AN EMERGENCY ORDINANCE AMENDING ORDINANCE
NO. 9939, ADOPTED DECEMBER 20, 1984,
THE CAPITAL IMPROVEMENT APPROPRIATIONS
ORDINANCE, BY ESTABLISHING BAYSIDE SPECIALTY
CENTER PROJECT IN THE AMOUNT OF $1,998,000
AND APPROPRIATING AN AMOUNT OF $515,000 FROM
1984 STORM SEWER GENERAL OBLIGATION BONDS,
AN AMOUNT OF $322,000 FROM 1980 SANITARY
SEWER GENERAL OBLIGATION BONDS, AN AMOUNT
OF $968,000, FROM 1980 HIGHWAY GENERAL
OBLIGATION BONDS, AND AN AMOUNT OF $193000
FROM 1980 HIGHWAY GENERAL OBLIGATION BONDS
INTEREST EARNINGS FOR A TOTAL APPROPRIATION
TO SAID PROJECT IN THE AMOUNT OF $1,998,000;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9939 on
December 20, 1984, establishing resources and appropriations
for implementation of Capital Improvements in the City of
Miami, and
WHEREAS, by Resolution No. 84-1341.3 on December 7, 1984,
the City Commission authorized the City Manager to execute a
lease agreement between the City of Miami and Bayside Center
Limited Partnership (Developer) on behalf of Rouse Miami, Inc.
an affiliate of the Rouse Company of Columbia, Mar -•land for the
planning and design, construction, leasing and management of a
waterfront specialty center known as "Bayside Specialty
Center;" and
WHEREAS, the executed lease agreement between the City and
Developer includes a provision that the City pay a total of
$4,000,000 to the Developer for site improvements to be
constructed by the Developer at Bayside Specialty Center,
located on a City. -owned land parcel &Jjacent to Biscayne
Boulevard and Miamarina and a portion of Bayfront Park; and
WHEREAS, storm sewer, sanitary sewer, highway and related
improvements to be constructed by the Developer at a value of
$4,000,000 have been identified to be funded by the City in
fulfillment of the 0lty'5 obligation under the executed lease
agreement; and

WHEREAS, it is estimated that during PY 1085 an amount of
$11998,000 will be eoouirod to fund said storm sewer, sanitary
sewer; highway and related improvements; and
WHEREAS, an amount of $515,000 is available from 1584
Storm Sewer General Obligation Bonds and can be appropriated to
Bayside Specialty Center for storm sewer improvements; and
WHEREAS, an amount of $322,000 is available from 1980
Sanitary Sewer General Obligation Bonds and can be appropriated
to Bayside Specialty Center for sanitary sewer improvements;
and
WHEREAS, an amount of $968,000 is available from 1980
Highway General Obligation Bonds and can be appropriated to
Bayside Specialty Center for highway and related improvements;
and
WHEREAS, an amount of $193,000 is available from 1980
Highway General Obligation Bonds Interest Earnings and can be
appropriated to Bayside Specialty Center for the demolition of
the Bayfront Auditorium Building as agreed upon between the
City and Developer; and
WHEREAS, the total amount of $1,998,000 is hereby
appropriated to establish Bayside Specialty Center as a capital
project in the Capital Projects Fund;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 9939, adopted
December 20, 1984, is hereby amended in the following
particulars: 1/

Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with provisions of this
,ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be
affected.
Section 4. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officer�,payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry out the functions
and duties of municipal affairs,
Se6tibn 5. The requirements of tettdihg this ordinance on
two separate days is hereby dispensed with by a Vote of not
loss than four-PiPths of the members of the Commission.

On December 7, 19842 by Resolution No. 84-1341.3 the City Commission
authorized the City Manager to execute a lease agreement between the
City of Miami and Bayside Center Limited Partnership (Developer) for the
planning and design, construction, leasing and management of a
waterfront specialty center known as "Bayside Specialty Center."
The executed lease agreement includes a provision that the City fund a
total of $4,000,000 worth of site improvements to be constructed by the
Developer. A total of $4,000,000 in site improvements have been
identified to be funded by the City to fulfill its obligation under the
lease agreement.
It is estimated that during the remainder of this fiscal year, FY185, an
appropriated amount of $1,998,000 will be required to fund identified
improvements that include storm and sanitary sewer improvements, street
improvements and other related improvements. The balance of the
$40000,0001 $2,002,000, will be appropriated next fiscal year, FY186.

Bayside Specialty Center from the following sources:
