A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING
RESOLUTION NO. R-22-0082 IN ITS ENTIRETY; ALLOCATING, BUDGETING,
AND APPROPRIATING TWO MILLION AND 00/100 DOLLARS ($2,000,000.00)
TO PROVIDE SUPPLEMENTAL FUNDING TO THE CITY OF MIAMI'S ("CITY")
SENIOR RENTAL ASSISTANCE PROGRAM; APPORTIONING THREE
MILLION, TWO HUNDRED FIFTY THOUSAND, TWO HUNDRED FIFTY-ONE
AND 19/100 DOLLARS ($3,250,251.19) EQUALLY TO EACH CITY
COMMISSION DISTRICT FOR THE COMMISSIONER OF EACH DISTRICT TO
ALLOCATE AND APPROPRIATE BY FUTURE RESOLUTION(S) FOR
AFFORDABLE HOUSING AND/OR RENTAL ASSISTANCE PROGRAMS; THE
USE, ALLOCATION, AND APPROPRIATION OF THE FIVE MILLION, TWO
HUNDRED FIFTY THOUSAND, TWO HUNDRED FIFTY-ONE AND 19/100
DOLLARS ($5,250,251.19) OF FUNDS REFERENCED HEREIN ARE SUBJECT
TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE
OF SUCH FUNDS AND THE RECEIPT OF ALL NECESSARY APPROVALS,
INCLUDING, BUT NOT LIMITED TO THE CITY ATTORNEY; AUTHORIZING
THE CITY MANAGER TO MAKE ANY CHANGES TO ADJUST, AMEND, AND
APPROPRIATE THE CITY'S OPERATING BUDGET, FIVE-YEAR FINANCIAL
PLAN, STRATEGIC PLAN, MULTI -YEAR CAPITAL PLAN, AND OTHER
DOCUMENTS AS NECESSARY AND APPLICABLE, PURSUANT TO THE
PROVISIONS OF THIS RESOLUTION; AUTHORIZING, RATIFYING,
APPROVING, AND CONFIRMING CERTAIN NECESSARY ACTIONS BY THE
CITY MANAGER AND THE DESIGNATED CITY DEPARTMENTS TO UPDATE
THE RELEVANT FINANCIAL CONTROLS, PROJECT CLOSE-OUTS,
ACCOUNTING ENTRIES, AND COMPUTER SYSTEMS IN CONNECTION
HEREWITH.

WHEREAS, pursuant to Resolution No. R-19-0516, adopted on December 12, 2019, the
City Commission approved the creation of the Senior Rental Assistance Program ("Program");
and
WHEREAS, the purpose of the Program is to alleviate the burden caused by rent
increases for the City of Miami's ("City") senior residents who are on a fixed income; and
WHEREAS, the Program is funded from the Historic Preservation Schedule of Fees
attributable to transfers of development rights and density paid into the Public Benefits Trust
Fund, with a priority of five percent (5%) of such funds to be expended for the City's Senior
Rental Assistance Program; and
WHEREAS, there is an explicit authorization to allocate funds to the Senior

Rental Assistance Program in section 62-32(o) in the Code of the City of Miami Florida, as
amended ("City Code"); and
WHEREAS, Resolution No. R-22-0082, adopted on February 24, 2022,
established the Miami For Everyone Rental Assistance Program, which was intended for middle
class families who do not have guardrails and are not financially able to absorb large rent
increases, with priority given to seniors and families with children; and
WHEREAS, Five Million, Two Hundred Fifty Thousand, Two Hundred Fifty -One
and 19/100 Dollars ($5,250,251.19) was allocated to the Miami For Everyone Rental Assistance
Program; and
WHEREAS, the City believes it is in the best interest to rescind Resolution No. R-
22-0082 in its entirety and to reallocate and apportion the Five Million, Two Hundred Fifty
Thousand, Two Hundred Fifty -One and 19/100 Dollars ($5,250,251.19) in available funds as
stated herein;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Resolution No. R-22-0082 is rescinded in its entirety.
Section 3. The City Manager is authorized' to allocate, budget, and appropriate
Two Million and 00/100 Dollars ($2,000,000.00) to provide supplemental funding to the City's
Senior Rental Assistance Program.
Section 4. The City Commission hereby apportions Three Million, Two Hundred
Fifty Thousand, Two Hundred Fifty -One and 19/100 Dollars ($3,250,251.19) equally between
the five (5) Commission Districts for the Commissioner of each District to allocate and
appropriate by future resolution(s) to district specific affordable housing and/or rental assistance
programs.
Section 5. The use, allocation, and appropriation of the funds referenced herein
are subject to all federal, State, and local laws that regulate the use of such funds and the
receipt of all necessary approvals, including, but not limited to the City Attorney.
Section 6. The City Manager is authorized' to make any changes to adjust,
amend, and appropriate the City's Operating Budget, Five -Year Financial Plan, Strategic Plan,
Multi -Year Capital Plan, and any other documents as necessary and applicable, pursuant to the
provisions of this Resolution.
Section 7. Certain necessary actions by the City Manager and the designated
City Departments to update the relevant financial controls, project close-outs, accounting
entries, and computer systems in connection herewith are hereby authorized', ratified,
approved, and confirmed.
' The herein authorization is further subject to compliance with all legal requirements that may be
imposed including, but not limited to, those prescribed by applicable City Charter and City Code
provisions.

Section 8. This Resolution shall become effective immediately upon its adoption
and signature of the Mayor.2

2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
