HomeMy WebLinkAboutR-85-0614J-83-447 85-614 RESOLUTION ION NO • _ w A RESOLUTION CALLING AND PROVIDING FOR A SPECIAL MUNICIPAL ELECTION TO BE HELD ON AUGUST 13, 1985, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF J THE CITY OF MIAMI FOR THEIR APPROVAL OR DISAPPROVAL, AN AMENDMENT TO THE CITY CHARTER TO BE KNOWN AS CHARTER AMENDMENT NO. 2, PROVIDING FOR THE HOLDING OF PARTISAN ELECTIONS FOR THE OFFICE OF MAYOR IF THE PROPOSED EXECUTIVE MAYOR CHARTER AMENDMENT KNOWN AS CHARTER AMENDMENT NO. 1, SCHEDULED FOR REFERENDUM ON AUGUST 13, 1985 BECOMES EFFECTIVE, SAID PARTISAN ELECTIONS TO COMMENCE NOVEMBER 5, 1985; SETTING FORTH PROCED- URES FOR NOMINATION OF CANDIDATES; PROVIDING FOR A FIRST AND SECOND PRIMARY NOMINATION ELECTION; PROVIDING FOR THE NAMES OF QUALIFIED INDEPENDENT CANDIDATES TO BE PLACED ON THE BALLOT AT THE REGULAR ELECTION; FURTHER DIRECTING THE CITY CLERK TO CAUSE A CERTIFIED COPY OF THE HEREIN RESOLUTION BE DELIVERED TO THE SUPERVISOR OF ELECTIONS OF METROPOLITAN DADE COUNTY, FLORIDA, NOT LESS THAN 45 —' DAYS PRIOR TO THE DATE OF SUCH SPECIAL MUNICIPAL ELECTION. yx BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A special municipal election is hereby called and directed to be held in the City of Miami, Florida, from 7:00 A.M. until 7:00 P.M. on Tuesday, August 13 , 1985, for the purpose of submitting to the qualified electors of the City of Miami for their approval or disapproval a measure known as Charter Amendment No. 2, amending the City Charter by providing for the holding of partisan elections for the office of Mayor, if the proposed Executive Mayor Charter CITY COMMISSION MEETING OF J U N 13 1985 RESOLM 10 i N-S5-614 REMARKS ■ ir I W Amendment known as charter Amendment No, it scheduled for referendum on August 13, 1085 becomes effective, said partisan elections to commence November 5, 1085; setting forth procedures for nomination of candidates; providing for a first and second primary nomination election; and providing for the names of qualified independent candidates to be placed on the ballot at the regular election. Section 2. Said special municipal election shall be held at the voting places in the precincts designated, all as shown on the list attached hereto and made a part hereof and referred to as Exhibit No. 1, or as may be designated by the Supervisor of Elections of Metropolitan Dade County, Florida, in conformity with the provisions of the general laws of the state. A description of the registration books and records which pertain to election precincts wholly or partly within the City and which the City is hereby adopting and desires to use for holding such special municipal election is as follows: all registration cards, books, records, and certi- ficates pertaining to electors of the City and established and maintained as official by the Supervisor of Elections of Metropolitan Dade County, Florida, in conformity with the provisions of the general laws of the state; the same being hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records, and certificates of the City of Miami. Section 3. The ballot to be used in said election shall be so prepared as to comply with the laws of the State of Florida with respect to absentee ballots and to the use of mechanical voting machines or the Computer Election System (CES). W2a 85-614 ISection 46 In COmpI iance with +S100 * 342 t Plorida atatutesi the City Clerk is hereby authorized and directed to publish notice of the adoption of the herein resolution and of the provisions hereof, at least twice, once in the P fifth week and once in the third week prior to the week in which the aforesaid special referendum election, as herein set forth, is to be held in the following newspapers published within the City of Miami, Florida: which notice shall be substantially as set forth in the following form: NOTICE OF SPECIAL REFERENDUM ELECTION TO BE HELD ON TUESDAY, AUGUST 13, 1985 IN THE CITY OF MIAMI, FLORIDA PURSUANT TO RESOLUTION NO. 85- A special referendum election will be held on Tuesday, August 13, 1985, from 7:00 A.M. until 7:00 P.M. in the City of Miami, Florida, at the polling places designated and set forth herein, for the purpose of submitting to the qualified electors of the City of Miami, Florida, the following question: "CHARTER AMENDMENT NO. 2: Shall the City Charter be amended to provide for the holding of partisan elections for the office of Mayor if the proposed Executive Mayor a Charter Amendment known as Charter Amendment No. 1, scheduled for referendum on August 13, 1985 becomes effective, said partisan elections commencing November 5, 1985, with there being provisions made for placement of independent candidates' names on the ballot at the regular election?" r 85-614 Yen No Section 5. The City Clerk shall cause to be prepared absentee ballots containing the question set forth in Section 4 above for the use of absentee electors entitled to cast such ballots in said election. Section 6. All qualified electors of the City shall be permitted to vote in said municipal election and the Supervisor of Elections of Metropolitan Dade County, Florida, is hereby requested, authorized, and directed to furnish, at the cost and expense of the City of Miami, a list of all qualified electors in the City of Miami as shown by the registration books and records of his or her office and to duly certify the same for delivery to and use of the election officers designated to serve at the respective polling places in said election precincts. Section 7. For the purpose of enabling persons to register who are qualified to vote in said special municipal election to be held on August 13, 1985, and who have not registered under the provisions of the general laws of Florida and Chapter 16 of the Code of the City of Miami, Florida, or who have transferred their legal residence from one voting precinct to another voting precinct in the City, they may register at the following permanent branch offices as approved by the Supervisor of Elections of Metropolitan Dade County, Florida, which are hereinafter set forth and which will be open during the following dates and times: t W 4s ku 85-614 W FA 1d 11 ELECTIONS DEPARTMENT 1440 Biscayne Boulevard, Miami i Florida Monday to Friday, inclusive: 800 A.M.- 5100 p.M% In addition to the above times and places, said qualified persons may register at such other branch offices and may also use the mobile registration van for the purpose Of registration in order to vote in the herein described election during such times and on such dates as shall be designated by the Supervisor of Elections for Metropolitan Dade County. Section 8. RALPH G. ONGIE, the City Clerk of the City of Miami, Florida, is hereby designated and appointed as the official representative of the City Commission in all transactions with the Supervisor of Elections of Metropolitan Dade County in relation to matters pertaining to the use of the registration books and the holding of said special municipal election. The election clerks and inspectors to serve at said polling places shall be those designated by the Supervisor of Elections for Metropolitan Dade County for such purpose. Section 9. The proper officials of the City of Miami and Dade County are hereby authorized and directed to submit said question to the electorate at the August 13, 1985 special municipal election and to certify the result thereof to the Commission of the City of Miami, Florida, and all acts pertaining to said election heretofore performed by said officials are hereby ratified and confirmed. Doug erty Rai`€fZENCE5: Partisan Election of Mayor City Attorney ENCLOSURES: The City Commission at its May 9, 1985 meeting adopted on first reading the attached ordinance which provides for a separate Charter Amendment (No. 2). This ordinance proposes a charter amendment subject to a referendum on August 13, 1985, that will mandate partisan elections for the office of Executive -Mayor if the proposed Executive -Mayor Charter Amendment is approved by the electorate. If these proposed ordinances are approved and adopted on second reading at the June 13, 1985 Commission meeting, it would then be appropriate to adopt a resolution calling for a special election on August 13, 1985 which is the election date designated in both of the ordinances.
