HomeMy WebLinkAboutO-099944/g%85 ORDINANCE NO. 9994 EMERGENCY AN/ORDINANCE AMENDING SECTION 53=-161 (3) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WHICH CREATED A SCHEDULE OF FEES FOR THE USE OF THE CONVENTION CENTER PARKING GARAGE (MUNICIPAL GARAGE NO. 4) BY CHANGING THE RATE 8CH80ULE FOR THE USE AND OCCUPANCY OF AND THE SERVICES FURNISHED OR TO BE FURNISHED IN CONNECTION WITH THE MIAMI CENTER AND PARKING GARAGE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE, WHEREAS, the City of Miami has covenanted in the Trust Indenture securing the Convention Center and Parking Garage Revenue Bonds in Article V, Section 501, that a Consultant will be appointed to prepare and submit a recommended schedule of rates, fees and charges for the use and occupancy of and for the services furnished or to be furnished in connection with the Miami Convention Center and Parking Garage, effective May 1, 1985 and October 1, 1985. WHEREAS, Department of Off -Street Parking Consultants did perform research and complete a schedule of rates, fees and charges for the use of and for services furnished or to be furnished in connection with the World Trade Center Garage (Municipal Garage No. 4) which schedule is found to be acceptable and is reflected in the herein ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 53-161(3) of the Code of the City of Miami, Florida, as amended, is hereby further amended in the following particulars:) 1 "Sec. 53-161. Schedule of fees. The schedule of rents, rates, fees and charges for the use or occupancy of and for the services furnished or to be furnished in connection with the Convention Center of the City of Miami/University of Miami James L. Section 2. All ordinances or parts of ordinances in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the pre- servation of peace, health, safety, and property of the City of Miami, and the requirement of reading this ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. James L. Knight International Center. A recent review of the utilization and revenue generating patterns of the garage indicates a dram.=.rtic increase during the three years and Lhree months of operation. The result of this pattern is that the garage is near capacity at the peak mid -day period at least two days of each week. RELATIONSHIP OE' GARAGE FINANCIAL PERFORMANCE TO THE JAMES L. KNIGHT CENTER ---"-------"._.._ Financing for the garage and the James L. Knight Center were included in a $60 million revenue bond issue which was issued by the City of Miami on July 1, 1980, The Official Statement for the bond issue reflects that $15 million of the total financing was allocated to the garage. Using this amount, the conclusion is that 25 percent of the annual debt service should be allocated to the garage which results in debt service of $1,285,000 for Fiscal Year 1985/86. Knight Center and Hyatt Regency Hotel during mid -day peak times. It is also necessary to reduce the number of monthly parkers to accommodate the City Commission's commitment of 500 spaces for the Centrust Tower development as this project will be ready for occupancy during the forthcoming fiscal year. 11 third justification for highter monthly rates is that additional spaces are necessary to accommodate the valet service which has been an ongoing problem for the image of the Knight Center. The net impact of the proposed rates is that the number of monthly parkers will gradually reduce until the Centrust Tower is occupied. Knight International Center. .Ct is interesting to note that the financial structure of the Gusman Cultural Center and the contiguous Olympia Building is similar. With- out surplus revenues created by the operation of the Olympia Building, there would be insufficient funds to operate the Gusman Cultural Center without :-I property Lax subsidy. The Department of Off -Street Parking worked closely with the Olympia Building tenants over the past year to develop a strai egry for renovat_i.on of the office building and continued expansion of the event, at Giisman Cu.lLurai. The purpose of the Ordinance is to increase rates and charges for use '- of the Miami Convention Center Parking Garage (Municipal Garage No. 4) for the years 1985 and 1986, with the first increase effective June 1, 1985, and the second increase effective October 1, 1985. In accordance with the covenant of the Trust Indenture securing the Convention Center/Garage Revenue Bonds, the Off-street Parking Au- thority, acting as consultants for the Miami Convention Center Park- ing Garage, submitted to the City of Miami a suggested schedule of rents, rates, fees and charges for the facility. Pursuant to a review of the garage rates, it was determined that an increase in rates would place the City of Miami in a more competitive posture with the other downtown area parking facilities. The pro- posed rate changes will increase the garage revenue by $24,000 for the remainder of FY 1984-85. Furthermore, it is projected that a net increase of $180,000 in revenues for FY 1985-86 will result from the proposed garage rate increases on June 1, 1985, and October 1, 1985, respectively.
