WHEREASO the Miami Planning Advisory Board, at its meeting
of December 5, 1984# Item No. 13, following an advertised
hearing, adopted Resolution No. PAB 129-84, by a 8 to 0 vote,
RECOMMENDING APPROVAL of a change of zoning classification, as
hereinafter set forth; and
WHEREAS, the Miami Planning Advisory Board, at its meeting
of January 6, 1985, Item No. 3, following an advertised hearing,
adopted Resolution No. PAB 10-85, by a 6 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning classification for certain blocks,
as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOWt THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMIt FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
zoning ordinance of the City of Kiamip Florida, is hereby amended
by changing the zoning classif ication for the properties located
at approximately 701-745 Northwest 6th Avenue (east side only),
also described as Lots 9-12, Block 49Nr MIAMI NORTH A,L, KNOWLTON

Section 3. Pages No, 23 and 36 of the Zoning Atlas, made
a part of ordinance No, 9500 by reference and description in
Article 3p Section 300 of said Ordinance# ate hereby amended to
reflect the changes made necessary by these amendments,
8ection 4, All ordinancest code sectionst or parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
8ection 5. Should any part or provision of this Ordi-
nance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinance
as a whole.

8ACKGROUN0 N 1988, several property owners approached the
Planning Department with a petition reques*Cing
re -zoning consideration, stating that the RG-2/6
zoning that they had in Zoning Ordinance 9500
was not as liberal as the zoning they fortrerly
had under prior Zoning Ordinance 6871 which
expired in June, 1983.
ANALYSIS Under prior Zoning Ordinance 6871, zonilig
was R-4 Mlediun Density Multiple Dwelling east of
a line mid -block between N14 4th and NW Sth
Avenues and C-5 Liberal Commercial west of that
line. Ordinance 9500 the area was
zoned RG-2/6 General Residential, to reflect the
predominent residential character of the area
but which left existing commercial uses in a
non -conforming status.
The Plannfng Department now recognizes that the
existing commercial uses along-P NW 8th Street
form a neighborhood node whic; is likely to
remain for the foreseeable future. However, any
rezoning must respect two factors:

area, principally represented by existing
housing, and vacant land destined for

of Housing and Urban Development; and
b the provision of a restrictive commercial

commercial property so that necessary
neighborhood commercial services will
conti nue to be provi ded. To preser, ' e the
residential character of the neighborhood,
liberal commercial uses should not be
allowed.
The recommended rezoning to CR-1 Commercial
Residential (Neighborhood) allows both
residential uses and neighborhood commercial
uses, However, any existing bars or taverns
would remain non"conforming as to use in the CR�
I district.

In response to your request, I have reviewed the proposed zoning
changes and backgroun-d data submitted by the Southeast/Overtown
Park West Redevelopment Project and based on this"' review I have
no problems with their recommendation. In addition, Richard
Weisberg, Chief Zoning Section, Joseph W. McManus and - I surveyed
the area on last Friday, October 12, 1984. After we discussed
the general pros and cons of the zoning change, it was felt by
Richard Weisberg that the change would not pose any problems.
Based on the aforementioned information, I recommend that we
prepare a Request For Change In Zoning.
The overall purpose and intent of this change will be to afford
the businessmen the needed flexibility to expand their businesses
and also mediate any incompatibility with the surrounding
residential area. If the area is rezoned, coupled with the
proposed new residential development, it will allow these
businesses an opportunity to expand, depending upon whether it is
economically feasible, to better serve the needs of their
community.

In response to the attached letter addressed -to you, the following discussion
is hereby provided for your consideration and review:
REMVENDATION
It is recommended that the City Planning Department initiate rezoning of the
area bounded by approximately N.W. 3th Street on the north, N.W. 7th Street dn
the south, N.W. 6th Avenue on the west, and N.W. 4th Avenue on the east from
RG-'2/6 to CR-1/16 in order to allow. for the expansion of the existing neeighbor-
hood oriented retail establishments which would be compatable with the overall
residential character of the area (see Exhibit No. 1). Twelve of the existing
16 businesses would be permitted to expand under the proposed rezoning.
Comparatively speaking, the RG-2/6, General Residential District, designation
is intended to be applied in areas suitable for general residential develop-
ment from single-family detached to multi -family housing. Conversely, the
recommended zoning change to CR-1/6 is intended to be applied where the exist-
ing pattern of development is predominately strip connercial which will have
no adverse effects on the character of adjoining residential neighborhoods.
Relative to the negative and positive aspects of the change, the following
table is provided:

As part of the citywide rezoning that went into effect on June 27, 1983, a
portion of West Overtown was rezcned Ircm IC-5, general co=ercial, to RG-2/6,
general residential. The area east of approximately 5th Avenue was rezoned
residential (R-4) prior to 1961. However, businesses located;within the
rezoned R-4 District made no attempt to expand until after June 28, T983, and
discovered that, even though their businesses were grandfathered in, they were
unable to expand. Historically, the 8th St�eet corridor has been a commercial
district in Overtown.
Since 1979, the.City of Miami, in conjunction with Dade Couinty through its
Community Development Program, has instituted an aggressive redevelopment
program in West Overtown (Culmer Park Area). The objective of this program,
as delineated _�n the Overtown Redevelopment Plan, 1979, is to redevelop the
Culmer Park area as a residential community. Components of this program
include:
1 Housing
- Construction of 14 units of second mortgage housing (Southgate
Villas).
- Construction of 75 units of public housing.
- Finalizing process to construct 32 townhouse units for the
market (construction is imminent).
- Rehabilitation of 15 multi -family units.
2. Rezoned the area froin commercial to residential.
3. Acquisition of approximately six acres of land.
4. Demolition of approximately 21 vacant structurally unsound
buildings.
5. Completed the Metro -Dade Department of Housing and Urban Development
(HUD) Central Warehouse facility,
Subsequent to the adoption of the City's newly enacted Zoning Ordinance, the

N.W, 4th Avenue, and on the west by N.W. 6th Avenue. Nine signatures regis-
tered on the petition, representing a lounge ovrner, grocery store owners,

restaurant owners, and an import/export owner (see list of businesses attached
to Exhibit No. 1 for compatibility).
Consequently, the group sent you a letter requesting a meeting with the
Planning Department (see Exhibit No. 3). To date, two meetings have -taken
place wit*h the group. The initial meeting, October 21, 1983, at Robinson's
W *�ned out to be more of a fact finding

mission. We agreed to follow-up with a proposed, possible zoning change that
would afford the group the needed flexibility in expanding their businesses.
At the ensuing meeting held on November 15, 10,83, we shared our -preliminary
J recommendation With the group and we adjourned with their concurrence in the
recom.mended change which calls for rezoning a segment of N.W. 9th Street froin
RG-2/6 to CR-1/6.
One of the businesses, Mr. Willie Simmons, is currently renovating his busi-
ness with the intention of establishing an electronic video game room (see
Exhibit, No. 1, Item 15). However, subsequent to reviewing this particular
use, we discovered that such an establishment is definitely not permitted in a
CR-1 zoning district and, in all probability, the same will hold true in seek-
ing a special permit in the same district. A letter will be forwarded to Mr.
Simmons reflecting this matter.
In view of the discussion provided herein, it is our opinion that the proposed
zoning district change car. be implemented without a negative impact on the
overall intended residential character of the area.
Those participating businesses located beyond the recommended district change

are Mom and Pop type grocery stores located in existing apartment complex�
without the capacity for expansion.

8ACKGROUND in 1983, several property owners approached the
Planning Department with a petition requesting
ro-zoning consideration, stating that the RG-2/6
zoning that they had in Zoning Ordinance 9500
was not as liberal as the zoning they fortnerly
had under prior Zoning Ordinance 6871 which
expired in June, 1983.
ANALYSIS Under prior Zoning Ordinance 6871, the zoning
was R-4 Medium Density Multiple Dwelling east of
a line mid -block between NW 4th and NW 5th
Avenues and C-5 Liberal Commercial west of that
line. --Under.-Zoning Ordinance 9500 the area was
zoned RG-2/6 General Residential, to reflect the
predominent residential character of the area
but which left existing commercial uses in a
non -conforming status.
The Planning Department now recognizes that the
existing commercial uses along NW 8th Street
form a neighborhood node which is likely to
remain for the foreseeable future. However, any
rezoning must respect two factors:
a) the predominent residential character of the
area, principally represented by existing
housing, and vacant land destined for
tPusing, owned by the Dade County Department
of Housing and Urban Development; and

b) the provision of a restrictive commercial
zoni ng classification for exi sti ng
commercial property so that necessary
neighborhood commercial services will
conti nue to be provided. To preserve the
residential character of the neighborhood,
liberal commercial uses should not be

The recommended rezoning to CR-1 Commercial
Residential (Neighborhood) allows both
residential uses and neighborhood commercial
uses. However, any existing bars or taverns
would remain non -conforming as to use in the CR-
I district.

have reviewed the proposed

changes and backgroun-d data submitted by the Southeast/Overtown
Park West Redevelopment Project
and based on this review
I have
no problems with their recommendation. In addition, Richard
Weisberg, Chief Zoning Section, Joseph W. McManus and I surveyed
the area on last Friday, October 12, 1984. After we discussed
the general pros and cons of the zoning change, it was felt by
Richard Weisberg that the change' would not pose any problems.
Based on the aforementioned information, I recommend that we
prepare a Request For Change In Zoning.
The overall purpose and intent of this change will be to afford
the businessmen the needed flexibility to expand their businesses
and also mediate any incompatibility with the surrounding
residential area. If the area is rezoned, coupled with the
proposed new residential development, it will allow these
businesses an opportunity to expand, depending upon whether it is
economically feasible, to better serve the needs of their
community.

In response to the attached letter addressed to you, the following discussion
is hereby provided for your consideration and review:
RECUVENDATION
It is recommended that the City Planning Department initiate rezoning of the
area bounded by approximately N.W. 8th Street on the north, N
W. 7th Street dn
the south, N.W. 6th Avenue on the west, and N.W. 4th Avenue on the east from
RC-2/6 to CR-1/6 in order to allow.for the expansion of the existing neighbor-
hood oriented retail establishments which would be compatable with the overall
residential character of the area (see Exhibit No. 1). Twelve of the existing
16 businesses would be permitted to expand under the proposed rezoning.
Comparatively speaking, the RG-2/6, General Residential District, designation
is intended to be applied in areas suitable for general residential develop-
ment from single-family detached to multi -family housing. Conversely, the
reconnended zoning change to CH-1/6 is intended t6 be applied where the exist-
ing pattern of development is predominately strip connercial which will have
no adverse effects on the character of adjoining residential neighborhoods,

BACKGROUND
As part of the citywide rezoning that went into effect on June 27, 1983, a
portion of West Overtown was rezoned from C-5, general commercial, to RG-2/6t
general residential. The area east of approximately 5th Avenue was rezoned
residential (R-4) prior to 1961. However, businesses located1within the
rezoned R-4 District made no attempt to expand until after June 28, 1*983, and
discovered that, even though their businesses were grandfathered in, they were
unable to expand. Historically, the 8th SICieet corridor has been a commercial
district in Overtown.
Since 1979, the.City of Miami, in conjunction with Dade County through its
Community Development Program, has instituted an aggressive redevelopment
program in West Overtown (Culmer Park Area). The objective of this program,
as delineated,�n the Overtown Redevelopment Plan, 1979, is to redevelop the
Culmer Park area as a residential community. Components of this program
include:
1. Housing
Construction of 14 units of second mortgage housing (Southgate
Villas).
Construction of 75 units of public housing.
Finalizing process to construct 32 townhouse units for the
market (construction is imminent).
Rehabilitation of 15 multi -family units.
2. Rezoned the area from commercial to residential.
3. Acquisition of approximately six acres of land.
4. Demolition of approximately 21 vacant structurally unsound
buildings,,
5. Completed the MetrQ-Dade Department of Housing and Urban Development
(HUD) Central Warehouse facility.
Swb*equent to the adoption of the City's newly enacted Zoning Ordinance, the
business community, mainly along N,W. 8th Street and west of 1-95, circula"�d
a petitiQn (see Exhibit No. 2) requesting a rezoning of the area bounded on

N.W. 4th Avenue, and on the West by N,W. 6th Avenue, Nine signatures re-gis-
tered on the petitiont representing a lounge owner, grocery store ownerst
restaurant owners, and an import/export owner (see list of businesses attached
to Exhibit No6 I for compatibility).
Consequently, the group sent you a letter requesting a meeting with the
Planning Department (see Exhibit No. 3)4 To date, two meetings have taken
place with the group. The initial meeting, October 21, 1983, at Robinson's
Import/Export, Which you attended, tu�ned out to be more of a fact finding
mission. We agreed to follow-up with a proposed, possible zoning change 'that
would afford the group the needed flexibility in expanding their businesses.
At the ensuing meeting held on November 15, 1983, we shared our preliminary
recommendation With the group and we adjourned with their concurrence in the
recommended change which calls for rezoning a segment of N.W. 9th Street from
RG-2/6 to CR-1/6.
One of the businesses, Mr. Willie Simons, is currently renovating his busi-
ness with the intention of establishing an electronic video game room (see
Exhibit No. 1, Item 15). However, subsequent to reviewing this particular.
use, we discovered that such an establishment is definitely not permitted in a
CR-1 zoning district and, in all probability, the same will hold true in seek-
ing a special permit in the same district. A letter will be forwarded to Mr.
Sirr,nons reflecting this matter.
In view of the discussion provided herein, it is our opinion that the proposed
zoning district change can be implemented without a negative impact on the
overall intended residential character of the area.
Those participating businesses located beyond the recomended district change
are Mom and Pop type grocery stores located in existing apartment complexes
without the capacity for expansion.
