A RESOLUTION ALLOCATING FUNDS IN AN AMOUNT NOT TO EXCEED TWENTY-FIVE THOUSAND DOLLARS ($259000.00) FROM THE CITY OF MIAMI LAW ENFORCEMENT TRUST FUND TO COVER NECESSARY WAGES AND EMPLOYEE BENEFIT EXPENSES ASSOCIATED WITH THE EMPLOYMENT OF A CLERICAL SUPPORT PERSON TO BE ASSIGNED TO THE POLICE DEPARTMENT LEGAL UNIT; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE HUMAN RESOURCES DEPARTMENT TO EMPLOY SUCH PERSON. WHEREAS, the Miami Police Legal Unit serves a necessary function within the Police Department; and WHEREAS, the Miami Police Legal Unit is charged with providing legal advice, opinions and general counsel to the members of the Police Department; and WHEREAS, the Miami Police Legal Unit is charged with conducting legal proceedings and litigation under the Florida Contraband Forfeiture Act; and WHEREAS, the Miami Police Legal Unit, pursuant to legal proceedings and litigation, has had in excess of $ 2,522,000.00 awarded to the City of Miami for deposit in the City of Miami Law Enforcement Trust Fund; and WHEREAS, monies from the City of Miami Law Enforcement Trust Fund have been utilized to purchase such necessary law enforcement items as the Simulated Media Environment Training Unit (Stress Simulator) and the Remote Moble Investigator (Bomb Deactivation Robot); and WHEREAS, the increasing volume of forfeiture litigation actions requires that a clerical support person be assigned to the Police Legal Unit to prepare, type, and file correspondence, documents and legal pleadings associated with forfeiture proceedings; and WHEREAS, this clerical support person would be assigned to the Miami Police Legal Unit to assist the Police Legal Advisors in the expeditious processing of forfeiture proceedings; and WHEREAS, the current assignment of only one clerical support person does not allow the Miami Police Legal Unit to adequately and efficiently carry out its goals and objectives; and WHEREAS, funds to cover the necessary expenses of a second clerical i CITY COMMISSION MEETING OF MAR gg .i3vi hull (Vo. re Akjj� I W* support person have not been included in the Police T)epartment's normal operating budget for fiscal year 1984-85; and WHEREAS, funds to cover these expenses are available in the City of Miami Law Enforcement Trust Fund; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Funding in an amount not to exceed twenty-five thousand dollars ($25,000.00) is hereby allocated from the City of Miami Law Enforcement Trust Fund to cover necessary wages and employee benefit expenses associated with the employment of a clerical support person to be assigned to the Police Department Legal Unit. Section 2. The City Manager is hereby authorized to instruct the Human Resources Department to employ such person. PASSED AND ADOPTED this 21 day of March ,. 1985. Maurice A.
