HomeMy WebLinkAboutO-09977J-85L378 ORDINANCE NO. fro- 9 9 7 rl AN EMERGENCY ORDINANCE AUTHORIZING CERTAIN ADDITIONAL PROVISIONS REGARDING THE ISSUANCE OF $5,000000 FIRE FIGHTING] FIRE PREVENTION AND RESCUE FACILITIES BONDS, $5,000t000 POLICE HEADQUARTERS AND CRIME PREVENTION FACILITIES BONDS, $8,000,000 SANITARY SEWER SYSTEM BONDS, $9,0000000 STORM SEWER IMPROVEMENT BON08 AND $6t000,000 STREET AND HIGHWAY IMPROVEMENT BONDS OF THE CITY OF MIAMI, FLORIDA (THE "BONDS"), FOR THE PURPOSE OF CONFORMING THE PROVISIONS OF CERTAIN OTHER ORDINANCES TO THE PROVISIONS OF SECTION 9 OF RESOLUTION NO. 84- 628: PROVIDING THAT THIS ORDINANCE SHALL GO INTO EFFECT IMMEDIATELY UPON ITS PASSAGE; AND DISPENSING WITH THE READING OF THIS ORDINANCE ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE COMMISSION. BE IT ORDAINED, by the Commission of the City of Miami, Florida (the "Commission"): Section 1. The Commission has ascertained and deter- mined and does hereby declare that: (a) The issuance of the Bonds, the form thereof and certain details relating thereto were authorized by the following ordinances: Ordinance No. 9296, as adopted by the Commission on the 23rd day of July, 1981 and subsequently amended by Ordinance No. 9406, adopted by the Commission on the 1st day of April, 1982; Ordinance No. 9787, as adopted by the Commission on the 26th day of January, 1984 and subsequently amended by Ordinance No. 9904, adopted by the Commission on the loth day of October, 1984; Ordinance No. 8573, as adopted by the Commission on the 22nd day of July, 1976; Ordinance No. 9128, as adopted by the Commission on the loth day of July, 1980; Ordinance No. 9781, as adopted by the Commission on the 26th day of January, 1984 and subsequently amended by Ordinance No. 9905,adopted by the Commission on the loth day of October, 1984; and Ordinance No. 9129, as adopted by the Commission on the loth day of July, 1980 (collectively, the "Authorizing Ordinances"), (b) In order to have the interest on the Bonds be exempt from federal income taxation and to assist the marketing of the Bonds under current market conditions, it is necesbary to authorise certain additional provisions regatding the issuance of. the Bonds, the form thereof and certain details relating thereto, as provided in Section 2 hereof. Section 2. The details of the Bonds issued, and any other obligations to be issued pursuant to the Authorizing ordinances, on or after July 1, 1983, shall be substantially the same as the details of the Bonds described in the Authorizing Ordinances except that to the extent that any provision of any Authorizing Ordinance conflicts with the provisions of Section 9 of Resolution No. 84-628, as adopted by the Commission on the 14th day of June, 1984 ("Resolution No. 84-628"), the provisions of Section 9 of Resolution No. 84-628 shall govern in all instances. Section 3. Notwithstanding anything to'the contrary in the Authorizing Ordinances or in Resolution No. 84-628, in the event that more than one series of bonds shall be issued at the same time by the City, a separate bond form for each series of bonds shall not be required and the City is hereby authorized to consolidate into one bond form, solely for the purpose of printing such bonds, the different series of bonds. Section 4. Pursuant to Section 58 of the Charter of the City of Miami, this Ordinance shall go into effect immediately upon its passage and shall not be subject to the right of referendum. Section 5. This Ordinance is hereby declared an emer- gency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 6. Garcia Director of Finance OAtE: March 28, 1985 pILM SUBJECT: Agenda Item REFERENCES: ENCLOSUA M It is recommended that the attached emergency ordinance authorizing certain additional provisions regarding issuance of $5,000,000 Fire Fighting, Fire Prevention, and Rescue Facilities Bonds, $5,000,000 Police Headquarters and Crime Prevention Facilities Bonds; $8,000,000 Sanitary Sewer System Bonds; $9,000,000 Storm Sewer Improvement Bonds; and $6,000,000 Highway Improvement Bonds, (the "Bonds") for the purpose of _ certain other ordinances, to the provisions of certain other ordinances, to the provisions of Section 9 of Resolution Number 84-268; providing that this ordinance shall go into effect immediately upon passage; and dispensing with the reading of this ordinance on two separate days by a vote of not less than 4/5ths of the Commission. This Ordinance is required in order to bring the City into compliance relative to registration of municipal bonds to maintain the tax-free status. The change also allows for issuance of bonds in denominations of $5,000 or multiples thereof. Currently only $5,000 denominations are allowed. In addition, the ordinance has certain other technical changes required to bring the originating ordinance in compliance with recently passed federal laws and regulations.
