Rescinding Ordering Resolution

(For Commission Meeting
ENCLOSURES: of June 13, 19 8 5 )
The Department of Public Works recommends
adoption of a resolution rescinding the
ordering resolution for N. W. 14 STREET
HIGHWAY IMPROVEMENT, H-4500.
' N. W. 14 Street Highway Improvement H-4500 was ordered by Resolution
• No. 84-1435 on December 13, 1984. The proposed improvement district
was located at N. W. 14 Street between N. W. 27 and 37 Avenues. The
estimated total project cost was $900,000.
On January 10, 1985, a public hearing was held prior to the scheduled
confirmation of the project by the City Commission. At the public
hearing, a petition against the proposed improvement was presented to
the City Commission. This petition represented approximately 45% of
the property owners within the proposed improvement district.
This improvement was to be funded by Local Option Gas Tax funds. Due
to a projected budget deficit for the fiscal year 1985-86, the City
Administration now plans to utilize all available gas tax funds for
the City's annual street light budget. Therefore, at this time no
funding source is available for N. W. 14 Street Highway Improvement.
For these reasons, we are not proceeding with the construction of
this improvement.
j
Also, passage of an ordering resolution for any of the City's highway
improvements, in effect, places a pending lien against all properties
located within the proposed improvement district. Since we are not
proceeding with the construction of N. W. 14 Street Highway
Improvement, it is now in order to rescind the ordering resolution
and thereby remove the pending liens created by Resolution No. 84—
`
T
1435.
