AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 99394 ADOPTED
DECEMBER 20, 1984, THE CAPITAL IMPROVEMENTS APPROPRIATION
ORDINANCE, BY TRANSFERRING t174,000 OF 1972 PARKS AND
RECREATION GENERAL OBLIGATION BONDS REVENUE FROM JOSE MARTI
RIVERERONT PARK DEVELOPMENT - PHASE I TO JOSE MARTI
RIVERFRONT PARK DEVELOPMENT PHASE II FOR THE PURPOSE OE
FUNDING THE CITY`S LOCAL MATCH REQUIRED BY THE LAND AND
WATER CONSERVATION GRANT AWARD; CONTAINING A REPEALER
PROVISION AND A SEVERA81LITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9939, on December 20,
1984, establishing resources and appropriations for the implementation of
Capital Improvements in the City of Miami, Florida; and
WHEREAS, the funding for this request was provided for this purpose under
Jose Marti Riverfront Park Development Phase I and can be transferred to Jose
Marti Riverfront Park Development Phase Ii; and
WHEREAS, the revenue and a similar amount in expenditures reflecting site
work done during Phase I in preparation for Phase II must be transferred as part
of the local match required for the Land and Water Conservation grant received
for Phase II;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 1 of Ordinance No. 9939, adopted December 20, 1984, is
hereby amended in the following particulars: 1/
Section 1. The following appropriation hereby made by fund
and project title include previously authorized projects and
fund appropriations for implementation of all municipal
capital improvements of the City of Miami, Florida. The
source of revenues to support the herein appropriations are
hereby identified by fund and project:

Section 2. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with provisions of this ordinance are hereby
repealed.
Section 3, If any section, part of section, paragraph, clause, phrase or
word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an emergency measure on
the grounds of urgent public need for the preservation of peace, health, safety,
and property of the City of Miami, and upon the further ground of the necessity
to allow the Parks and Recreation Department to proceed with the site
development of Jose Marti Riverfront Park - Phase II in an expeditious manner.
Section 5. The requirement of reading this ordinance on two separate days
is hereby dispensed with by a vote of not less than four -fifths of the members
of the Commission.
Section 6. The recitals appearing in the preamble to this Ordinance are
hereby adopted by reference as if fully set forth verbatim in this Section and
constitute an accurate description of the nature of the herein appropriation as
appearing in the title of this Ordinance.

It is recommended that the Miami City Commission approve the
attached emergency ordinance transferring 5174,000 of 1972
Parks and Recreation General Obligation Bonds Revenues from
Jose Marti Riverfront Park Development - Phase I to Jose
Marti Riverfront Park Development — Phase II for the purpose
of funding the City's local match required by the Land and
Water Conservation grant award.
The changes will result in transferring $174,000 in revenues from Phase I of the
Jose Marti Project to Phase II. This revenue is a part of the local match
required for the Land and Water Conservation fund grant received for Phase II.
A similar amount in expenditures, reflecting site work done during Phase i in
preparation for Phase II will also be transferred.
The attached emergency ordinance is prepared for the February 14, 1985 City
Commission meeting.
