A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO AN INTERLOCAL COOPERATION AGREE-
MENT, IN ESSENTIALLY THE FORM ATTACHED
HERETO, WITH METROPOLITAN DADE COUNTY FOR THE
PROVISION OF SERVICES RELATED TO PROPERTY
ACQUISITION AND RELOCATION FOR PURPOSE OF
IMPLEMENTING PHASE I OF THE SOUTHEAST
OVERTOWN/PARKWEST REDEVELOPMENT PROGRAM; AND
ALLOCATING AN AMOUNT NOT TO EXCEED THREE
HUNDRED AND EIGHTY THOUSAND DOLLARS
($380,000.00) FROM THE 1976 GENERAL OBLIGA-
TION HOUSING BOND FUNDS AND A SECTION 108
LOAN FROM THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT SECTION 108 LOAN PROGRAM.

WHEREAS, on October 25, 1983, the City Commission, by
Resolution No. 83-972, approved in principle, Phase I of the
O vertown Transit Station Impact Area Redevelopment Program for
the Southeast O vertown/Parkwest Redevelopment Area; and
WHEREAS, five (5) of the blocks located within the
redevelopment area have been acquired; and
a
WHEREAS, the City of Miami is desirous of initiating the

acquisition of the remaining seventy-one (71) parcels in the
redevelopment area; and

WHEREAS, by Resolution No. 83-187 the City Commission

authorized the Interlocal Cooperation Agreement between the City
of Miami and Metropolitan Dade County wherein redevelopment
responsibilities between the City and the County were delineated;
and
WHEREAS, the County is accordingly required to undertake

certain activities on behalf of the City relating to acquisition

and relocation to include: 1) administrative services regarding
residential relocation, 2) legal and other related services
regarding condemnation, 3) technical assistance associated with
business relocation, 4) coordination of building demolition; and

WHEREAS, the City is required to compensate the County for
the services rendered; and
WHEREAS, the City will utilize proceeds from General
Obligation Housing Bonds and a Section 108 Loan from the U.S.
Department of Housing and Urban Development to compensate the

Section 1. The City Manager is hereby authorized to
enter into an Agreement of Cooperation` in essentially the form
attached with Metropolitan Dade County for the purpose of
implementing Phase I of the Southeast O vertown/Parkwest
Redevelopment Program.
Section 2. An amount not to exceed Three Hundred and
Eighty Thousand Dollars ($380,000.00) is hereby allocated from
the 1976 General Obligation Housing Bond funds and a Section 108
loan from the Department of Housing and Urban Development to fund
the services related to property requisition and relocation to be
provided by Metropolitan Dade County under the terms of the
Agreement.

INTERLOCAL,.000PERATION__AGREEMENT
This Agreement entered into this — day of
1985, by and between the City of Miami, a municipal corporation
of the State of Florida, hereinafter referred to as "CITY", and
Metropolitan Dade County, Florida, hereinafter referred to as
"COUNTY."
WITNESSETH:
WHEREAS, on October 25, 1983, the City Commission, by
Resolution No. 83-972, approved in principle, Phase I of the
Overtown Transit Station Impact Area Redevelopment Program for
the Southeast 0 vertown/Parkwest Redevelopment Area; and
WHEREAS, five (5) of the blocks located within the
redevelopment area have been acquired; and
WHEREAS, the CITY is desirous of initiating the acquisition
of the remaining seventy-one (71) parcels in the redevelopment
area; and
WHEREAS, by Resolution No. 83-187 the City Commission
authorized the City Manager to enter into the Interlocal Coopera-
tion Agreement between the City of Miami and Metropolitan Dade
County wherein redevelopment responsibilities between the CITY
and COUNTY were delineated; and
WHEREAS, the COUNTY is accordingly required to undertake
certain activities on behalf of the CITY relating to acquisition
and relocation to include: 1) administrative services regarding
residential relocation, 2) legal and other related services
regarding condemnation, 3) technical assistance associated with
business relocation, 4) coordination of building demolition; and
WHEREAS, the CITY is required to compensate the COUNTY for
the services rendered; and
WHEREAS, the CITY has available proceeds from General
Obligation Housing Bonds and a Section 108 Loan to compensate
the COUNTY for services rendered.
NOW, THEREFORE, in consideration of the promises and the
mutual covenants and obligations herein contained, and subject to
the terms and conditions hereinafter stated, the parties hereto
understand and agree as follows:

SCOPE OF
_.SERVICES:

The
County bepartment of Housing and Urban Development will
be responsible for implementing the following activities:
A.
Relocation - The COUNTY shall provide administrative
services and technical assistance associated with
residential and business relocation.
B.
Condemnation - In the event that condemnation is
necessary, the COUNTY shall provide legal and other
related services pertaining thereto pursuant to Florida
Statute 163. The COUNTY shall notify the CITY in
writing of the necessity of such action. The COUNTY
shall hold all condemnation actions in obeyance pending
a written authorization to proceed issued by the CITY.
C.
Building Demolition - The COUNTY shall be responsible
for any site clearance activities necessary to the

preparation of the acquired parcels. Demolition and
site clearance shall be undertaken and completed in
accordance with specifications for site preparation for
new development.
<X`r` COMPENSATION:
For the services performed by the COUNTY under Section I,
the CITY will reimburse the COUNTY in an amount not to exceed
Three Hundred and Eighty Thousand Dollars
($380,000.). Said

Itemized vouchers for payment should be prepared by the
COUNTY by specific activity and submitted to the CITY when
partial or full payment for such services is required in the
course of implementing the activities in Section I. The total to
be paid to the COUNTY shall not exceed the above mentioned
amount.
TIME OF PERFORMANCE:
The COUNTY will undertake the activities enumerated in
Section I of this Agreement upon its execution and proceed to
complete them in a timely and efficient manner in light of the
objective of the Agreement.
IV.
ASSURANCES AND CERTIFICATIONS:
No person in the United States shall, on the grounds of
race, color, creed,• national origin, sex, marital status or
physical handicap, be excluded from participation in, be denied
the benefits of, or be otherwise subjected to discrimination
under this Agreement and will immediately take any measure
necessary to correct any such discrimination and to insure that
such discrimination cannot occur in the future.
AUDITS AND INSPECTIONS:
At any time during normal business hours and as often as the
City may deem necessary, there shall be made available to the
CITY, for examination all its records with respect to all matters
covered by this Agreement and the COUNTY will permit the CITY,
to audit, examine and make audits of all contract, invoices,
materials, payroll, record of personnel conditions of employment
and other data relating to all matters covered by this Agree-
ment. The CITY reserves the right to require the COUNTY to
submit, at the request of the CITY, to an audit by an auditor of

the CITY's choosing. The cost of said audit shall be borne by
the CITY. Said documents and records shall be maintained by the
COUNTY no less than three (3) years after the termination of this
Agreement.
VI.
AMENDMENTS:

No amendments to this Agreement shall be binding on either
party unless in writing and signed by both parties.
IN WITNESS WHEREOF, the CITY OF MIAMI, FLORIDA, has caused
this Interlocal Cooperative Agreement to be executed in its name
and behalf by its City Manager and its official seal to be
hereunto duly authorized; and Dade County, Florida, has caused
this Interlocal Cooperative Agreement to be executed in its name
and behalf by its County Manager and the official seal of the
Board of County Commissioners to be hereunto affixed and attested

It is recommended that the City Commmission
approve the attached resolution authorizing
the City Manager to enter into an agreement
of cooperation with Metropolitan Dade County_
for the purpose of implementing Phase I of
the Southeast Overtown/Park West Redevelop-
ment Program and to allocate an amount not
to exceed Three Hundred and Eighty Thousand
Dollars ($380,000) for services related to
property acquisition and relocation.
In October 1983, the City Commission approved the Transit Station
Impact Area Redevelopment Proposal (Resolution No. 83-972) which
delineated a nine -plus block Phase I redevelopment area. Five of
the blocks have already been acquired and the City is now initi-
ating the acquisition of the remaining 71 parcels.
The Interlocal Cooperation Agreement (Resolution 83-187) between
the City of Miami and Dade County which delineates redevelopment
responsibilities between the City and the County and requires
that Dade County undertake certain activities on behalf of the
City relating to acquisition and relocation.

Proposed services to be rendered by Dade County include:
-- Administrative services related to residential relocation;
-- Legal and other related services associated with condemnation
pursuant to Florida Statute 163;
-- Technical assistance associated with business relocation (the
City has been assigned the responsibility for business relo-
cation but currently does not have the staff to undertake
this effort); and
-- Coordination of building demolition.

The County will bill the City directly for services rendered
and has provided the City with an estimated budget for certain
aspects of the project (note attachments). The estimated cost of
services includes
Residential Relocation (242 cases) $210,300
Acquisition/Property I9anagement 52,300
Appraisal Review and
Assistance in Property Negotiation 54,000
Administration/Planning 26,400
Business Relocation 22,000
Engineering/Demolition 15,000
TOTAL $380,000
It is probable that the cost of services provided by Dade County
will be significantly lower if we are able to reach a negotiated
settlement on the acquisition of property.
:'he County will assign a business relocation officer to work
directly out of the Southeast Overtown/Park West Project Office.
It should be noted that the Dade County Department of Housing and
Urban Development will retain approximately 40% of its relocation
staff to undertake this project, these positions will be elimi-
nated otherwise. Funding will be provided by the 1976 Ge:naral
Obligation Housing Bonds and a loan from the U.S. Department of
Housing and Urban Devttlopmant Section 103 Lonn Program. The
Section 108 Loan will be repaid with proceeds of the first sale
of tax increment revenue bonds.

RE: Park West Budget Estimate
It is very difficult to develop a detailed budget for your program since we do
not know the specifics or the extent of our involvement in each activity. The
staff analysis attached is divided into four categories of staff based on areas
of expertise as follows:
Acquisition/Property Management 20% 36,057.90
Engineering/Demolition 10% 10,610.28
*Administration/Planning 10% 18,223.91
Relocation 40% 145,038.15
Sub -Total 209,930.24
Fringe 30% 62,979.07

*Does not include entire staff.
Please review these numbers and make recommendations to us as to where you think
we should make adjustments. For example, engineering/demolition could be eliminated
if we are not going to be involved in that category. Relocation can be adjusted
based on the actual workload in buildings to be acquired. The relocation staff
including fringes and overhead averages out to approximately $868.00 per case.
This budget is based on an estimate of 242 cases.
Also attached is an estimate of relocation costs prepared by Nick Chickillo.
