ALL OF THE FOREGOING SUBJECT TO any dedications, limitations, restrictions, reservations or easements of record. and after due consideration of the reconnendations of the Planning Advisory Board takes the following action: Authorization to Issue a Major Use Special Permit subject to the following modifications: FINDING OF FACT WITH MODIFICATIONS Development The development proposed 564,350 square feet of floor area for Phases II and II, comprised of the following elements as specified by the applicant in the Major Use Permit Development Impact Study. Phase I met the requirements of Zoning._. Ordinance 6871 which was in force at the time the building permit was 'issued; Phase I has been completed. The project is further limited by applicable provisions and procedures of City of Miami Zoning Ordinance 9500, as follows: The Schedule of District Regulations, Sheet 5 of 6, General Commercial y Zoning District Zoning Ordinance 9500; the Miami Large Scale Development Committee meeting of October 5, 1984, approving the project per conceptual plan and design schematics on file, dated 5/14/84, with further revisions dated 7/2/84, and 11/7/84, with the following parameters for the site under development, bounded by LeJeune Road, NW 7th Street and HVI 43rd Avenue. Phase II - 7-level parking garage containing approximately 1,122 spaces (approximately 65 feet - maximum height). a drive-in bank facility a 6-story building containing offices and shops (approximately 70 feet maximum height). " Phase III - 6-story building containing offices, shops, a restaurant, and movie theaters (approxi-mately -70 . feet maximum height) . - 4 loading berths. The total project will include 144,483 square feet of open space (14.1,748 required), which includes 92,797 square feet of uncovered open space, 13,685 square feet of covered open space, and 38,000 square feet of improved roof area. Pedestrian open space will total 52,638 square feet (20,964 required). This exhibit constitutes the conditions for a Major Use Special Permit per Article 28 of Zoning Ordinance 9500, and is applicable to the entire project. THE APPLICA14T SHALL: 1. Use only native and other non-invasive species adapted to South Florida climatic conditions in project landscaping. 2. Implement best management practices to minimize air pollution to include: • Provision of mass transit information, such as bus and metrorail schedules and routes, to project tenants and in project common areas; • Provision of at least two percent of all parking spaces for car or van pool parking; Establishment and operation of a van or car pool program in order to encourage ride sharing and make information readily available; Provision of bicycle storage areas in the parking area. Incorporate the following energy conservation measures into the development: Individually metered tenant -controlled air conditioning. Air distribution using a variable air volume system. Maximum use of task lighting in work areas. Centralized energy control system that will provide start/stop optimization, time of day scheduling, electrical demand limiting, night temperature setback/setup, programmed maintenance, and building lighting control. Non -electrical energy will be used in the project restaurant for heating and cooking, except for microwave use. 4. Collaborate with the City to incorporate security measures and systems into the design and operation of the project; security systems and construction documents to be reviewed by the Miami Police Department (at their option). The applicant shall report within ninety (90) days of the issuance of this Major Use Special Permit hoer and to what extent security systems and measures have been incorporated. 5. Obtain all necessary permits fron Dade County Water and Sewer Authority Department provision of water and wastewater services to serve the project. 5. In the event any potential significant historic or archeological artifacts are uncovered, notify State and local historic preservation officials and delay construction for up to 3 months, if requested, for survey and excavation of the discovery. 7. Work with the City to prepare a Minority Participation and Employment Plan to be submitted within ninety (90) days of the issuance of this Major Use Special Permit. 8. Work with the City to develop a Minority Contractors/Subcontractors Participation Plan to be submitted within ninety (90) days of the issuance of this Major Use Special Permit. 9. The applicant shall comply with Federal Aviation Authority regulations and Dade County Miami International Airport Regulations, as detailed in the Dade County Code, Chapter 33, Article 37, covering applicant site as listed in Section 33-333 (9). 10. During construction, the applicant shall maintain existing parking spaces for the use of present tenants, or provide alternative spaces, in conformance with zoning regulations. Collaborate with the Applicant to ensure the incorporation of security measures and systems into the design and operation of the project. 12. Assist the Applicant in complying with Federal Aviation Authority and Dade County regulations in regard to development proposed within areas controlled by Dade County Code Section 33-333 (9). General 13. The Applicant shall submit a report, twelve (12) months from the date of issuance of this Major Use Special Permit and each twelve (12) months thereafter until a final Certificate of Occupancy is issued to the Planning Director, City of Miami Planning Department. This report shall contain, for the preceding twelve (12) months. A general description of construction progress in terms of construction dollars and employment. A cumulative list of all permits or approvals applied for, approved or denied. A statement as to whether any proposed project construction changes in the ensuing twelve (12) months are expected to deviate substantially from the approvals included in this Major Use Special Permit. The Planning Director, City of Miami Plarni ng Department, or a project director to be named later, is hereby designated to receive this report, and to monitor and assure compliance with this Major Use Special Permit. 14. The Applicant shall consolidate all original and supplemental information submitted to the City into a revised Application for Major Use Special Permit and submit four copies of the document to the Planning Director, City of Miami Planning Department, within ninety (90) days of the effective date of the LeJeune Centre Major Use Special Permit. CONCLUSIONS OF LAW The LeJeune Centre Project, proposed by Epic One Corporation, complies with the Miami Comprehensive Neighborhood Plan, --is consistent with the orderly development and goals of the City of Miami, and complies with local land development regulations being Zoning Ordinance No. 9500; and The proposed development does not unreasonably interfere with the achievement of the objectives of the adopted State Land Development Plan applicable to the City of Miami. Per Zoning Ordinance 9500, Article 28 Major Use Special Permits - Article 28, review of the Final Application and consideration of granting of a Major Use Special Permit; and further recommending that the City Commission consider the granting of a Major Use Special Permit. REQUEST To review the Final Application for Major Use Special Permit and recommend that the applicant be granted a Major Use Special Permit. BACKGROUND This development was first approved in 1982, and construction was begun on Phase One, a bank building, under Zoning district C-2, in accordance with Zoning Ordinance #6871. In a subsequent public hearing before the Zoning Board on September 23, 1982, Resolution #82 -875 approved a conditional Use for a Drive -In Bank Teller facility as per site plan on file. In June of 1983, Ordinance 9500 was adopted applying zoning District CG-1/7 to the site. Phase I, a bank building of approximately 125,400 SF has been completed. Under the new Zoning Ordinance #9500, the development is now subject to Planning Department review under the Major Use Special Permit process for the second and third phases. PAB 1/2/ Item #7 ps Zoning Ordinance 9500 establishes a Major Use Special Permit process (Article 28) whereby defined major uses require recormendation by the Planning Advisory Board and consideration and authorization by the City Commission (both preliminary and final) before coristruction can be undertaken. LeJeune Road REFERENCES: -NC_c S'.1S5: The Epic One Corporation has proposed a project to be located at 780 N.W. LeJeune Road. T The Project includes: - Offices and banking facilities of approximately 295,890 square --feet, which includes an existing bank and office structures of 125,400 square feet. -- shops and lobbies on the first floor of 22,860 square feet -- a theater of 9,600 square feet -- a restaurant of 6,600 square feet -- a drive-in banking facility of 350 square feet -- a garage of 355,400 square feet. Analysi s Employment During the period of construction, it is estimated that 250 construction workers and craftsman will be employed at prevailing area wages. When completed the over-all development will provide approximately 1,015 full time and 60 part-time jobs. Offices will employ 885 full-time and 21 part-time employees. Retail shops will employ 60 full-time and 20 part-time employees. A theater will employ 23 full-time and seven -part-time employees. A restaurant will employ 38 full-time and 12 part-time employees. The overall development will also require 9 full-time employees for general service and maintenance. The anticipated wages for the entire projected work force is estimated at $22,802,306. Emissions from other on -site sources will be minimal. The development contributes minor amounts of Ozone (03), as a result of sunlight action on reactive hydrocarbons and nitrogen oxides. The Carbon Monoxide emission levels from development traffic will be well within the limits of CO concentrations set by the U.S. Environmental Protection Agency. No impacts to existing water bodies are anticipated at completion of the project. The natural topography and existing drainage systems will rove surface runoff from 'the project northward to an outfall at the Comfort Canal. In addition, exfiltration trenches will substantially reduce stormwater runoff and its associated pollutants. The proposed drainage plan will provide better recharge to the aquifer, and reduce the amount of salt water intrusion. Sewage and :Dater The development is expected to generate a total of 66,823 gallons of sewage per day at buildout. The existing bank is connected to an eight inch sanitary main on N.W. 43 Avenue, and no additional connections will be required. The final development will receive all of its water supply from the ' Mi ami -Dade Water S Sewer Authority and will require approximately 66,823 Gallons per day. The developer has a written commitment from WASA, dated earth P, 1984. Access and Circulation The opportunity exists for some of the bank trips to be satisfied y employees from offices in the development, and by walking reduce vehicle movement. This on -foot traffic should reduce the vehicular volume to the bank by about 5 per cent of the total bank traffic. Based on recognized traffic projection methods, there will be an estimated P.M.* peak hour (4-5 P.M.) traffic volume of 330 inbound trips and 817 outbound trips: Also, based on the same criteria and standards set by the South Florida Regional Planning Council, the development will not impact the transportation network at an unacceptable level. Also, the existing four lane section on LeJeune Road is to be widened to a six -lane divided section from N.W. 36 Street to N.W. 54 Street, with preliminary engineering scheduled for 1985-86. A new connector from the Miami International Airport to N.W. 36 Street is also scheduled for construction during the 1985-86 period. Land Use The project is consistent with the Miami Comprehensive Neighborhood Plan an with the CG-1/7 General Commercial Zoning District, Ordinance 9500. Findings The development will have a favorable impact upon the economy with the propro ected creation of over 1,000 new jobs. The demand for accessible housing for employees of this development can be met by the increasing amount of housing being constructed to the west of this developnent both in the City of Miami and in Dade County, particularly multi- family dwelling units. The development is advantageously located to take advantage of the major utility lines, major roads, and the airport. The development has been determined not to have any negative impact on the environment or natural resources of the r i ty. Living conditions in the neighborhood of the proposed development will not be adversely affected. Police services and public safety are sufficient for the proposed development and the surrounding area. _Based on department analysis of the various benefits, and the various impacts upon services and the environment, it has been determined that the public welfare will be served by the proposed development.
