FLORIDA IN'TERC7FFICE MEMORANDUM • ENCLOSURES: 0ATE: March 5, 1985 SUBJECT: Simulated Bullfighting or Novilladas at the Orange Bowl Stadium REFERENCES: Law Department memo and copy of Proposed Legislation The Office of Stadiums met with Mr. Joe Barredo concerning bloodless bullfighting or " novilladas" which is now being held in certain parts of Spain. Mr. Barredo is a promoter who wants to present bloodless bullfighting events in the Orange Bowi. According to Mr. Barredo, this is a new concept of bullfighting which is widely used and accepted in Soain, Portugal and southern France. It could be implemented in the Orange Bowi during the months of January to June. The playin field at the Bowl could be protected by the use of geotextile" material which would be removed at the conclusion of each event. The cost of this material, thirty thousand dollars ($30,000 , should be paid for by Mr. Barredo. If Mr. Barredo desires to stage a number of these events, it may become necessary to completely resod the playing field. The cost of resodding, one` — Hundred twenty thousand dollars ($120,000), should be covered by a cash bond or appropriate surety. Mr. Barredo is requesting the City Commission at their March 21st Commission meeting to endorse his proposal for the purpose of introducing a bloodless bullfight bill in the upcoming session of the Florida Legislature. There would be no legal limitation upon holding a simulated or bloodless bullfight exhibition in the City of Miami if the proposed legislation is enacted. A RESOLUTION EXPRESSING SUPPORT FOR AND URGING ADOPTION OF THE ATTACHED PROPOSED LEGISLATION WHICH BROADENS THE STATE LEGIS- LATION THAI PRESENTLY ALLOWS SIMULATED ANIMAL FIGHTS WHEN THE SAME ARE CONDUCTED FOR THE PURPOSE OF, OR AS PART OF, A MOTION PICTURE OR TELEVISION BY PERMITTING A SIMULATED OR BLOODLESS BULLFIGHT EXHIBITION IN FRONT OF A LIVE AUDIENCE WHEN SAID EXHIBITION I5 SANCTIONED AND APPROVED BY A COUNTY OR MUNICIPALITY. BE IT RSOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Adoption by the Florida Legislature of the proposed attached legislation which broadens the state legis- lation that presently allows simulated animal fights when the same are conducted for the purpose of, or es part of, a motion picture or television by permitting a simulated or bloodless bullfight exhibition in front of a live audience is hereby strongly urged and the City Commission hereby expresse3 full support for said legislation. A bill to be entitled An act relating to simulated bullfighting exhibitions; amending s. 829.121, Florida Statutes to allow simulat- ed bullfighting exhibitions under certain conditions upon approval of the county or municipal government having jurisdiction; amending s. 828.122 (6) (a) , Florida Statutes; providing an effective date. Be it Enacted by the legislature of the State of Florida: Section 1. Section 828.121, Florida Statutes, is amended to read : / "828.121 Conduct of simulated bullfighting exhibitions. It shall be unlawful, and punishable as a misdemeanor, for any person to conduct or engage in a simulated or bloodless bullfighting exhibition, except as provided A county or nun cipality may allow simulated or bloodless bullfighting exhibitions in an enclosed arena or stadium to be conducted within its jurisdiction provided that: (1) No bull that is to be used in said exhibition shall be subjected to more than 20 minutes of fighting in the State of Florida during the lifetime of the animal. (2) During the course of the exhibition no physical con- tact may ace to the bull through the use of any device or means designed to inflict injury; and the bull shall only bx exposed to contact with a cape or capes in the hands of the matador or his assistants during the course of the 1/COOING: Words in streek thredgh type are deletions from existing law; words underlined are additions. 1 exhibition. 2 (3) The bull shall be protected from all physical harm 3 during said exhibition." 4 5 Section 2. Paragraph (a) of subsection (6) of section 6 828.122, Florida Statutes, is amended to read: 7 "(6) The provisions of subsection (3) and paragraph (4) 8 (b) shall not apply to: 9 (a) Any Person simulating a fight for the purpose of using 10 the simulated fight as part of a motion picture which will 11 be used on television or in a motion picture, or any person 12 conducting a simulated or bloodless bullfighting exhibition 13 under the provisions of s. 828.121; provided s. 828.12 is 14 not violated ". 15 Section 4. Fighting" exibition under certain characteristics explained in the draft. Since I have received a petition in that respect. I would like to obtain a report on the legal limitations or possibilities in order to consider holding this event in the City of Miami. I would like to obtain your recommendation, and if possible, a resolution be drafted to be presented to the Commission expressing their support of the celebration of this type of simulated event.
