The Rouse Company is negotiating a buyout of the remaining term of New World Marinas' Miamarina Management Agreement and will work with the City to accommodate moving and relocating tenants currently located at the marina. i The Pier 5 Boatman's Association includes 32 charter and fishing boats currently operating at Miamarina. These businesses have operated in Miami for many years, first at Pier 5, then at Watson Island during reconstruction of the Pier 5 area and since opening Miamarina they have ' been located at the marina under dockage agreements with the City. rt The City's Request for Proposals for Bayside required the successful r proposer to accommodate the commercial boats. The Rouse Company has indicated a desire to have them located next to Bayside and has designed '! the landside facilities in anticipation of the Pier 5 Boatman's Association returning to Miamarina when Bayside is opened and operating. My staff has explored, with the Association, alternative locations and strategies for temporary facilities to accommodate the fleet, keeping them together until such time as Bayside construction is complete and the option is available to them to return to Miamarina. We are seeking your approval to proceed with plans and permitting for {i the construction of temporary docks to be located at the south water edge of Bicentennial Park in the deep water slip adjacent to the { existing seawall. The attached sketches are conceptual only and are to indicate the potential scope of facilities and location recommended. The following proposal has been discussed with representatives of the Pier 5 Boatman's Association who have indicated their desire to move forward together with the City to accomplish such a facility: M0771,01 IL 85-611G/l k # # Eton. Mayor and Members of the City Commission Pr� oposal The City will fund and construct a temporary deck, access stairs, finger piers, pilings and utilities along approximately 800 feet of seawall at the south edge of Bicentennial Park in order to } accommodate approximately 40 boats and make these facilities exclusively available to the Pier 5 Boatman's Association. . Members of the Association will each enter into separate dockage agreements with the City of Miami to temporarily occupy the Bicentennial Park location limited to a term of three years or until Bayside is complete and Miamarina is available to operate at, whichever is greater, and further, that each member agree to vacate the Bicentennial Park facility at that time. Dockage Fees ' g paid to the City by the Pier 5 Boatman's Association members for the three year term shall be adequate to repay the City for the cost of construction of the facilities, normal maintenance and operations for three years, and to cover the cost of removal of the facilities. . The option to return to the Miamarina will be guaranteed by a written agreement between the Association, the City and Bayside. Alternative ,t options such as Watson Island or remaining at the temporary location i, as a part of future City plans for developing that area shall not be precluded by the agreement. In the event the proposed facilities cannot be constructed and made available prior to construction beginning at the Bayside site, the City will exercise its best efforts to make available access to and use of one of the Miamarina piers north of Reflections restaurant as an interim facility. wo • The Pier 5 Boatman's Association agree to drop their lawsuit against Miami, Bayside and New World Marinas in its entirety upon satisfactory ' agreement to temporary location facilities and all attendant agreements.
