HomeMy WebLinkAboutPre-LegislationCity of Miami Resolution R-19-0516 alldl 11 li.Rl I + Legislation File Number: 6879 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 12/12/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE ESTABLISHMENT OF A PERMANENT SENIOR RENTAL ASSISTANCE PROGRAM, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED, TO ASSIST ELIGIBLE LOW INCOME CITY OF MIAMI ("CITY") SENIOR RESIDENTS IN MITIGATING RENT INCREASES; ALLOCATING AND APPROPRIATING THE FUNDS GENERATED EACH YEAR, SUBJECT TO THE AVAILABILITY OF FUNDING AT THE TIME OF NEED, FROM THE APPLICABLE HISTORIC PRESERVATION SCHEDULE OF FEES PAID INTO THE PUBLIC BENEFITS TRUST FUND, IN ORDER TO FUND THE SENIOR RENTAL ASSISTANCE PROGRAM, IN FURTHERANCE OF THE SENIOR RENTAL ASSISTANCE PROGRAM; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE(S), IN COMPLIANCE WITH ALL APPLICABLE FEDERAL, STATE OF FLORIDA, AND LOCAL LAWS. SPONSOR(S): Commissioner Manolo Reyes, Mayor Francis X. Suarez WHEREAS, pursuant to Resolution No. 19-0488, adopted on November 21, 2019, the City Commission approved the creation of the Senior Rental Assistance Pilot Program ("Pilot Program") and allocated one million dollars ($1,000,000.00) from the general fund in order to fund the Pilot Program; and WHEREAS, the goal of the Pilot Program is to alleviate the burden caused by rent increases for the City of Miami's ("City") senior residents who are on a fixed income; and WHEREAS, it is the will of the City Commission to make the Pilot Program permanent in nature ("Senior Rental Assistance Program") and to fund the Senior Rental Assistance Program using the funds generated and allocated from the Historic Preservation Schedule of Fees attributable to transfers of development rights and density paid into the Public Benefits Trust Fund, with a priority of five (5%) of such funds to be expended for the City's Senior Rental Assistance Program; and WHEREAS, there is an explicit authorization to allocate funds to the Senior Rental Assistance Program in section 62-32(o) in the Code of the City of Miami Florida, as amended ("City Code"); and WHEREAS, funding for the Senior Rental Assistance Program, as detailed in this resolution, may be revised by the City Commission from time to time, as is practicable and warranted; and City of Miami Page 1 of 2 File ID: 6879 (Revision:) Printed On: 411712023 File ID: 6879 Enactment Number: R-19-0516 WHEREAS, the City desires to make the Pilot Program a permanent Program, thereby creating the permanent Senior Rental Assistance Program, and this Resolution authorizes its establishment of this as a permanent Program utilizing the funds generated and budgeted each year from the Historic Preservation Schedules of Fees attributable to certain transfers of development rights and density paid into the Public Benefits Trust Fund in order to fund the Senior Rental Assistance Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Senior Rental Assistance Program, as more particularly described in Exhibit "A," attached and incorporated, which assists eligible low-income City senior residents in mitigating rent increases, is approved as a permanent Program. Section 3. The funding will be allocated and appropriated from the applicable section of the Historic Preservation Fees, subject to the availability of funding at the time of need, utilizing the funds generated and budgeted each year from the Historic Preservation Schedules of Fees attributable to transfers of development rights and density paid into the Public Benefits Trust Fund, in order to establish permanent funding for the Senior Rental Assistance Program is authorized.' Section 4. The City Manager is authorized' to negotiate and execute any and all necessary documents, in forms acceptable to the City Attorney, for said purpose(s), in compliance with all applicable federal, State of Florida, and local laws. Section 5. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. City of Miami Page 2 of 2 File ID: 6879 (Revision:) Printed on: 411712023 EXHIBIT "A " CITY OF MIAMI DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT (THE "DEPARTMENT") LOW-INCOME SENIOR RESIDENTS RENTAL ASSISTANCE PROGRAM Program Description: The Low Income Senior Rental Assistance Program is designed to mitigate and relieve the rental housing cost burden to City of Miami ("City') residents that are 62 years old or older, whose household income is 40%, or less, of the Miami -Dade County's AM I. The program is crafted to offset or reduce the impact of rent increases relative to City senior resident's fixed income. The City is cognizant that rent increases are usually greater than the cost of living increases in the City for the Low -Income Senior Resident's social security or other fixed income. These unmitigated rental increases oftentimes force senior residents to choose between housing and other essential costs such as food and medication. The goal of this program is to lift the heavy housing cost burden of extremely low-income and very low income seniors renting in the City, who are severely cost burdened , by ensuring that these eligible senior residents don't spend more than 50% of their monthly income on housing costs. Most of these eligible senior residents are rent burdened insofar as they spend over 30% of their monthly income on housing costs. Source of Funding: As referenced in Chapter 62, "Planning and Zoning Fees", Article VII, "Historic and Environmental Preservation Board —Schedule of Fees", Subsection 62-32(o) of the City Code of the City of Miami, as amended from time to time: An amount equal to fifteen percent (15%) of the value of the capital improvements pursuant to Section 23-6," Transfer of development rights and density" will be retained [ with the following funding allocations]: Ten percent (10%) for the Public Benefits Trust Fund, particularly forAffordable/Workforce Housing as per Article XIV, with priority of five percent (55vo) for the City's Senior Rental Assistance Program; Eligible Costs: Monthly rent costs that exceed 50% of the senior resident's monthly household income. Eligible Properties: Must be rental property located within the City limits with no current code violations, fines, or outstanding fees due the City, and funding prioritized as follows: a. Rental housing funded by the City; and, b. Subsidized rental housing in the City; and, c. Rental housing where % or more of the residents are low income senior residents as defined by this program and by the Housing Guidelines of the Department of Housing and Community Development (the" Department"). Eligible Tenants: a. Must be 62 years of age or older; b. Household income must be 40%, or less, of Miami -Dade County's AMI; c. Cannot have more than $5,000 in total bank accounts; d. Cannot receive rent subsidies; e. Rent must be current; and, f. Must always be City residents when participating in this Program. Required Documents: a. Most recent proof of monthly income; b. State of Florida issued identification card; c. Copy of executed lease /rental agreement; and d. Affidavit attesting that the rental unit is their primary residence. Amount to be provided: Basic monthly rent cost that exceed 50% of the low-income senior resident's monthly household income but not to exceed $100.00 per month per household. Payment: Payments will be made directly to landlord on a monthly basis. Length: Payment will be made for an initial period of 12 months. Renewal of payments for another 12-month period will be subject to availability of funds and tenant(s) maintaining program eligibility. City of Miami Resolution R-22-0082 alldl 11 li.Rl I + Legislation File Number: 11516 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 2/24/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT TITLED "MIAMI FOR EVERYONE RENTAL ASSISTANCE PROGRAM," ATTACHED AND INCORPORATED AS EXHIBIT "A" ("PROGRAM"); ALLOCATING AND APPROPRIATING FUNDING IN AN AMOUNT NOT TO EXCEED FIVE MILLION DOLLARS ($5,000,000.00) FOR THE PROGRAM TO PROVIDE ASSISTANCE TO MIDDLE CLASS CITY OF MIAMI RESIDENTS WHO ARE UNABLE TO ABSORB DRAMATIC RENT INCREASES; APPORTIONING FUNDING FOR THE PROGRAM BETWEEN THE FIVE (5) COMMISSION DISTRICTS PURSUANT TO THE ANTI -POVERTY INITIATIVE METHODOLOGY; FURTHER AUTHORIZING THE CITY MANAGER TO ALLOCATE AND APPROPRIATE AN AMOUNT NOT TO EXCEED TWO HUNDRED FIFTY THOUSAND, TWO HUNDRED FIFTY-ONE DOLLARS AND NINETEEN CENTS ($250,251.19) TO THE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR THE ADMINISTRATION OF THE PROGRAM; AUTHORIZING THE PROGRAM FOR SIX (6) MONTHS WITH AN OPTION TO CONTINUE OR TERMINATE THE PROGRAM AS FURTHER DESCRIBED HEREIN. Suarez, Commissioner Ken Russell, Commissioner Manolo Reyes, Commissioner Christine King WHEREAS, new data has revealed that rent in South Florida has risen approximately fifty percent (50%) compared to last year, the most of anywhere in the nation; and WHEREAS, the City of Miami ("City") wishes to provide assistance to City residents who do not qualify for the City's current rental assistance programs administered by the City's Department of Housing and Community Development ("Department') but are not financially able to absorb such dramatic rent increases; and WHEREAS, the City wishes to establish the "Miami For Everyone Rental Assistance Program", attached and incorporated as Exhibit "A" ("Program"), to provide assistance to those eligible City residents; and WHEREAS, funding for the Program will come from the CityCoin Gift the City received pursuant to the Gift Agreement authorized by Resolution No. R-21-0345; and WHEREAS, it is in the best interest of the City's residents to apportion the funding for the Program between the five (5) Commission Districts pursuant to the Anti -Poverty Initiative ("API") methodology; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 11516 (Revision: A) Printed On: 411712023 File ID: 11516 Enactment Number: R-22-0082 Section 1. The Miami City Commission establishes and implements the Program as detailed in Exhibit 'A" attached and incorporated. Section 3. The following new Special Revenue Project is established and resources are allocated and appropriated as described herein: PROJECT TITLE: RESOURCES: APPROPRIATION Miami For Everyone Rental Assistance Program CityCoin Gift pursuant to the Gift Agreement authorized in Resolution No. R-21-0345 Miami For Everyone Rental Assistance Program $5,250,251.19 $5,000,000.00 to the Program $250,251.19 to the Department for Administrative Costs associated with Administering the Program Section 4. The funding for the Program is apportioned between the five (5) Commission Districts pursuant to the API methodology. Section 5. The Program shall be authorized for six (6) months from the date the Program is first made available to the public by the Department. After the initial six (6) months, the District Commissioner may decide, based on the District's needs, to either continue funding the Program with the remaining Program funds or terminate the Program within the District and direct the remaining Program funds to other affordable housing project(s) within the District, subject to all appropriate budgetary actions and approvals. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'
