A RESOLUTION REQUESTING THE FLORIDA LEGISLATURE TO AMEND CHAPTER 159 OF i THE FLORIDA STATUTES TO PROVIDE FOR i THE CONCURRENCE OF MUNICIPALITIES IN THE ISSUANCE OF INDUSTRIAL DEVELOPMENT TAX FREE BONDS BY COUNTIES WHERE THE PROCEEDS OF SAID BONDS ARE TO BE USED TO FINANCE THE RELOCATION OF A BUSINESS FACILITY FROM SUCH MUNICIPALITY TO AN UNINCORPORATED AREA WITHIN SAID COUNTY. i i WHEREAS, Florida Industrial Development Tax Free Bonds provide a tax incentive for the construction of business facilities; and WHEREAS, the departure of certain businesses from municipalities can have and has had a negative impact on City i employment and economics; and WHEREAS, under present federal legislation, a business may i relocate within a county without regard to the negative effect that such relocation would have on local government units in said county; and WHEREAS, there is a need to secure for municipalities a state e policy that will protect the economic stability of their tax base to the maximum extent possible; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Florida legislature is hereby requested to amend Chapter 159 by adding the following new section: 159.286 Prohibition. A county (or the Industrial Development Authority of such county) shall not issue industrial Development Bonds for the purpose contained in this part if the proceeds of such bonds will be used to finance a project that will cause the relocation of a facility from a municipality located in such county to an unincorporated area of such county unless the governing body of such municipality shall have adopted a resolution approving the issuance of said bonds. The City Clerk is hereby instructed to dis- tribute this resolution to the Governor, members of the Dade Delegation, the appropriate legislative committees responsible for considering this proposed amendment, the Speaker of the House of Representatives, the President of the Senate, the Dade League of Cities, and the Florida League of Cities.
