is in accordance with past policy.
