TO THE ISSUANCE OF TITLE INSURANCE
BINDERS AND POLICIES FOR NEGOTIATED
TRANSACTIONS AND TO RENDER OPINIONS
OF TITLE WITH RESPECT TO THE FILING
OF CONDEMNATION PROCEEDINGS BY THE
CITY FOR THE SOUTHEAST/OVERTOWN
PARK WEST REDEVELOPMENT PROJECT, AT
A FEE NOT TO EXCEED $300000, WITH
FUNDS ALLOCATED F1?OM THE CITY'S
1976 GENERAL OBLIGATION HOUSING
BONDS AND THE SECTION 108 LOAN FROM
THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. An amount not to exceed $30,000 is hereby
allocated from the City's 1976 General Obligation Housing Bonds
and the section 108 loan from the U.S. Department of Housing and
Urban Development for the hiring of the law firm of BEATTY & SHY,
25 Southeast 2nd Avenue, Suite 247, Miami, Florida 33131, to
perform legal services including but not limited to the issuance
of title insurance binders and policies for negotiated
transactions and to render opinions of title with respect to the
filing of condemnation proceedings by the City for the Southeast
Overtown/Park West Redevelopment Project. The City will be
charged for title insurance premiums at the Insurance
Commissioner's minimum promulgated rate for the issuance of title
policies or a rate of $150.00 an hour for the issuance of
opinions of title.
Section 2. An amount not to exceed $30,000 is hereby
allocated from the City's 1976 General Obligation Housing bonds
and the section 108 loan from the U.S. Department of Housing and
Urban Development to cover the cost of such legal services.

It is recommended that the attached
resolution be passed by the City Commission,
authorizing the City Attorney to hire the law
firm of Beatty and Shy to perform legal
services including the issuance of title
insurance binders and policies and the
rendering of opinions of title with respect
to the filing of condemnation proceedings by
the City for the Southeast Overtown/Park West
Redevelopment Project.
The purchasing of land and the initiation of condemnation
proceedings are necessary for the success of the Southeast
Overtown/Park West Redevelopment Project. Obtaining adequate
title insurance and opinions of title are mandatory outgrowths of
these purchase and eminent domain actions, ir, order to insure the
transfer of legal title. The City Attorney's Office is not
permitted to issue title insurance since issuers of title
insurance are required to carry professional liability insurance,
not available to the Law Department. Therefore, it is necessary
to hire outside counsel to insure title.
The law firm of Beatty and Shy is a minority firm established in
1983. The growth in the firm's real estate practice has
paralleled that of the local real estate market. Members of the
firm have extensive title examination experience and are
authorized agents for Chicago Title Insurance Company, Ticor
Title Insurance Company, and Attorney's Title Insurance Fund. In
addition, members of the firm are active in the community holding
positions including President of the National Association for the
Advancement of Colored People and Treasurer of the Miami -Dade
Chamber of Commerce.
