APPROVAL BEING SUBJECT TO AN OPINION OF

CITY ATTORNEY AS TO THE LEGALITY OF
SUCH
DONATION AND ITS COMPLIANCE WITH
CITY
PROCUREMENT PROVISIONS AND ALSO BEING
CONDITIONED UPON THE RECEIPT BY
SAID
ORGANIZATION OF ALL NECESSARY PERMITS
FROM
ALL STATE AGENCIES WHICH CONTROL
THE
CONSTRUCTION AND OPERATION OF HOSPITALS
AND
UPON THE FUTURE APPROVAL OF ANY NECESSARY
ZONING CHANGES; FURTHER ESTABLISHING
DEED

RESTRICTIONS.

' 1 WHEREAS, the City Commission, on March 21, 1985, by Motion

No. 85-266, expressed its intent to grant the request of El Liga
Contra El Cancer for the donation of land owned by the City for
the construction of a 25 bed hospital for cancer �:-�.-- p patients with
~'F limited or no resources and for further expanding home care
services; and
WHEREAS, said Motion further referred the request to the
;? City Manager for evaluation and recommendation; and
WHEREAS, the staff of the Parks and Recreation Department
has researched several possible sites with said organization; and
WHEREAS, the Parks and Recreation Department and El Liga
Contra E1 Cancer recommend that the old Southside Park site be
a
t. designated for the hospital; and
WHEREAS, said site, located at 100 Southwest llth Street and
consisting of + 2.2 acres, is no longer an active park site;
r`- NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The donation of the City -owned Southside Park
located at 100 Southwest 11 Street for the site of a hospital to
be constructed and operated by El Liga Contra E1 Cancer is hereby
approved, in principle. CITY COMMISSION

Section 2. The herein approval is subject to an opinion
of the City Attorney as to the legality of such donation and its
compliance with City Procurement provisions and also is further
conditioned upon the receipt by E1 Liga Contra E1 Cancer of all
necessary permits from all State agencies which control the
construction and operation of hospitals.
Section 3. The herein approval is further conditioned
upon the future approval of all necessary zoning changes.
Sectuib 4. The herein approval is further conditioned
upon the establishment of restrictions upon the transfer of
title; said restrictions shall require that the property revert
to the City in the event the hospital is not constructed, changes
ownership, or is converted to any use other than that which is
described herein.

The City Commission, By Motion No. 85-266, on March 21, 1985,
expressed its intent to grant the request of El Liga Contra E1 Cancer
for the donation of land owned by the City for the construction of a
25 bed hospital for cancer patients with limited or no resources and
for further expanding home care services. By the same Motion, the
Commission referred the request to the City Manager for evaluation
and recommendation.
The staff of the Parks and Recreation Department has researched
several sites with the Liga and our two organizations have agreed
upon the old Southside Park site as the most suitable location. This
site, located at 100 SW 11 Street and consisting of + 2.2 acres, is
no longer an active park site.
The Parks and Recreation Department recommends that the designation
of the Southside Park site be approved in principle as the site of
the hospital described above. We further recommend that the approval
be conditioned upon the receipt by the Liga of all necessary permits

from the State agencies which control the construction and operation
of hospitals and upon the future approval of any necessary zoning
r' changes.
The Department also recommends that restrictions be placed on any
deed transfers which would require that the property revert back to
the City in the event the hospital is not built, changes owners, or
is converted to any use other than that which is described above.
