WHEREAS, the City Department of Public Works recommends the acceptance of the plat; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The plat entitled "PAPANICOLAOU TRACT" is a subdivision of a portion of the N.E. 1/4 of Section 35, Township 53 South, Range 41 East, City of Miami, Dade County, Florida, being more particularly described as follows: Begin at the Southwest corner of Tract "B ", BISCAYNE CIVIC CENTER PLAZA, according to the plat thereof, as recorded in Plat Book 115, at Page 63, of the Public Records of Dade County, Florida; thence run S 88 ° 58'09" W. along the Northerly right -of -way line of N. W. 14th Street, along a line parallel to and 35 feet Northerly of, as measured at right angles to the South line of the N. E. 1/4 of said Section 35, for 419.85 feet to a point of curvature; thence run Southwesterly and Northwesterly along a circular curve to the right having for its elements a central angle of 91 ° 01'51" and a radius of 25 feet, for an arc distance of 39.72 feet to a point of tangency; thence run due North along the Easterly right -of -way line of N. WHEREAS, the execution of this Agreement by the Owner does not waive his immunity from taxes or special assessments; and WHEREAS, this Agreement when executed will testify to the Owner's intention to plat and install the required improvements as set forth herein; and WHEREAS, the completion of the improvements as set forth herein will not be required prior to the acceptance of the plat by the Cit, Commission. NOW, THEREFORE, the Owner hereby convenants and agrees with the City as follows: 1. Within one (1) year from the effective date of the acceptance and confirmation of said plat by the Commission of the City, or prior to the issuance by the City of a Certificate of Occupancy for the premises, the Owner will construct, or cause to have constructed, at his own expense and in accordance with standard specifications of the City, the following listed improvements: See attached Exhibit "B" Although one year is allowed for the completion of the afore . mentioned improvements, it is not in the public interest that such • 85 -54( • construction work sho d be prolonged to the EV.ent that it would have a disorganizing effect upon the neighborhood. AT PAPANICOLAOU TRACT, 1155 N.W. 14th STREET, MIAMI, FLORIDA WHEREAS, UNIVERSITY OF MIAMI, the Tenant, (hereinafter referred to as "U.M."), for the use and benefit of the Owner, Dade County, Florida, concurrently with the delivery of this Agreement, has applied to THE CITY OF MIAMI, FLORIDA, (hereinafter referred to as the "City ") , for the acceptance and confirmation by the Commission of said City, of a certain proposed plat of n subdivision to be known as PAPANICCLAOU TRACT located at 1155 N.W. 14th Street, Miami, Florida, a copy of which proposed plat is attached hereto and made a part hereof as Exhibit WHEREAS, the execution of this Agreement by the U.M. does not waive its immunity from taxes or special assessments; and WHEREAS, this Agreement when executed will testify to the U . M .'s intention to plat and install the reauired improvements as set forth herein; and WHEREAS, the completion of the improvements P s set forth herein will not be required prior to the acceptance of the plat by the City Commission. NOW, THEREFORE, the U.M. hereby covenants and agrees with the City as follows: 1. Within one (1) year from the effective date of the acceptance and confirmation of said plat by the Commission of the City, or prior to the issuance by the City of a Certificate of Occupancy for the premises, the U.M. will construct, or cause to have constructed, at its own expense and in accordance with standard specifications of the City, the following listed improvements, all as shown on the Improvement List, a copy of which is attached hereto as Exhibit "B" and made a part hereof: Although one year is allowed for the completion of the aforementioned improvements, it is not in the public interest that such construction work should be prolonged to the extent that it would have a disorganizing effect upon the neighborhood. After 85 -54€ /0 the work is started, the U.M. hereby agrees to prosecute said work progressively so as to complete it in a reasonable length of time as determined by the City Department of Public Works. 7.• The Certificate of Occupancy for any building or huildings constructed on the property platted shall not be issued by the City Building Department until the U.M. has fully and faithfully performed the work in accordance with the terms of this Agreement and has submitted to the City Department of Public Works a letter form a Registered land Surveyor certifying that the Permanent Reference Monuments indicated on the plat have been installed and properly placed.
