A RESOLUTION ACCEPTING THE PLAT ENTITLED
i 'PAPANICOLAOU TRACT ", A SUBDIVISION IN THE
CITY OF MIAMI; AND ACCEPTING THE DEDICATIONS
SHOWN ON SAID PLAT; AND AUTHORIZING AND
DIRECTING THE CITY MANAGER AND CITY CLERK TO
EXECUTE THE PLAT AND PROVIDING FOR THE
RECORDATION OF SAID PLAT IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, the City Department of Public Works recommends the
acceptance of the plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The plat entitled "PAPANICOLAOU TRACT" is a
subdivision of a portion of the N.E. 1/4 of Section 35, Township
53 South, Range 41 East, City of Miami, Dade County, Florida,
being more particularly described as follows: Begin at the
Southwest corner of Tract "B ", BISCAYNE CIVIC CENTER PLAZA,
according to the plat thereof, as recorded in Plat Book 115, at
Page 63, of the Public Records of Dade County, Florida; thence run
S 88 ° 58'09" W. along the Northerly right -of -way line of N. W. 14th
Street, along a line parallel to and 35 feet Northerly of, as
measured at right angles to the South line of the N. E. 1/4 of
said Section 35, for 419.85 feet to a point of curvature; thence
run Southwesterly and Northwesterly along a circular curve to the
right having for its elements a central angle of 91 ° 01'51" and a
radius of 25 feet, for an arc distance of 39.72 feet to a point of
tangency; thence run due North along the Easterly right -of -way
line of N. W. 12th Avenue along a line parallel to and 60.50 feet
Easterly of, as measured at right angles to, the West line of the
N.E. 1/4 of said Section 35, for 241.97 feet to a point of
intersection with the South line of Tract "A ", CARDIAC HOSPITAL
SUBDIVISION, according to the plat thereof, as recorded in Plat
Book 75, at Page 46, of the Public Records of Dade County,
Florida; thence run N 89 ° 03'00" E. along the South line of said
Tract "A ", CARDIAC HOSPITAL SUBDIVISION, for 445.20 feet to the

thereon together with the dedications to the perpetual use of the
public of all existing and future planting, trees and shrubbery on
said property, are also hereby accepted and confirmed by the City
of Miami, Florida.
Section 2. The City Manager and City Clerk are hereby
authorized and directed to execute the plat and cause the same to
be recorded in the Public Records of Dade County, Florida.

2, The location of the streets and the widths conform
with the standards of the Department of Public WorKs
Of the City of Miami, Florida.
4. The attached Certificate of Title Examination dated
April 10, 1985, signed by Brian P. Tague, Attorney,
indicates that the fee simple title to the property
platted is correctly vested in the County of Dade and
the plat has been correctly executed.
5. The area platted is encumbered by a mortgage and the
mortgage holder has executed the Plat and joined in
its dedications.
As certified to by Louis R. Campanile, Registered Land
Surveyor, this plat complies with the plat filing laws
of the State of Florida.
In accordance with the requirements of Chapter 54, of
the Code of the City of Miami, Florida, the
Performance Bond has been waived due to the fact that
this plat involves another governmental agency. The
improvements required at the property being platted
are landscaping, asphaltic concrete paving, removal of
existing sidewalk, removal of existing curb, sidewalk,
curb & gutter, and storm drainage structures.
7. The location of the property is shown colored in red
on the accompanying copy of a portion of City of
Miami, Florida, Zoning Sheet No. 214.
3. The attached resolution has been prepared for the
acceptance of the plat by the City Commission of
Miami, Florida.

AGREEMENT kuR CONSTRUCTION OF CERTAIN IMPROVEMENTS
WHEREAS, DADE COUNTY, a political subdivision of the State of
Florida (hereinafter referred to as the "Owner ") , concurrently with
the delivery of this Agreement, has applied to THE CITY OF MIAMI,
FLORIDA, (hereinafter referred to as the "City "), for the acceptance
and confirmation by the Commission of said City, of a certain proposed
plat of a subdivision to be known as " PAPANICOLAOU TRACT
located on approximately N.W. 12th Avenue and N.W.
14th Street a copy of which proposed plat is attached hereto
and made a part hereof as Exhibit "A".
WHEREAS, the execution of this Agreement by the Owner does not
waive his immunity from taxes or special assessments; and
WHEREAS, this Agreement when executed will testify to the Owner's
intention to plat and install the required improvements as set forth
herein; and
WHEREAS, the completion of the improvements as set forth herein
will not be required prior to the acceptance of the plat by the Cit,
Commission.

1. Within one (1) year from the effective date of the acceptance
and confirmation of said plat by the Commission of the City, or prior

his own expense and in accordance with standard specifications of the

constructed on the property platted shall not be issued by the City
Building Department until the Owner has fully and faithfully
performed the work in accordance with the terms of this Agreement and
has submitted to the City Department of Public Works a letter from a
Registered Land Surveyor certifying that the Permanent Reference
Monuments indicated on the plat have been installed and properly placed.

WHEREAS, UNIVERSITY OF MIAMI, the Tenant,
(hereinafter referred to as "U.M."), for the use and benefit of the
Owner, Dade County, Florida, concurrently with the delivery of
this Agreement, has applied to THE CITY OF MIAMI, FLORIDA,
(hereinafter referred to as the "City ") , for the acceptance and
confirmation by the Commission of said City, of a certain proposed
plat of n subdivision to be known as PAPANICCLAOU TRACT
located at 1155 N.W. 14th Street, Miami, Florida, a copy of which
proposed plat is attached hereto and made a part hereof as Exhibit
WHEREAS, the execution of this Agreement by the U.M.
does not waive its immunity from taxes or special assessments; and
WHEREAS, this Agreement when executed will testify to
the U . M .'s intention to plat and install the reauired improvements
as set forth herein; and
WHEREAS, the completion of the improvements P s set
forth herein will not be required prior to the acceptance of the plat
by the City Commission.
