A RESOLUTION ACCEPTING THE PLAT ENTITLED
"DOWNTOWN GOVERNMENT CENTER FIRST ADDITION",
A SUBDIVISION IN THE CITY OF MIAMI; AND
ACCEPTING THE DEDICATIONS SHOWN ON SAID
PLAT; AND AUTHORIZING AND DIRECTING THE CITY
MANAGER AND CITY CLERK TO EXECUTE THE PLAT
AND PROVIDING FOR THE RECORDATION OF SAID
PLAT IN THE PUBLIC RECORDS OF DADE COUNTY,
FLORIDA.
WHEREAS, the Department of Public Works recommends the
acceptance of the plat:

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
_`. OF MIAMI, FLORIDA:
Section 1. The plat entitled "Downtown Government Center
First Addition", is a resubdivision of all of Block 114 North, and
that 50 foot wide thoroughfare designated Avenue F (now known as N.W.
first Avenue West) lying between the South right of way boundary

extended of eleventh Street (now known as N.W. First Street) and the
North right of way line extended of twelfth Street (now known as West
P;A, Flagler Street), and that part of the one -hundred (100) foot wide
right of way of the Florida East Coast Railway Company, lying between
the North right of way boundary extended of eleventh Street (now known
as N.W. first Street) and the South right of way boundary extended of
twelfth Street (now known as West Flagler Street). All of the
foregoing in A.L. Knowlton's Map of Miami, Dade County, Florida,
according to the plat thereof recorded in Plat Book "B" at Page 41 of
the Public Records of Dade County, Florida, all lying in Section 37,
Township 54 South, Range 41 East, City of Miami, Dade County, Florida
j which subject plat by reference is made a part hereof as if fully
incorporated herein and which plat, together with the dedications
shown thereon, and the dedications to the perpetual use of the public
of all existing and future planting, trees and shrubbery on said
property, is hereby accepted and confirmed by the City of Miami,
Florida.

recommends the approval of the plat by
the City Commission of Miami, Florida,
and certifies its correctness as to
form.
The proposed record plat entitled "Downtown Government Center
First Addition" is a resubdivision of all of Block 114 North, and
that 50 foot wide thoroughfare designated Avenue F (now known as
N.W. first Avenue West) lying between the South right of way
boundary extended of eleventh Street (now known as N.W. First
Street) and the North right of way line extended of twelfth Street
(now known as West Flagler Street), and that part of the one -
hundred (100) foot wide right of way of the Florida East Coast
Railway Company, lying between the North right of way boundary
extended of eleventh Street (now known as N.W. first Street) and
the South right of way boundary extended of twelfth Street (now
known as West Flagler Street). All of the foregoing in A.L.
Knowlton's Map of Miami, Dade County, Florida, according to the
plat thereof recorded in Plat Book "B" at Page 41 of the Public
Records of Dade County, Florida, all lying in Section 37, Township
54 South, Range 41 East. The Plat consists of one tract
containing 4.3 + acres. It is zoned GU.
This plat is being forwarded to your office for City Commission
action.
Also attached are the following itemized papers necessary to
present the Plat to the City Commission of Miami:

(2) Print of proposed Record Plat
(3) Agreement form pertaining to subdivision
improvements
(4) Opinion of Title

The accompanying Plat entitled "Downtown Government Center
First Addition" was prepared by Biscayne Engineering.
It is in correct form for submission to the City Commission and
is forwarded with a recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a resubdivision of all of B1ocK
114 North, and that 50 foot wide thoroughfare designated
Avenue F (now known as' N.W. first Avenue West) lying
between the South right of way boundary extended of
eleventh Street (now known as N.W. First Street) and the
North right of way line extended of twelfth Street (now
known as West Flagler Street), and that part of the one -
hundred (100) foot wide right of way of the Florida East
Coast Railway Company, lying between the North right of
way boundary extended of eleventh Street (now known as
N.W. first Street) and the South right of way boundary
extended of twelfth Street (now known as West Flagler

(2) The location of the streets and the widths conform with the
standards of the Department of Public Works of the City of
Miami, Florida.
(3) As certified to by Alfred B. Mohr, Registered Land Surveyor,
this Plat complies with the plat filing laws of the State of
Florida.
(4) The City Zoning Board of Miami, Florida, after Public
Hearing, has recommended the closing of N.W. 1 Avenue West
lying South of the South right-of-way line of N.W. 1 Street
North of the North right-of-way line of West Flagler Street.
This action was confirmed by City Commission Resolution No.
83-867.
(5) The attached Certificate of Title Examination dated
January 169 1985, signed by Murray A. Greenberg, Attorney,
indicates that the fee simple title to the property platted
is correctly vested in Metropolitan Dade County and the Plat
has been correctly executed.
(6) The area platted is not encumbered by mortgages.
(7) The Owner at its own expense has substantially completed
that portion of the improvements necessary for the City
Building Department to issue the final Certificate of
Occupancy for the building or buildings located on the
property platted. The completion of the improvements as set
forth herein will not be required prior to the acceptance of
the plat by the City Commission. Upon approval of the plat
by the City Commission the Owner will proceed to design and
construct, at its own expense and in accordance with
applicable standards of the City and/or State, the remainder
of the work to complete the north half of (W) Flagler Street
between N.W. 1 Avenue and N.W. 2 Avenue, east half of N.W. 2
Avenue between (W) Flagler Street and N.W. 1 Street, south
half of N. W. 1 Street between N. W. 1 Avenue and N.W. 2

AGREEMENT FOR CONSTRUCTION OF CERTAIN IMPROVEMENTS
DOWNTOWN GOVERNMENT CENTER FIRST ADDITION
N.W - 2 AVENUE TO N.W. 1 AVENUE (E) AND (W)
FLAGLER STREET TO N.W. 1 STREET
WHEREAS, DADE COUNTY, a political subdivision of the State of
Florida (hereinafter referred to as the "Owner"), concurrently with the delivery
of this Agreement, has applied to THE CITY OF MIAMI, FLORIDA (hereinafter
referred to as the "City"), for the acceptance and confirmation by the Commission
of said City, of a certain proposed plat of a subdivision to be known as "DOWNTOW N
GOVERNMENT CENTER FIRST ADDITION", located on N.W. 2 Avenue to N.W.
1 Avenue (E) and (W) Flagler Street to N.W. I Street, a copy of which proposed
plat is attached hereto and made a part hereof as Exhibit "A".
WHEREAS, the Owner at its own expense has substantially completed
that portion of the aforesaid improvements necessary for the City Building Depart-
ment to issue the final Certificate of Occupancy for the building or buildings located
on the property platted; and,
WHEREAS, this Agreement when executed will testify to the Owner's
intention to plat and complete the required improvements as set forth herein;
and
WHEREAS, the completion of the improvements as set forth herein
will not be required prior to the acceptance of the plat by the City Commission.
NOW, THEREFORE, the Owner hereby covenants and agrees with the
City as follows;
1. Upon approval of the plat by the City Commission the Owner
will proceed to design and construct, at its own expense and in accordance with
applicable standards of the City and/or State, the remainder of the work to complete
the north half of (W) Flagler Street between N.W. 1 Avenue and N.W. 2 Avenue,
east half of N.W. 2 Avenue between (W) Flagler Street and N.W. 1 Street, south
half of N.W. 1 Street between N.W. 1 Avenue and N.W. 2 Avenue, and west half
of N.W. 1 Avenue between 00 Flagler Street and N.W. 1 Street.
The said street improvements will include only such sidewalk, curb
and gutter, roadway pavements, drainage, lighting, and related adjustment or relocation
of utilities as may occur within the above described portions of existing dedicated
public street right of way.

2. After the work is started the Owner hereby agrees to prosecute
said work progressively, so as to complete it in a reasonable length of time and
submit to the City Department of Public Works a letter from a Registered Land
Surveyor certifying that the Permanent Reference Monuments indicated on the
plat have been installed and properly placed.
IN WITNESS WHEREOF, the Owner has authorized this Agreement

opinion of title pertaining to the following described real

provision, I hereby certify that I am an attorney authorized to

This opinion is conditioned and based upon, and assumes as
true, complete and correct, the following:
a. The title search of the Title Analysis Section of the
Dade County Public Works Department, based upon a search from the
beginning of time to and including December 9, 1983, and the
conclusion of said department that there is a continuous and
unbroken chain of title on the subject property into Metropolitan
Dade County, Florida.

b. That there have been no encumbrances or liens, by
judgment or otherwise, recorded against the subject property
subsequent to the vesting of title in Dade County.
C. The information contained in the memorandum of
Mr. B. P. Nuckols, Chief of the Right of Way Division of Dade
County Public Works Department, explaining the slight discrepancy
in the legal description of the property acquired from Florida
East Coast Railway Company pursuant to Special Warranty Deed
dated December 18, 1979, and recorded in Official Records Book
10606, at Page 1431, Public Records of Dade County, Florida, and
the legal description prepared by Biscayne Engineering Company,
Inc. as the result of its recent survey for the platting of the
subject property. A copy of said memorandum, dated March 19,
1984, is attached.
d. That with regard to that portion of N. W. first Avenue
,. West (Avenue F) sought to be closed, as described, ,in the
tentative plat of Downtown Government Center -First Addition,
contained within the Plat of A. L. Knowlton's ASAP OF MIAMI,
recorded in Plat Book B, Page 41, Public Records of Dade County,
Florida, fee simple title has previously been vested in Dade
County by the provisions of said plat.'
Based and conditioned upon the assumption that all
statements hereinabove set forth are correct, I am of the opinion
that, subject to any conditions, restrictions, covenants,
easements, reservations, limitations and liens of record or
zoning regulations, Dade County has -good and marketable fee
simple title to the property described herein.

As expressed In our memo of December 30, 1983 requesting an Opinion of Title for
the proposed plat of DOWNTOWN GOVERNMENT CENTER FIRST ADDITION, we feel that
although the legal' description on the proposed plat differs slightly from the
legal by which the properties were acquired by O.T.A., the legal description on
the proposed plat more accurately describes the properties acquired by O.T.A. as
they exist today and are in effect one and the same.
The difference appears to have been created when a more accurate recent survey
r for the plat was prepared. The survey revealed an angle break (point at which a
particular line changes direction or bearing) in the City of Miami Monument
Lines for both West Flagler Street and N. W. 1st Street. The angle break In* the
monument lines created an angle break In the right of way lines for both West
Flagler Street and N. W. 1st Street, since the right of way lines are generally
established parallel to the center line of right of way or in this case the
monument lines.
Comparing the legal descriptions of the parcels acquired by O.T.A. (parcels
1S 000.35A, 7S 000.36, 7S 000.36A) with the plat legal, we see that the O.T.A.
parcels Indicate the right of way lines for both West Flagler Street and N. W.
1st Street to be straight lines (easterly prolongation) and the plat legal calls
for the angle break. Because the plat itself indicates the .right of way lines
for both West Flagler Street and N. W. 1st Street to be straight and because
O.T.A. described the parcels "according to the plat thereof . . ." It is our
opinion that O.T.A. acquired all of the property lying between the North line of
N. W. 1st Street and the South line of West Flagler Street and between the East
line of N. W. 1st Avenue West and the West line of N. W. 1st Avenue East no
matter where they are physically located today.
Enclosed is a copy of the tentative plat with
and excerpts from the FEC deed for the parcels
114 N. was acquired by Eminent Domain.
