HomeMy WebLinkAboutO-10010G 85-S90 6/03/85 CM/IGA ORDINANCE NO, 10 0 10 AN ORDINANCE PROVIDING FOR THE HOLDING OF A SPECIAL, MUNICIPAL ELECTION IN THE CITY OF MIAMI, FLORIDA$ ON TUESDAY, AUGUST 13, 1985, WITH RESPECT TO THE ISSUANCE OF $7,0009000 GENERAL OBLIGATION BONDS FOR THE BAYFRONT PARK REDEVELOPMENT PROJECT, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Notice of the special municipal election heretofore called by Ordinance No. 10009 to be held on TUESDAY, AUGUST 13, 1985, shall be published in THE MIAMI NEWS, THE MIAMI REVIEW, THE MIAMI TIMES, DIARIO LAS AMERICAS, PATRIA AND BLACK MIAMI WEEKLY, newspapers of general circulation published in the City of Miami, Florida, at least twice, once in the fifth week and once in the third week, prior to the week in which said election is to be held, the date of the first publication in each of said newspapers to be at least 30 days before said election, which notice shall be substantially in the following form: NOTICE OF SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, AUGUST 13, 1985 IN THE CITY OF MIAMI, FLORIDA As provided by Ordinance No.10009 duly adopted by the Commission of the City of Miami, Florida, an election will be held on TUESDAY, AUGUST 13, 1985, for the purpose of submitting to the qualified electors of the City of Miami, Florida, the following question: Shall the City of Miami, Florida, issue Bonds in an aggregate principal amount not exceeding $7,OOQ,QOO under Ordinance #10009 to pay for the design and construction o Sayfront Park Redevelopment Project, at one time or from time to time and to mei:ura in annual installments P to P5 years inclusive, after the date of issuance of the reapectVe tones, with interest at lawful statutory rates', payable From unlimited ad valorem taxes? Ordinance No��vlCl, : provides that for the prompt payment of the principal of and the interest on such bonds there shall: be levied and collected annually an ad valorem tax upon all taxable property within the City of Miami, Florida, over and above all other taxes authorized to be levied by said City, sufficient to pay such principal and interest as the same respectively become due and payable. The City of Miami shall be authorized to issue said bonds if the question for the issuance of said bonds shall be approved by a majority of the votes cast by the qualified electors of the City of Miami voting on such question. Said special municipal election shall be held at the polling places in the City of Miami, in the several election precincts designated by the Board of County Commissioners of Dade County, as set forth below. The registration books and records, which pertain to election precincts wholly or partially within the City of Miami and which the City is adopting and desires to use for holding such special municipal election, are described as follows. All registration cards, books, records and certificates pertaining to electors of the City of Miami and established and maintained as official by the Supervisor of Elections of Dade County. Florida, in conformity with the provisions of the general laws of the State of Florida, are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records and certificates of such City. Section 3. Since the City of Miami has established the permanent registration system under State law, and the general election laws of the State require 14 days prior approval by the Board of County Commissioners of Dade County for acceptance of branch office registration and the closing of registration books 30 days prior to the date of such special municipal election, registration for such election shall be at the Office of the Supervisor of Elections of Dade County, 1440 Biscayne Boulevard, Miami, Florida. Section 4. Said special municipal election shall be held at the polling places in the several precincts, respectively, in the City of Miami, Florida, as set forth in the foregoing NOTICE OF SPECIAL MUNICIPAL ELECTION. Not fewer than 20 days before said election the City Commission shall designate the Inspectors of Election and the Clerk of Election for each precinct and shall publish the names of such Inspectors of Election and Clerks of Election in a newspaper of general circulation published in the City of Miami 15 days before the date of election. Section 5. All qualified electors of said City shall be permitted to vote in said special municipal election and the Supervisor of Elections of Dade County is hereby requested, authorized, and directed to furnish, at the cost and expense of the City of Miami, a list of all qualified electors residing in the City of Miami as shown by the registration books and records of the Offioe of $aid Superviaor of Elections and duly certify 0 0 the same for delivery to and use by the election officials designated to serve at the respective polling places in said election precincts, Section 6, RALPH G. ONGIE, the City Clerk of the City of Miami, Florida, is hereby designated and appointed as the official representative of the Commission of the City of Miami, in all transactions with the Supervisor of Elections of Dade County in relation to matters pertaining to the use of the registration books and the holding of said special municipal election, Section 7, The official ballot to be used at said election shall be in full compliance with the laws of the State of Florida with respect to absentee ballots and to the use of the Computer Election System (CES), and shall be in substantially the following form, to wit: OFFICIAL BALLOT SPECIAL MUNICIPAL ELECTION TUESDAY, AUGUST 13, 1985 FOR APPROVAL OR DISAPPROVAL OF THE FOLLOWING QUESTION: ORDINANCE AUTHORIZING ISSUANCE OF $7,000,000 GENERAL OBLIGATION BONDS FOR CONSTRUCTION OF BAYFRONT PARK REDEVELOPMENT PROJECT : FOR BONDS AGAINST BONDS s Shall the City of Miami, Florida , issue Bonds in an aggregate principal amount not exceeding $7,000,000 under Ordinance # to pay for the design and construction of the Bayfront Park Redevelopment Project, at one time and from time to time and to mature in annual installments 2 to 25 years, inclusive, after the date of issuance of the respective bonds, with interest at lawful statutory rates, payable from unlimited ad valorem taxes? 7 4 Section 8. Electors desiring to vote for the bonds, in approval of said Question described above, shall be instructed to punch straight down with the stylus through the hole next to the word "EOR" within the ballot frame containing the statement relating to said Question. Electors desiring to vote against the bonds) in disapproval of said Question, shall be instructed to punch straight down with the stylus thrrugh the hole next to the word "AGAINST" within the ballot frame containing the statement relating to said Question. Section 9. The City Clerk shall cause to be prepared absentee ballots containing the Question set forth in Section 7 above for the use of absent electors entitled to cast such ballots in said election. Section 10. This ordinance shall go into effect immediately upon its passage and shall not be subject to the right of referendum as an ordinance. The date of the election and the amount of the bonds to be issued have been left blank in order for the Commission to make its final determination as to the funds that are needed to complete the Bayfront Park Redevelopment Project and the most appropriate date to hold the election.
