Wk!458- A RESOLUTION WAIVING THE REQUIREMENTS FOR FORMAL SEALED BIDS BY REDUCING THE 13IDDING TIME AND ACCEPTING THE BID OF CUYAHOGA WRECKING CURP IN THE PROPOSED AMOUNT OF $1651000, BASE BID OF THE PROPOSAL, FOR BAYFRONT AUDITORIUM DEMOLITION WITH MONIES THEREFORE ALLOCATED FRUM THE "BAYFRONT PARK REDEVELOPMENT" ACCOUNT IN THE AMOUNT OF $165,000 TO COVER THE CONTRACT COST; ALLOCATING FROM SAID FUND THE AMOUNT OF $23,100 TO CUVER THE COST OF PROJECT EXPENSE; ALLOCATING FROM SAID FUND THE AMOUNT OF $313UO TO COVER THE COST OF SUCH ITEMS AS ADVERTISING, TESTING LABURATURIES, AND POSTAGE; ALLOCATING FROM SAID FUND THE AMOUNT OF $950 TO COVER THE INDIRECT COST; AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH SAID FIRM. WHEREAS, sealed bids were received April 1'1, 1985 for BAY FRONT AUDITORIUM DEMOLITION; and WHEREAS, the City Manager and the Director of the Department of Public Works recommend that the bid received from Cuyahoga Wrecking Corp. be accepted as the lowest responsible and responsive bid; and WHEREAS, the Capital Improvements Appropriation Urdinance No. 9939, as amended, was adopted on December 20, 1984, and monies are available for the proposed amount of the contract, project expense, incidentals and indirect cost from the account entitled "Bayfront Auditorium Demolition" as set forth under Section 3. A. Capital Projects Fund. 3 of said ordinance; and WHEREAS, monies are available for the proposed amount of the contract, project expense, incidentals and indirect cost; WHEREAS, the City Manager has made a written finding that the use of the competitive sealed bidding method for the award of the herein procurement contract is not practicable or advantageous, due to the fact that the fifteen (15) day bidding 'Y COMMISSION MEETING OF APR IS 199 lu-4 140. 85458. SC.1^:.Ywsi iiS. sti 00*4 �n F. y` ! time required by the City Code imposes a serious constraint on 1 the schedule for the development of the Bayside project; and F.. i ' WHEREAS, the City Commission, after a properly advertised public hearing, accepts and ratifies the City Manager's above finding; NOW, THEREFURE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The findings set forth in the preamble to this Resolution are hereby adopted as if fully set forth in this Section. Section 2. The requirement for formal competitive sealed bids for the BAYFRONT AUDITORIUM DEMOLITION is hereby waived by a d four -fifths vote of the members of the City Commission, and a l bidding time of eight (8) calendar days is hereby approved. Section 3. The April 17, 1985 bid of Cuyahoga Wrecking Corp. in the proposed amount of $165,000 for the project t, .. entitled BAYFRUNT AUDITURIUM DEMOLITION based on lump sum prices, is hereby accepted at the price stated therein. The additional amount of $23,100 is hereby allocated from the aforesaid fund to cover the cost of project expense. Section 6. Cather REFERENCES:(For Commission Meeting of Director of,Public Works April 18, 1985) l r ENCLOSURES: The Department of Public Works has determined a low bidder for the BAYFRONT AUDITORIUM DEMOLITION. The proposed attached resolution waives the requirements for formal sealed bids and accepts the bid received April 17, 1985 of in the amount of $ and autnorizes the City Manager to enter into a contract on behalf of the City. The City of Miami and the Rouse Corporation are committed to a certain schedule for the construction of Bayside Specialty Center. In order to avoid any delays in the start of said construction, the reduction in bidding time from the required 15 days to 8 days became necessary. Bids were received April 1'l, 1985 for BAYFRONT AUDITORIUM DEMOLITION. As reflected in the tabulation of bids, the $ aid of is the lowest responsible bid for the total bid of �. the proposal. Poms Asst. to the City Manager ENCLOSURES: Special Projects Task Force The construction plans for the Bayside Project requires the demolition and removal of the Bayfront Park Auditorium in order to prepare for the construction of the Bayside Parking Garage. It is anticipated that the Developer will take possession of the site by June 1, 1985 and immediately commence construction. In order for the City to meet its obligations under the agreement with the developer, Bayside Center Limited Partnership, the demolition of the auditorium must be undertaken by the City on an accelerated schedule. The project includes the removal of existing asbestos material within the building prior to demolition, relocation of electric services, demolition and removal of the building foundation and adjacent parking areas, roads, sidewalks and curbs and related site elements. The Public Works Department estimates it will take 3 months to complete the project. There is not enough time for the City to have this work completed following all of the requirements of competitive bidding procedures. In order to have the Bayfront Park Auditorium demolished by the end of June, it will be necessary to waive the requirement for a 15- calendar day bidding period and reduce it to 12 days. All other procedures outlined in the City Code for sealed competitive bids will be followed. The Public Works Department will advertise the project on April 5, 1985 and receive bids on April 17, 1985. Under Sec. 18-52.5 of the City Code, the City Manager may make a written finding supported by reasons that a valid emergency exists. However, such findings must be ratified by an affirmative vote of two-thirds of the City Commission after a properly advertised public hearing. Page 1 of 2 Wilim _117 1, IN Sergio Pereira April 4, 1985 In order to expedite the project, it is therefore recommended that the City Manager authorizes a waiver in the bidding period from 15 to 12 days and that the resolution for the award of the project to the lowest qualified bidder be put on the City Commission agenda for public hearing at the meeting scheduled for April 18, 1985. THE ABOVE FINDINGS OF FACT AND SUPPORTING AND REASONS THEREFOR ARE HEREBY APPROVED AND ADOPTED AS FINDINGS OF THE UNDERSIGNED.
